Our local recreational bike paths simply post a speed limit, notify people before passing them, and which users get top priority, in this order: Horses (mostly to not startle or frighten them) Pedestrians Cyclists

If the new OR laws are like the new CA laws, having a bike in which you can change the classes doesn't matter. You could change it to class 2 from class 3, but since the ebike is still capable of class 3 operation it's technically illegal.

Hey Mark, I am a EBiker from the East Coast. Once California made its ruling we know that the other states were chomping at the bits to make their mark on ebike regulation. But of course the Oregon assembly would not dare to mention these 25lb road bikes that we see taking over the streets are going well over 28 mph, in fact they can go over 35 mph. I say that to say this, Oregon assembly put a caveat in their legislation, and that is human power only, so that lets the bikers off the hook. So, you know that there are people on the assembly that ride those kinds of bikes and know how to word it to exclude them. I am quite sure that all the states are going to feel this pain. Last thing, with all this talk about ebike regulations, we still see post from other KZbinrs who continue to ruin it for everyone else. Wheelies in the middle of the street, crashing in the middle of the street from doing stunts and the list goes on. Only if these people could understand the effect of their behavior on the masses, we probably would not be here talking about this now. Have a blessed day.

if a driver hits a pedestrian or cyclist in Massachusetts they will be fine as long as they stay at the scene. the only way I could see an issue is if they are on camera and driving blatantly improper. the lady who hit me (going 40mph) wasn't even cited.

Glad I did my homework looking at different companies selling these e-bikes before making a decision to buy one and I found the right one. Spark Cycle Works is the company I went with back in 2021 and I bought me the Bandit. From the start I was told I'm buying an e-moped and it comes with all the proper paperwork I need to ride legally on the streets. Love my first Bandit so much that I purchased my second Bandit in 2023 and it's such a joy riding these things. I live in New York City, I ride with the cars unregistered all the time and the police don't bother me. When the laws finally change here about riding our personal electric bikes I'll have everything I need to ride legally in traffic and not have to worry about my bikes being taken from me by the police.

This proposed law will likely not be enforced on a day to day basis by the police. Local police here have said so much in neighborhood safety meetings. What it will provide is a legal standing for law suits brought by people injured by negligent class 3 e-moped operators. Bottom line, a bike that can travel at speeds of 28mph; gas or electric powered; with or without pedals, with or without throttle control will be classified as mopeds and subject to motor vehicle regulations. That means turn signals, head and brake lights and registration and licensing of both the vehicle and operator.

I think the problem stems from the fact that the ebike scope is misunderstood. Meaning there's just a realm of essentially e-motorcycles disguised as bikes. Or in other words people that should be riding exclusively in the street but using bike paths instead. So, which begs the simple question of cars that entire a bike path to cut a line to a turn lane, that would also then be illegal and they should be fined because they definitely aren't pedal assist :) The other thing that is troubling is the need to try and over legislate this. We don't ban cars from the roads because they have a lot of horsepower in that they can go over the speed limit, why are we trying to do this to bicycles? Maybe the simple answer is set speed limits on bike paths?

A safety issue that needs repair is the lack of keeping the narrow bike lanes clear of debris. It is pretty hard to try dodging glass, rubber, and whatever else you come upon. It's worse riding in the dark even with great lighting.

Nobody talks about the e bike going up a grade... Especially In cold weather batteries lose their power... All ebikes have different wattage and they all have speed limiters..... And they all come in various poundage... And load capacity.

Another thing to be mindful of, cop next to you can see what the name of your bike is. While the cop is driving away and seems to have just moved on with his job, he can google your bike name and end up turning back around to have you explain more about the bike. My bike branding is not easily seen from 5 feet away.

I can just go into settings and turn my bike down so it can not go over 20mph. If I just do that, I think it's fine. But my take off and wattage up to 20 mph will still be 1,500 watts.

I have a 1,500w e-bike in CA which was illegal before all these new laws came out but it looks like a typical bicycle, I always pedal and mostly ride under 20mph. I don't draw attention to myself and I look like anyone else riding a regular bicycle around, so I'm not very worried about these new laws here. The key is not to ride like a moron.

bike paths should have speed limits much lower than 28mph. The restriction of being used in a bike lane is rather weird, but yeah it could be an effort to limit speed w/o having to pay Police to enforce if the future bikes wont be able to travel past the 20mph. There are plenty of situations where I travel 20+mph in a bike lane on my analog bikes.

