On the Enforcement of Child Maintenance Payments

1 in 5 single parents on benefits are lifted out of poverty by receiving Child Maintenance Payments.
It's essential the Government ensures fair enforcement of Child Maintenance obligations. I spoke in Parliament about the lack of enforcement of these crucial payments since the pandemic, and urged the government to resolve this issue swiftly.

I have 50/50 equal day to day shared care. I have sent in countless amounts of evidence to support that the level of care between the two households that my children live in, is no different at either. Change of circumstances rejected. This is despite it clearly stating in their legislation that if the day to day care between a paying parent and recieving parent is equal, no maintenance is to be paid. Furthermore, I actually claim Child Benefit for one of my two children, and when I notified the CMS of this, they asked me to open a case against their mother to counteract the one open against me. When I explained that this would be fraudulent to the point I have made above, I got this response from the person on the phone..... "Dont worry, we can find a way" I believe the CMS and it's legislation, is Corrupt, Unfair, Biased and needs a reform. No way on gods green earth should you take the word of someone getting free money (RP) over an investigation into each case. Not to mention the number of dads that take their lives each year due to spiteful, abusive exes and this system, which go hand in hand unfortunately. I believe the CMS actively promote parental alienation and its director should be brought forward to answer criminal charges.

The CMS took £19,269 from my bank account without a court order, but backdated it to 1999. Fortunately, I had kept my records and made an appeal and they conceded. They have now admitted error, but are now trying for a smaller amount despite signing the consent order. They are criminals.

How did you get on mate ? I’ve had the same issue but in the last 5 years all made up based on fake tax arrears they made up , appealed and I’ve recorded everything aswell as evidence, still waiting. For a response as there’s that many complaints and appeals the bloke is 1.5 year behind , meanwhile there frauding me again

Matt, are you aware that the majority of parents having to pay child maintenance are doing so because they are alienated from their children, If the care of children is split equally there is no need for either parent to pay child maintenance, however this doesn’t create any revenue for the government, so it is beneficial to the government if one parent ( usually the mother) alienates the other parent, usually through false claims of domestic abuse, they can then claim child maintenance. with regard to enforcing the payment of child maintenance, most parents refuse to make the payments as they would much rather see their children and use the money to look after them themselves! Ask the government if it has any statistics on why parents refuse to pay child maintenance, I’m sure it doesn’t but if it did it would be for one of the following reasons 1. I’m spending all my money trying to get access to my children. 2. I’m not paying because paying it is like a bonus payment for my ex-partner alienating me from my children. 3. The calculation is based on fictitious amounts. If all separated parents had shared care of their children there would be no reason for child maintenance and that’s what the government should be aiming for! Could you please report the turnover of the CMS each year including its profit.

Reform of CMS and a more complex calculation is required, factoring in resodent and non resident earnings, assets, costs, lifestyles. Cms should be capped at 3 x child tax benefit, max 240 per child a month,

The Takings Clause of the Fifth Amendment, which derived from the Magna Carta, is a right against the uncompensated takings of property. In simple terms, if the government takes one of your property interests away-like the right to exclude others from your land-it must immediately pay a fair price for the value of that property interest. If one person wants a baby but the other dosen't. The UK and USA are the only places on earth that unlawfully force a person with a Y chromosome into farther hood.

Employers are never obligated to pay anything towards a family. If you have One child or Twenty children your wage stays the same. It's such a massive con. In a 1950's Nuclear family situation where the father earns a decent wage which covers a family then it is appropriate. In the current system where employers pay MINIMUM it's rediculous exploitation. Minimum wage is enough to cover ONE working adult. If you strip them of 30-40% then those men are literally 30-40% below the basic living standard. The maths just don't add up. It's an absolute con job. Employers are posting record profits because our wages don't cover family. Government is bailing out/subsidizing rich global employers. Who should be paying wages which support families.

What an absolute crock of shite. My fiance has been put into 15K of arrears classed as diversion of income from LTD company yet CMS fail to state where its being diverted too? Plus theres no evidence of anything being diverted anywhere. Awaiting tribunal like thousands and thousands for the CMS F*ck ups. Incorrect calculations, Mandatory reconsiderations rejected. No longer a chat service on their portal which is also not fit for purpose. 4 hours on hold before you get told a caseworker will ring when they never do. The list of fails are endless. CMS need shutting down. Trying to wedge more friction between the mother and father and applying DEO incorrectly. taking money direct from bank accounts not leaving anything for them to get by and pay for their children living with them. Its disgusting how an assessment of £50 for one child per week but then only get £5 deducted off calculation per week because theres a child living with us. Why is it that the child living with the resident parent is worth more than the child living in the non resident parents house. Surely it should be equal.... but no CMS do what they want to do and f*ck what happens to the resident parent. until ultimately it ends with DEATH

They breached the regulations twice and involved my local MP. The DWP gave the correct response but the CMS still breach regulations. There needs to be an ombudsman service for cases and powers removed. They are incompetent and they ignored all my complaints and requests.

You forget that most men who pay child maintenance are extorted! I lost my job from COVID, and i've been in arrears with the cms for 3yrs so far, and I'm being extorted! I dont get the opportunity to have my kids over as i cant afford a flat or apartment of my own! I live in a damn sharehouse and i earn 45k per annum! Absolutely needs reform. Good fathers, bad mothers and vice versa. There should be no blanket opinion, but if a parent isnt paying and actively avoiding paying for their children and avoiding contact with CMS, enforcement action should be taken straight away. 6 months of my ex lying about not working, despite CMS having his full time income and emails from his new employer, and yet all i get is 6 quid a week for two kids.
