Wrong. Qualified immunity only applies in civil cases. If cops went through the criminal system, like normal citizens, no immunity would apply and guilty cops would go to prison.

Yes because the cops should know that they are actors playing a role, as baby sitters because the entire population is considered a child, a ward, a man or woman that doesn't know how to act as a representative of his or her title I'm sorry it's not there fault they are stupid, but cops get tired of protecting people that don't even understand what it means to be American, people actually think you can come here and be considered an American, 😂😂😂😂😂never, you may become a citizen subject, but you will never be American, because you are incapable of understanding certain concepts, people want free-dum they wanna be free and dum, instead of just free.

Remember: qualified immunity is designed to protect government officials who have broken the law or violated someone's rights but when an ordinary citizen breaks the law they're told that ignorance of the law is not a defense.

It doesn't protect all government officials equally either. If a teacher walks into their classroom and guns down a student, there's not a prosecutor, judge, or jury in the country that would believe, "Gosh, there just wasn't any precedent in this circuit saying that executing my students was a violation of their rights. I should get qualified immunity."

This goes above any individuals freedom, we should all be ready to sacrifice our freedoms to achieve true justice on the street when presented with tryanny. The courts are not aligned with justice, we will not find the solution in the jaws of the system

Qualified Immunity should never apply to illegal activity. Qualified Immunity exists so that minor mistakes do not end up in lawsuits. It's not supposed to be a shield against committing actual crimes.

@@hugoh.9694 and they need to stop using ‘woke’ (short for awoken or awake, waking up) as an insult. We all need to wake tf up. The system is about keeping the average person in their place and to protect the rich without restricting them. The average person doesn’t get protection. Just try to report a burglary and see how little they care. Compare that to someone caught shoplifting a can of baby formula or lunch meat. Waking up to the terrible way the majority of us are treated is a good thing but those with influence had to try to turn it into an insult, that way the masses distance themselves from it.

No police or law enforcement officer should be able to use qualified immunity as a shield for wrong doing in circumstances which are not clearly defined as “official capacity”. Regardless of whether they are on duty or of duty if they are not enforcing the law or engaging in an active investigation they should not be granted qualified immunity. Why would a judge need case law or legal precedent to make a ruling which is so blatantly obvious.

⁠telling an alleged abuser his girl is reporting him is common sense he is putting her in danger. That is pure corruption. That is criminal investigation and got that woman hurt with a no shit Sherlock behavior. “Qualified immunity” as a matter of a cop working within rules either not yet ruled unconstitutional but later is and maybe reasonable to assume it was legal or a mistake the officer was not in a position to know but that the city or department could be liable is a good thing. The cop worked within the law but this was a suspect was informed their was a witness against them to what, protect his friend another cop. That doesn’t take a lawyer and a court to make that clear that outing her is danger. If for example he was on the take is that any different in reality than having a emotional reason to interfere with the case versus a monetary compensation.

Nothing is confidential with the police. A confidential informant gets named in someone's discovery when they get indicted. That's how it works in Ohio anyway.

Are you one of those mythical "good cops" we're always hearing about? I've heard people talk about them for decades but I've never met anyone that encountered one. (like unicorns or bigfoot) When you see a coworker violate someone's constitutional rights, do you throw them to the ground, handcuff them and tell them "that's against the law" rather than just standing back and watching because you don't want to make waves in the department? when I was a mortgage broker I had a coincidence of having three separate females who were either ex-girlfriends or ex-wives of police officers that confided in me during the processing of their loan documents probably related to credit issues about the abuse they suffered at the hands of the police officers. I think the country would be shocked to know that high percentage of domestic abuse amongst police officers. in one instance the ex-boyfriend officer kicked in the door of his ex-girlfriend and took a flat screen TV off her wall and two other officers (not in uniform), his friends, came in the apartment behind him and helped. He flatly told her "oh you want to call the police?" and he laughed "just imagine who's going to respond they're all my friends." I actually had some connections with the sheriff at that time and I offered to get involved but she was so afraid of the retaliation she asked me not to say anything and she just accepted the abuse. by the way the flat screen TV was something she purchased with her own money and he decided he wanted it after she dumped him, so it was a burglary and forced robbery by a police officer.