I’m an early adopter and have 4 e-bikes. If you are getting a road bike, go with a class-3. Class-1 is agonizingly slow on roads. Class-2 is the only one with a throttle that doesn’t require you to pedal it. Class-2 are the ones causing most of the controversy because it can be viewed as an electric “motorcycle”. I love all my e-bikes and have commuted on my for 5+ years here in Salem, OR.

I agree to a point these fast Ebikes shouldn't be on trails and bike paths and if your bike is capable of road speed then you should be in the road anyways that's why I'm building mine to do 60mph so I can stay in traffic in my area roads are 45 and 50mph roads and there really aren't any bike lanes that are safe. So if your bike is fast enough to stay up with traffic then why ride in a bike lane.

@oregonebikermark8953 yes I'm only building to do that so I'm not full throttle everywhere I go doing 45mph and it will be more efficient not pushing everything to its boiling point. I never plan on doing 60 but this way I have the power of needed to get out of the way. I only plan on doing 45 to 50max like I said in my area all the roads are 40 to 50mph and bike lanes are only like 2ft wide and over grown. From what I have seen in NJ the insurance companies say they have no way to ins a Ebike and it may take yrs to fig it out not months so I'm just going with the flow. The cops in my area say they have better things to do than pull over bikes lol

20 mph is slow on an ebike, while i wouldn't ride an ebike capable of 45 to 50 mph, i have ridden 35 mph for short periods and normally pedal along at 25 mph, and even 30~32 if I'm in a hurry. but at 20 mph i'd never get out of PAS 3

Most of my commuting is 25mph or less. I have ridden 35mph on sketchy roads where there is no bike lane and the speed limit is 35mph. I've had no issues and just blend in with cars.

20mph isn't slow. it's only because you've experienced faster that it feels that way. If you remember riding your bike as a teen or maybe adult most are going 15 to 18mph in burst and thats at top speed and it was not only fast but not easy to maintain but now we've gotten away from that and people keep wanting more and more. Well, if you put the bike back into class 2 mode, then you can use the bike lanes, and you can use pure throttle - up to 20mph. As noted, the class3 regs were ALWAYS only pure throttle up to 20mph, and after that, you have to pedal to get 28mph - even if you are ghost pedaling. Thus, the only real issue is if the bike is placed in class 2 mode, can it legal be ridden on those bike lanes? My best guess is "yes", but with the door being opened? Then next regulations will no doubt NOT allow class 2 bikes if they can be un-locked. In other words, they will probably pass this bill, and then find out that everyone is claiming their bikes are in class 2 mode. When that occurs, then we have a real mess, since regulators will not know what to do, and when they don't know what to do, that's when I start to worry... The other issue? Some state "twist" throttle, but now they are dropping the word "twist", and hence that suggests no throttle. As noted, throttles were always limited to 20mph by most regulations.....

Grandfathered Rights: Since bikes were around before cars.. and bikes have the right to use the roads.. does this mean ebikes can now take an entire lane to get from point A to point B..? and if they are limited to 20mph, that means that it will be illegal for a car to honk if you are slowing them down..? that is going to upset car drivers to be limited to 20mph..Any 2 or 3 wheeled pedaled bike/trike has a right to use the roads.. For those of us who are disabled and require assistance of throttle to get rolling so we can get our balance to ride, this would be discrimination on basis of disability and failure to provide a reasonable accommodation.. Does this mean that disabled riders in power chairs will be banned from sidewalks...? if so, the penalty for hitting a person with electric assist mobility devices that have been prescribed by a medical doctor needs to be a mandatory year in federal prison..if the person is injured then 5 years, and if that collision causes d e a t h, minimum of 20 years... Bikes can take an entire lane when there is an obstetrical in the bike path (or no bike path). And if we are banned from bike paths and bike lanes, we can take the entire lane.. Sorry road rage car drivers. 49cc scooters don't require a DL or licensing. and because Ebikes are less than 50cc there can't be any restrictions on ebikes riders..

