In this video we have discussed about the 127th Amendment bill, which is now the 105th Amendment Act of the Indian Constitution.
This is also referred to as the OBC bill which has been passed by the Parliament recently. The video tries to explain the provisions that are inserted by the 105th Amendment Act. How an Amendment Bill is different from an Amendment Act?. How will this amendment benefit the Socially and Educationally Backward Classes or as we know them OBCs? 1:06 : you are WRONG . Political reservations for Scs & Sts was for 10 years initially and it is provided that if found necessary it can be extended by another 10 years and so on. It was not fixed for 70 years. There is no such periodic limitation in respect of reservations in jobs n education…

The initial reservation were only for sc &st article 15(4) and article 16(4). OBCs were included in the ambit of reservation in 1991 article 15(5)

not really - private jobs are free of reservations and will likely stay that way for some time ... or migrate to places like uttrakhand where UC's have high population and will keep a tab on limit of reservations. plus government jobs are less than 1% of all the jobs in the country - it doesn't make any difference - even for the sc st obc's if they get all the seats - why ? because if for the past 70 yrs nothing has changed - it'll not change in the coming years , the creamy layer of sc st will keep getting benefits , rest will be deprived. reservations are just political gimmicks.

@@mother.95 you r right , actually this ammendment was made to nullify the decision of sup.court in champakkam dorairajan vs. state of Madras in which sc declared the law made by Madras govt in which they reserved seats in med and engineering colleges on the basis of religion ,race and caste. Sup.court declared the law to be void as it discriminates on the ground of caste etc and it's voilation of Art.15 . . Here backward includes sc and st . And other backward classes also, in both the clause 15(4 & 5)For sc and st there is a reservation since the commencement of constitution but obc had given recognition only after mandal commission .

First of all, why the reservation??, Second why subsidies??. These two things killed India's progress, India was a skilled, righteous and duty bound citizens who never ever begged or demanded for their basic rights and authority. Handful of British to rule these large number of subjects wanted sympathizers, followers, slaves, stooges in to their side, so the reservation devil came onto the picture. Due to these two draconian law, all learned,educated, professional are drained out and settled abroad and doing miracle over there. Instead of this, try to encourage the uneducated to do education, while giving that try to give them the knowledge of current affairs, technological advances etc. All tribes were skilled in an PERTICULAR way, caste is not even herd in india till 18th century. Shahu Maharaj was the first to implement caste-based reservation in the modern era of India. He declared 50% reservations from which only four castes were excluded: 1) Brahmin 2) Shenvi 3) Prabhu and 4) Parsi. All other castes except these were declared as constituting the Bahujan Samaj.

SECC Caste survey was conducted in 2011 by ministry of rural development and Urban development for rural and urban areas respectively but was never made public.

@@Viraj_2305 i don't believe that's a utopian idea of providing reservation on the basis of economic condition of the citizens as we are already doing so ( EWS - 10%) we only need to identify the loopholes in the EWS portion, the criteria is set for 8 lakh per annum which covers a good amount of population! Apart from that census taken based on caste and creed itself provides for caste based distinction and the benefits of reservation often don't even reach the needy. So the correct way of implementation of reservation is actually economic based census and provisions that matches the socio- economic conditions.

@@Viraj_2305 yes i know that reservation is not a poverty alleviation programme, still does not justifies it efficiency after years of its implementation i believe now we can look forward for better methods to mainstreaming the downtrodden rather than just affecting the administrative efficiency. And why economic reservation should be provided is because they actually need the reservation to catch up into mainstream . Reservation right now is like a painkiller tablet which is just numbing the pain and not doing much for the disease. Reservation was very good policy when it was implemented but in current scenario it's a stagnant policy with very less relevance. @@factshut9675 it's not about ₹ 3000 crore, it's matter of representation, if someone from unprivileged class is in power, then you can see if someone dare to beat and dragging a weak person behind running vehicle, they manage to do because most of the influential position are hold by people belonging to same class like police officer, judges etc. And so culprits belonging to privileged class manage to escape... So u educated facts person, it's not about rich / poor, it's about ensuring social justice in different sphere of life of people belonging to marginalised/unprivileged class

@@Aryavart591 But, you will have more people of baniya community into business(because they have been doing it since ages),you will have more brahmins in teaching line or medical line( because they their ancestors have been doing this since ages and it is a normal thing for a brahmin parent to ask his/her kid to become a teacher or a doctor),you will have more people from rajput community in Indian Army(because their ancestors have been fighting battles since ages),you will have more people from Yadav community in animal rearing and army(because they have been doing both since ages) now, our constitution allows anyone to become anything but, if you reserve certain percent of seats for Yadavs(let's say) in teaching industry then indirectly you are adding those people who are not into teaching and are just pursuing it to earn money on the other hand you will lose those people who wanted to become good teachers.......There is no reservation in Indian Army, it doesnt mean a SC cant get into Indian Army, infact there are many SCs in Indian Army and we have 4th best army in the world and, you know how bad we are in those things where we have reservations.

@@lefttoright7831 don't go back in history, it's full of lie, mythological & superstitious story articulated/written by so called /declared themselves people of God and superior by keeping majority of native people in ignorance by making various cunning laws on the name of God, I don't know who is balmiki ..if u know, then u should know only upper caste were allowed to read/write...so better see the reality what's happening in society, still even in 21st century, reflection of past is still persisting.. If there is casteism, it's only because of rule created by selfish people who used God for their own benefit ... What was there in history, doesn't matter, see present reality, it's truth, society is divided on basis of caste, those born in upper caste are declared only as upper, otherwise there would have been marriage between upper caste and lower caste if both are economically/educationally at same level according to your ancient theory, so better u gain knowledge, Also if you are against reservation then you should clear your perception about getting jobs, even if all vacancy filled by so called upper caste, even then there will be unemployment among majority of upper caste youth, because vacancy are very very low as compare to eligible candidates, so if somebody do not get job, they began to curse unprivileged candidates as if all people belonging to unprivileged class are doing jobs

Yes Govt has pointed that the aim behind was to benefit the economically weaker ones within the general category who were left out of reservation benefits due to non-eligibility and 50% mark can be overlooked with proper data and evidences for the exceptional cases. T.Nadu has 69% reservations. Ample cases are there of the breach of 50% mark.
