I'm going through this mess with Orchard. I'm a singer/songwriter. I own full copyright to my songs and production. Orchard claimed 2 of my videos as their "sound recording." I disputed each claim stating I did not record with Orchard and that I have official certificate copyright to my very own songs. They rejected my disputes and still claim my videos. Ive deleted videos because its wrong of them to put advertising on my songs. I'm very much disheartened by this. Boo The Orchard. I curse them!

As a small record label, I use The Orchard, as tens of thousands of labels do, as my aggregate to get my music on iTunes, Amazon, Beatport etc. They are the largest digital portal for independent artists. Tunecore is another one. As part of our contact they monitor KZbin & other services looking for copyright infringement. So when you get those letters, it's on the artist's behalf which is why it says it's owned by The Orchard. They are our rep. They also agree to handle everything for us.

I recently did a review of a game called "Die by the Sword." The video only features tracks downloaded from KZbin's OWN library, and the in-game soundtrack. But somehow, the Orchard still managed to identify the IN-GAME SOUNDTRACK as one of their own tracks. I obviously filed a dispute, but this is madness. The evidence of the source is even there, directly in the video, as it plays simultaneously with the footage it was filmed from. They're getting a very angry mail from me, if they don't do something about this. The actual rights of the music belong to Treyarch and Interplay.

Good news! I disputed the claim and within two days a message came through from YT. I went like this: Your claim has not been reviewed in 30 days, so all your copyright restrictions have been lifted. I don't remember the exact words, but how could they even send a message saying it's been 30 days if it's only been about 3 or 4! Some kind of major fraud is going on here, but make sure all of you facing the same problem disputes the claim as they will most probably remove all restrictions

Yes, I understand that. The problem is that Orchard Music Group is claiming music that they are NOT licensed to claim. PERIOD. It does not belong to them OR their licensees. Several times they've claimed music I used in my videos composed by Kevin MacLeod. I've contacted him about it. He does NOT use Orchard Music AT ALL, and the works I used are CREATIVE COMMONS, FREE FOR USE. If you're using Orchard Music, I suggest you find another licensing company; this one's not reputable IMHO.

I recently got a notification from youtube was matched to orchard music and I refuted this restriction and yet it was upheld.. I have no music on my video.. I found your part 1 video and emailed Orchard Music and low and behold they sent me a link to their blog... yes I was angry I took some legal advice and contacted them using the info you supplied and within half an hour the copyright claim simply disappeared .. I have a current dispute with The Orchard Music for their claim against a video that I uploaded to KZbin which was downloaded from Pixabay website which licenses their videos under the Creative Commons license CC0 for commercial use. I've also written a letter to KZbin detailing additional information with regard to my claim dispute. Not sure if KZbin will even read the letter, but I've mailed it to them and they should have received it today. Not contacting The Orchard Music at this time as I don't want to let them know what I'm doing to fight their claim just yet.

I just got one of these stupid notices on one of my videos. While I do not own the rights to the song that I am singing in the video...neither does "The Orchard Music". The song belongs to "Elvis Presley Music" who I mentioned in my description. It also says "R.B. King-The Orchard Music" owns the rights to the song. I googled R.B. King and he is a medium talanted singer trying to sell Elvis covers on Amazon. I can't figure any way to discuss this with youtube. Do you have any suggestions? Terry

My bands entire album has been uploaded onto youtube and it says "Provided by Orchard Enterprises" I own the rights to these songs and they are registered with BMI. Orchard was not given permission by anyone to use these songs. BMI has been contacted. To be continued....

When a party can act, but fails to do so, odds are great that the party benefits from it's own inaction. In this case, it seems that KZbin itself is most likely benefiting from it's refusal to act. In fact, I would go so far as to say, given their past history of other monetary chicanery, Orchard is probably, on some level, a front to funnel advertising funds (that they seem to no longer wish to distribute to others basically because there is such a large volume of others) back to themselves. They've been caught red-handed tweaking monetary variables under the table to their own benefit before - it looks like this is just more of that.

This is still going on, almost 2 years since PedalingPrince posted this. I just posted a video on my channel using a song with a creative commons license - "Attribution-noncommericial 3.0 United States License" (where I have to attribute the work) and it was tagged by KZbin saying "The Orchard Group" owns it. I disputed it, waiting to hear back now. Chisztle - What was the outcome of your meeting to flag "The Orchard Group"? TTHOfficial - What was the outcome of suing them? class-action?