The other thing people are asking, is why are they bringing in all these laws if they are not going to enforce them? I asked this question to the local authorities, they want all these laws so they have more reasons to pull you over, throw far more charges on you, plus have the powers to confiscate illegal bikes, so if they see you doing something wrong, they'll have lots of excuses and you'll be in a world of pain from huge fines and losing your bike!

Washington already has similar "unenforced" laws for class 3 on sidewalks and bike paths. I looked this up prior to getting my creo, (250 watt motor, 320 watt hour battery, and a whopping 32 neuton meters of torque, and class 3, no throttle). The untrained eye wound not know it's electric. To reach and maintain 28mph you need 120 rpm on the pedals, more than I want to do at 55 years, besides maybe a short burst. On my acoustic road bike, at that cadence, I can go 35mph, (short burst) . Which one is more dangerous on the paths? I get a boost crossing intersections and some help climbing. Still a bicycle. With higher power motors and throttle, I still think it's a great alternative for local transportation and just having fun. Even just throttle is more exercise than driving. Be respectful on trails and keep the new laws unenforceable.

My bigger issue with these laws is they are wasting their time writing them. They aren’t going to enforce it, why bother? They’ve got illegal devices all over the place today they could ticket if they felt like it. They don’t ticket them, so why this push to expand the group of ticketable riders? They still aren’t going to be ticketing anybody.

@ Anything. There are tons of devices that don’t comply with existing law, I own several. If I don’t run anybody over or come close, nobody cares. Cops have given me the thumbs up many times when they’ve seen me going 35-40 down a 35 mph road. It’s not legal, but nobody cares. I don’t see why they are proposing this law when people are riding stuff that’s twice as fast and they don’t care about enforcing it. If they are not going to ticket the 40 mph rider, why expand the universe to 28 mph riders.

I would love to see the stats behind this law. I bet there are very few that support such measures other than hearsay from a few disgruntled people. The law will cost many people problems which include commuting on e-bikes, traveling around town, it will likely cause significant problems with bike shops that sell e-bikes (sales). I wonder who they have surveyed before coming up with this measure.

Three things will probably happen: Most retailers will switch to online sales from out of these states and include a "warning" in their apps telling the customer that if they unlock the bikes speed they may be in violation of local laws so that the companies can't face any backlash for people getting in trouble after they unlock their bikes. Secondly a handful of companies will sell permanently locked down versions of their bikes to try to continue sales under the new laws, and thirdly Mid drive bikes with extremely strong torque ratios will be released that cap the bike at 20 mph to appeal to people who still want power but want to be within the rules. It sucks but 20 mph on bike trails isn't that bad. People will always be able to buy a class 3 ebike but it might not be legal where they live haha.

I always ride in the bike lane if there a lot of traffic but if the no traffic I ride in the rode. I do have a class 3 ebile and side walks I understand not riding on but bike lanes come on now. A evoke is a bike come on

Your type E-bike may get singled out or given a second glance more frequently.. As apposed to say a Wired bike. But most people can still enjoy a 20mph ride with the right mindset. You can flip on the juice when its cool to do so. Just keep a low profile. Older adults especially should not grab attention at all with an ebike that looks more like a bike. The moped style may be scrutinized more heavily perhaps. Just lift your tire off the ground and show the speedometer only goes to 20mph.

They are expanding the law. I thought class 3 (I have one) cannot ride in bike lanes. Only in case of traffic or emergency needs. The bike path thing is new. The class 3 law is: 750 watt motor limit and 28 mph top speed. So it is about enforcement. Class 3 we are supposed to ride with traffic and I find drivers pass me because I am going the speed limit and have a "bike".

What gets me is the throttle issue. It seems like people don't understand the throttle and how it works, if your bike can accelerate from 0 to 28 by means of the pedals and it can also accelerate 0 to 28 by means of a throttle is there a difference whether you push a button or push a pedal?

All they have to do is post a bicycle speed limit for the areas they want to slow bikes and e-bikes down in. This is a very short sighted law. If you pedal you should be able to ride regardless of type of bike in bike lanes and trails. In my younger days I could pedal a regular bike faster than 20mph. As a pedestrian I've come closer to being run down by regular bike riders than by e-bike riders.

