आदेश 09 नियम 13 सपठित धारा 151 cpc के प्रार्थना अभी तक निर्णय /आदेश नहीं आया है। समय लगेगा। इसी बीच अस्थायी निषेधाज्ञा का प्रार्थना पत्र आदेश 39 नियम 1 व 02 सपठित धारा 151 cpc लगाया है। क्या यह द्वितीय अस्थायी निषेधाज्ञा का प्रार्थना पत्र maintainable है। यदि हां तो कोई रूलिंग की सख्त आवश्यकता है। कृपया....

Apke question ke anusar abhi tak ex-parte decree ko setaside nahin kiya gaya hai yani pending hai aur at the same time prativadi temporary injunction seek kr raha hai... Ab yahan pehle Order 9 rule 13 ko decide kiya jayega Tb uske baad Order 39 rule 1 & 2 maintainable hoga... Aur kya prativadi suit mein appeared ho gaya thaa aur kya W.S file kiya thaa phir uske baad suit mein appear nahin ho paya thaa too isliye suit exparte proceed ho gaya aur decide bhi kr diya gaya ?

What is the limitation of set aside ex parte order under order 9 rule 7 of CPC?

The prescribed period of limitation for an application under Order IX, Rule 13, C. P. C. for selling aside an ex parte decree is 30 days, but not for an application to set aside an ex parte order, with the result that an application for setting aside an ex parte order shall be governed by the residuary clause contained in Article 181 of the Limitation Act and the period of limitation for such an application shall be three years.