An absolute hats off to you sir, for putting out such videos against shameless scammers looking to profit off of other peoples hard work. The incident which happened to me is as follows: This happened to me as well for a piano piece . I'm absolutely sure that the piece I played is in the public domain and checked before uploading. Now I'm also aware that some versions of the piece, especially concert pianists versions are copyrighted, but this was my own performance! So as soon as I finish uploading, I get the "Orchard Music" group claiming my music, i checked a few forums and the sheer amount of other covers of the same piece and formed my decision to dispute the claim. This is all done on the 2nd of January,2016. Now im waiting for their reply and for the time being they have removed all of their restrictions, but im like absolutely sure theyll claim it again! Anyway, just if you seem this is out of order: The piece I uploaded is the "Piano Sonata No. 16 in C Major, K. 545, Mozart" The piece they claimed was Giampaolo Muntoni : Piano Sonata in G Major, K.545 . The titles are absolutely different, but the music after i hear it is the same, but a different person playing it at a different time. Now all of the people viewing this be the judge, a piece of music published in 1788, definitely in the public domain ,which i checked, was flagged for copyrighted content. As far as i know, covers of music often different from each other, cant be copyrighted, but i even wonder how far people will go for money ! They fixed it! The Orchard Music granted my appeal and removed their hold on my video. A second simultaneous hold was filed by BFM Digital. They tried to escalate the issue on KZbin but immediately released their claim when I emailed them and then called them on the phone today. BFM threatened to place a strike against my account if I lost the second appeal. They were much more polite on the phone.

John, I love the fire in your belly. I make money on my channel and I have to deal with at least one of these claims every week.. Most release their claim but like you Orchard aren't and now I don't get the money. Like you I only use PD, CCa0.3 and CCs+1. Your argument is great but you leave out one big piece of saga. When these fraudsters make their false claims on videos that would normally not have ads because the youtuber isn't a partner, KZbin all of a sudden can sell that ad space.

Thank you so much for letting us know about this scam! It seems like they continue to open so called copyrights claims!!! Because I just received TWO disputes today from the orchscam music group. I have just filed two dispute claims back to them since i am using creative commons free for commercial use music in my video clips. Remains to be seen what will happen now. You have made an excellent point, that Orchard, when they are finally prosecuted for their criminal false claims of ownership, must not only owe all of the royalties they have fraudulently collected, but they should also owe interest and punitive damages, IN ADDITION to criminal penalties.

I have 6 Albums and believe me I will be on this like white on rice because if they pretend they own 100 percent of a few of my songs they will claim more and more. I'm on it. I have had this on one of my videos, which is a let's play - the soundtrack owned by the game publisher, and otherwise my voice - neither of which owned by orchard. I have emailed them, just waiting now. The video is set to private until they take it down, they're not getting any money of my videos.

Just set it to private, screen cap all your proof of permissions, like if it's in the PD, and put that in your dispute - as well as emailing them. Their claim was released on me within two days though the reason for it being released was that "it had not been reviewed within 30 days" which is odd considering the whole claim lasted less than a week :3 I can just hope if people set the videos to private until the claimes are released that they don't make as much free money.

They just have a very very wide peramiters set for things they consider theirs - what they give to youtube for their automated system - there was one incident where they tried to claim the sound coming out of someone's throat for two seconds during an interview, it's just an automated thing - but they've cast a wide net. I wish you luck and that they reply promptly, this happens so much with gameplay, you'd be surprised.

My show is dealing with country gospel music and is made up of my original music and that of my guest who I would certainly have permission to use,on two occasions,I was flagged by them,One was on a soundtrack that was, and the other was a music video, that I know for a fact was not in any way associated with orchard. On top of that my show is also aired on a hand full of tv stations, so I have to make sure of stuff like that before they are aired anyway. So is any of their claims legit?

Any outfit operating this way might be a scam outfit. You notice they dispute but do not ask that it or the Ad be taken down. A possible scenario for any scammer could be to claim rights and put videos into dispute. This, if not counter disputed successfully would mean the scammer would end up owning any monetary income from the playing of it even though it stays on your site and the ads play too. If someone does dispute one, they quickly release it to avoid more complaints from you to KZbin. Meantime, thousands of people and sites do not bother to dispute it for the trouble it seems to be, so the scammer ends up with a certain percentage, probably larger than we might think, of hijacked videos with the ad proceeds being funneled to them. If this is the case, it certainly would qualify as a scam and fraud on top of that. Any fraud on the net is also automatically considered 'wire fraud' and serious business. If you are sure you own the rights or it is original music and playing, or even public domain, I suggest you report them to KZbin and the federal authorities. Another alternative is to take the ads down so they can't benefit from your views of it.

I just sorted a problem with them. I disputed via KZbin and wrote directly to them as well (following Jordan Mulsons advice - cheers). The video in question had no music only natural sound effects all from sources that were free, or that I already owned or recorded on location. It has to be said that it´s completely outrageous that a system exists that allows either KZbin or Orchard to waste peoples time in this fashion. I asked Orchard to clarify how exactly they came to the conclusion (either automatically or otherwise) that the ambient sounds in my video were copyrighted music that they handled... obviously, no reply. By all rights KZbin should not allow them to function on their system if they have had that many complaints about how they mis-detect soundtracks. Imagine somebody from a shop being able to stop you in the street and making explain where you bought your jacket because they "think" it looks like one they sell in their shops??? Fair enough if the system is accurate... but if not they should be sanctioned... thats what they expect KZbin to do for them... seems only correct and professional.