Both laws are terrible. Just trying to punish ebike makers and force them to keep changing their products. Funded by the car industry I suspect. Cars can go as fast as they want as long as no one catches them. Bike lane speed limits would make far more sense.

E-bikes aren’t allowed “under electric power” on sidewalks here in Ohio. And it’s the one ebike regulation I agree with. The only one. I just believe e-bikes don’t belong on sidewalks. And it’s not fun to ride on them anyway.

First of all, I never carry my wallet with me when I ride, just my phone. So if a cop wants to ticket me and I refuse to give them my name, are they going to arrest bike riders??? What about ppl without driver's licenses, how does that work? The bike's not registered so how will they know if it even belongs to me. Maybe I borrowed it from a friend. This is stupid. If a cop gives me a ticket, it's going immediately in the first trash can I can find. I refuse to comply to an unjust law. I'm sure the cops are overjoyed with the idea of having to deal with cyclist too. I'll continue to ride my high-powered bikes where I want. Last time I checked, my taxes help pay for those sidewalks, bike paths, bike lanes, and every road/street in my city.. Yet the golf cart riding in my city has become an epidemic, and I see no one passing laws banning them. Whatever, I'll just keep fake pedalling while going fast if that makes them feel better.

Why do you need to go more than 20 on a bike? When I pedal my bike I average 10-13 and peak around 15. I only go over 15 with wind at my back or if I'm on my 73 Schwinn Varsity 10 speed. I'm only interested in pedal assist when the wind is in my face and 20 is fine with me. Over 20 then it is a Moped if it has pedals and a motorcycle if it doesn't. Simple as that. Over 20 you have more chance of more serious injury to yourself or others and probably should be registered and have insurance. I'm 62 have have always owned at least one bike at all times since I was 5 or 6 so I'm all for riding bikes. Have owned a motorcycle at all times since I was 16 so I'm all for that when I want to go faster than 20.

I'm not allowed to ride my motorized gasoline Honda XR 250 dirt bike on sidewalks or bike paths , so why in the heck would class 3 motorized e-bikes be allowed to ride on sidewalks and bike paths . These class 3 e-bikes are essentially motorized vehicles just like traditional motorcycles that have no business riding on bike paths and sidewalks endangering pedestrians and traditional bicycles, it's all about maintaining safety for pedestrians and traditional bicycles on these pathways and sidewalks, common sense my friends

@@richardmcevoy3796 class 3 has not been allowed in the green bike lanes in all cities across the US nor on the bike/multi paths for over a decade. That is a straw man argument. In bigger cities where the “peloton” wannabes’ are, they ride 3/4 abreast and well over 25mph. They are all analog powered (no e-assist) yet you don’t cry about them on a constant basis. What is needed is folks learn to be respectful and responsible where others are concerned on any pathway. This is something that drivers need to learn as well. Please understand, just because you get rid of the e-bike, you don’t get rid of the idiot who breaks the rule and endanger others. Now they behind the wheel of a car. It’s not the the machine/tool, the user and their intent.

I just looked and there was just in 2024 large number of cyclist killed by trafic in Oregon. None seem related to e-bike speed. If nothing I think all cyclist got hit by cars because they where slow. Just wonder based on what is made decision and why you cyclist are silent.

I think the general rules around here are that type III ebikes are only permitted in bike lanes, and are not allowed on separated bike paths. The bike lane I used for commuting was alongside a 50 mph two lane highway so 28 wasn't a problem there and no reason to worry about that speed on bike lanes that are alongside streets. Riding ebikes on sidewalks is generally not allowed anyway so that's not much of a change. But really it would be better to restrict speeds on the different pathways rather than the class of bike. You can always ride slowly when the occasion calls for it. Really it's all about safety and riding at safe speeds for conditions. Trying to codify every situation into law just doesn't work.

We need to start suing municipalities for going backwards on clean transportation along with all the companies already established need to be jumping on boards as well. There are many of us that use as means of transportation along with ways to actually create an income. These people have no forward thinking except taking everything they see people starting to enjoy away from those people. It’s bs and we are not living in a jail setting to be unable to enjoy these simple things. The people need to start standing up to this over reach and take back or freedom to live and enjoy our lives.