The idea of circuit splits in general are unconstitutional for the reasons you stated. It makes federal law different for different people, which is a violation of the 14A. Suprised SCOTUS doesn't know that.

Arbitrary enforcement, ambiguity and subjectivity. Designed to allow any judge hearing the case to throw out ANY case they see fit to ignore by simply saying... "these two cases are just not similar. ​@@hugoh.9694the primary issue with the prior case rule is no 2 cases are ever the same. Even when the conditions are similar the people are different That is no way to apply law. To think some of the farmers believed the bill of rights was not necessary is hard to understand. But back then loyalties and government service meant very different things. Some genuinely believed the constitution itself had enough safeguards because why? The individuals serving in government are "we the people" too. As I said very different today.

If the judges require a previous case with the exact same circumstances in order to fit the “clearly established” definition, it’s a losing battle. They have to set precedent with a first case to refer to.

That is precisely the point. They are afraid that this case if ruled in favor of the plaintiff would jeopardize the now loosely interpreted shield of “Qualified Immunity”. It would create a legal precedent which would weaken qualified immunity by raising the standard by which q.i. would be deemed an acceptable defense.

That was the magical unjumpable hurdle SCOTUS intended when they illegally created QI. Many don't seem to make the connection that all these agencies, SCOTUS, Law enforcement all fall under a single umbrella called government. The greatest threat to the government is the restrictions imposed by the constitution. Systematically they have been dismantling the constitution. 1st amendment - no law shall be established - Courts, ah but time, place and manner restrictions. 2nd amendment - Shall not infringe - Courts, Well except in this case, that case and whenever we want. 4th amendment - secure in person, papers and effects - Courts, well there is that reasonable word so instead of probable cause we will reduce that to RAS of a crime. 5th amendment protects against self incrimination and the right to remain silent Courts, only if the person invokes this right verbally. 6th amendment right to have an attorney present during questioning. Never seen a situation yet even after invoking this right where the cops don't incessantly interrogate, harass, threaten, pretend to make deals with someone to trick them into answering questions.

Qualified Immunity should only be given to officers when they are acting in an official capacity, even then only when their conduct is within the bounds of the law. That should be the standard by which judges would grant q.i. as a valid defense. How can they call it qualified immunity when there is no standard and the only requirement is being a law enforcement officer.

@@ExestentialCrisis So both the confirming officer and the abuser committed criminal acts. The abuser was not acting in his capacity as a cop, so he should be criminally charged with the abuse, and should not in any way gain qualified immunity.

The 'precedent' concept makes no sense whatsoever. If these judges cannot make a decision when the facts are before them, using existing law, then they should resign. It appears obvious in these cases that being a judge is not a 'good fit" for them!

@@jeannineharrelson1201why isn’t it fair. The statistics point to law enforcement officers committing domestic abuse at a rate of 40% of all officers, and that is definitely underreported. They tend to protect their own and stuff like this gets swept under the rug quite often. He’s not saying she deserved it, she definitely did not. He is saying she rolled the dice probably aware of said statistic whether she believed it or not. Why should he feel sorry for her?

"Above the law" is literally what Qualified Immunity means. Federal judges (and all Federal employees) enjoy something called ABSOLUTE Immunity. And you can here thinking Q.I. had anything at all to do with law or justice. 😂 "Corrupt judges" sounds a lot like wet water or hot fire.

There is a huge problem amongst judges, there are many judges who are biased towards the prosecution and police. Not all judges mind you but far far to many. It leads to situations like this where one side is clearly abusing qualified immunity! This is unacceptable and I am so glad that IJ is taking this case to the supreme court

Qualified Immunity needs to be a thing of the past. If the state has no obligation to protect the private citizen, from anyone. Then agents of the state should not get a standard of protection from their actions that the private citizens does not get.