Thanks for this. I worked bloody hard to find public domain Jazz tracks to use on a film I shot for my brother in law (It was for his proposal to my Sister). I was baffled to find these claims as I'd even checked with the Performing Right Society, here in the UK. What really annoys me is that I got offers for promotion in local press, which may now be withdrawn dude to copyright dispute. Needless to say, I took your advice and disputed. I'm currently disputing my third situation with Orchard. I find them incredibly irritating, especially as they are claiming infringements on my own meditation compositions...I recorded them here at home & added them as backing tracks to my meditations. By contacting both the artists & Orchard involved, the notices were removed very quickly. John, I have just got my first false claim from Orchid but I am practiced against both WMG and SONY for the same false claims. Solution although a pest to have to do is to launch a dispute, then appeal then if they take it down, threaten a DMCA counter claim. It is then up to them to fund a court action against you and that they will not do as long as you have clear proof of copyright of the work.

Hi PedalingPrince. I just want to let you know that the reason The Orchard is doing this is not because they want to own new material. Having KZbin's approval would not give them that right. It's because the Orchard is an internet distributor who puts music on iTunes and many other outlets. They also represent their numerous executive producers who take an agreement with them so they can protect their album from copying. The Orchard probably has a special software to identify music on KZbin that matches their catalog. This is a good starting point as there is a lot of copyright on KZbin and the internet in general. What they need to do though is further check with album executive producers (those to who the albums belong to) as to where does that music come from. Executive Producers may not even know sometimes because they hired a music producer to record their album in the first place and that producer may well have taken some material from the same place you did. Therefore, it is easy to find that your music matches theirs, but more difficult for them to get in contact with the guy who recorded the material on the album they represent. The executive producer may not even know. Nonetheless, they should still make a better effort before claiming the music. Hope that explains a bit what's happening. So Orchard is not really a scam. Don't worry, if you can just prove where your stuff comes from, you'll be fine.

I'll remind everyone. You don't have to wait for a DMCA removal to file a DMCA counter claim. A DMCA counter claim WILL work on any video that has had a Content ID match in the recent past, even after you already filed a Content ID counter claim. Use the DMCA counter claim page which will escalate the claim directly to the lawsuit level, forcing them to either sue you or cease and desist claims on your video. If you're not using their work, guess which option they'll choose.

Watched your other video as well and got a claim by them too from music thats provided by Rockstar games in GTA 5. The movie editor in GTA 5 allows you to make video's you recorded in game and add music and sound effects to it so i assume that Rockstar has all the rights to the songs they provide for use in the editor and that no one can make a claim to it or am i wrong? I also got another claim by "[Merlin] SC Distribution" , also on a video made in the Rockstar Editor from GTA 5 with music provided by Rockstar ... Anyway, Orchard music really needs to be taken to court and be punished for all the falls claims they made and where they are making money of while they have no right to it.

Well I used to use them many years ago, then switched to Tunecore then IODA. I loved IODA & recently The Orchard bought IODA & is about to buy Tunecore making them the largest aggregate in the world. And besides a very small handful of others that don't reach the big stores, not using Orchard is no longer an option if I want music on Beatport, Traxxsource & the other big stores for my label's genre. In fact Beatport only accepts releases form Orchard & Tunecore period. That's 80% of my sales.

My videos are not monetised but they have just done this to me too. I have a haul video with different lots of music playing in the background. The piece of music Orchard is laying claim to, is not even that noticeable and there is other music in the rest of the video that is heard more clearly, yet there is now an information on the music used and a google itunes link to the piece of music Orchard is claiming they own. This could mislead anyone watching my video as they could think this was referring to other musci in the video which is heard much more clearly but which has no copyright claim on it by anyone . I can't understand why youtube does not have any provisions for anyone to contact them properly to report Orchard music. Your video is now four years old, yet this nonsense is still going on from Orchard music, whoever they are.

Copyright fraud, i.e. making a false claim of copyright where none exists, is punishable by fines ranging from $750 to $30,000. There are numerous web sites that explain this, but You Tube won't let me post the URLs. If you want to go after Orchard Music, I suggest a class action suit.

Orchard Music allegations are baseless, and Google should look into this.

Obviously, your rant has done nothing. The orchard group is alive and strong. If you write and play your own music, it will be stolen by this group. And there's nothing you can do about it. Unless KZbin (Google) is threatened with legal action. Then, and only then, will something happen.

i just jot the same thing for my Xmas video it said Hi Gaming with 9547, Due to a copyright claim, you are no longer monetising the following KZbin video. It is still playable on KZbin, but the copyright owner could choose to show ads on it.