Enforcement of the VAWA act needs to happen asap!! I live in Central WI and it is NOT enforced- the police dept does not protect people in domestic violence/abuse or survivor situations. They refuse to do it even when made aware. Happened to me.. put me and my kids in and unsafe situation which we are still in and there's zero support here. In fact they cut funding for our local women's community/domestic violence agency for support.

The real issue is qualified immunity only protects these people in civil court, not criminal court. DAs need to file charges when the law is broken, cop, judge or politician. This cop clearly broke a law by disclosing a confidential report to the abuser knowing he had opportunity to abuse his victim further. The bare minimum should be that this cop should lose their certification.

Thanks for pursuing Justice. You guys at IJ are awesome. The question is how can we eliminate qualified immunity and absolute immunity for police and prosecutors. How can we get people to pressure their legislators to write laws to make it easier to go after bad actors. Also Judges and their lackadaisical approaches of looking at facts.

This is happening everywhere! My ex tried to run me, and our son down with our truck. First, the Police refused to serve him with a protection order. Only when the Police were confronted about it, did they serve him. After he kidnapped our Son, whom was listed on the order.

They also know that it's socially frowned upon, and they don't want to be perceived as a bad person... It comes down to right or wrong. We are either going to recognize that or not. There's no other consideration. Government actors should pay for their CRIMINAL actions (and punishment should be severe, bc they come with the power of state). Do you think the judges and prosecutors who also benefit from qualified immunity will ever give that power up? Highly unlikely. This will be a never ending issue. If it was a citizen committing the same crime they would be rightfully punished. We have no control over our government when this becomes the process.

Qualified immunity should only apply within conduct within standards of conduct. In obvious commission of crimes, as in this case, qualify immunity should not apply and both officers should face legal consequences for their deliberate actions.

I'm so confused. Why are we talking about needing similar cases when someone did something clearly wrong and why are we talking about how force is used? It's a domestic violence case where one person happens to be a cop, who isn't even at work. It is disturbing, how the courts have clearly, done such a bad job, over time, they don't even know how to function, to the point they can't even prosecute a really obvious case.

Look at the organization responsible for several of the current Supreme Court Justices.... and look at how many of these local judges are a part of the same group. The erosion of democracy is intentional, and these people believe in and spread conspiracy theories because they are telling on themselves.

The only thing I don't like about IJ is they will not represent you unless you already have a lawyer and suit filed. I can never find a lawyer to take my case. No one wants to go against the cops.

As Steve explained, the IJ strategically selects existing law suits that they determine are good candidates to carry appeals to the SCOTUS in the hope of changing the law nationally. They do not have the resources to do otherwise.

That’s such an absurdity. Qualified Immunity is an excuse to ignore the clearly established body of Law for any reason. the Judge did not have to rule that way. They chose to ignore what is clearly established regarding the Duty of a Police Officer. And what is far outside of it. Leaking Reports of Criminal Abuse, to the Abuser is well outside of the Line of Duty. And is an Abuse of that Power, and a danger to the Victim of the Crime. That was and did abed a Crime. That is clearly outside of Duty, Abuse of Position, to Conspire to not only hide a Crime, but Facilitate further Criminality. That Judge is no Judge. They themselves are using made up Law, in order to allow the Abuse of Power to continue. I need that Judges name. It’s malignancy should be attached to everything they do and say. Observably. Disrepute upon the Courts is no joke.

Qualified Immunity doesn't apply where personal injury applies and the Officer who is personally contacted doesn't prevent victimization knowing they could, as a polite way to put it. This application of qualified immunity is just bogus.

We don't need more courts making more laws. We need SCOTUS to over turn it's original QI ruling and refer the concept to Congress to make a law on the manner. The complaint was supposed to be confidential and was marked that way? That should be sufficient to disallow immunity. You don't read confidential items to the subject, telling subject who filed it. Whole reason for confidentiality is protect filer. Qualified immunity is too hard to beat. Common sense should apply in law.

That was a violation of her rights with intent to do harm. Throw both officers in jail and throw the ninth circuit in jail with them unless they can prove low mental acuity, in which case they need to be fired. This whole thing about precedence is pure gaslighting.
