I think one of the the most telling piece of evidence is the jeans, inside out left in the middle of the floor. Everyone who knew Reeva said she was a very tidy person. I do believe there was a row. Reeva decided to go home, packed her overnight bag (including the pyjamas she was wearing earlier. She sat on the end of the bed to put her jeans on. Oscar grabbed the legs of the jeans and pulled them from her, dragging her and the quilt onto the floor. She grabbed his Basketball shorts from where they were laying over his prosthetics, and her phone and ran into the bathroom, to put them on so she could leave. He lost his temper and poor Reeva lost her life. Also why no mention in the trial of Frank the housekeeper/bodyguard, he was in the house, albeit in a room downstairs by the kitchen. Where were Oscars, dogs. why no questions about why his dogs didnt bark ? Oscar could have just shown his remorse by just saying Yes I take full responsibility, I accept whatever sentence the court gives me. To lie, cry and blame everyone but himself is just shameful.

Nel is craftily trying to bring out the OP rage that Reeva was victimized by, the last night of her life. He has cornered this liar and has (today) successfully blown out his self defense plea. Though it seems repetitive and tedious, Nel has successfully torn apart OP's version of what happened that horrible night. OP was in a homicidal rage. Witnesses have testified to hearing OP and Reeva fighting. The fact that Oscar Pistorius retrieved that gun during that fight is proof of premeditation. Gerri Nel is a genius.

@jcavanagh596210 жыл бұрын
Really? Maybe we aren't watching the same trial. I see that Nel is skilled. He has blown OP's version out. Just close your eyes and imagine OP's version. It absolutely makes no sense. Then close your eyes and imagine Gerri Nel's version, it makes sense. It is confirmed by the evidence.

J Cavanagh What people do when they are frightened and panicked rarely make sense. You say Nel's version is confirmed by the evidence. What evidence?
@bobbytchernaev270810 жыл бұрын
ByTruthImFree I agree with you that that there are no direct physical evidence to support Nel's version but to the same extend there are no direct physical evidence to support OP's version. Therefore, we are only left with the evidence both sides present and as J Cavanagh said, OP's version makes no sense to me. If I were to accept OP's version, I would have to believe that it would have been reasonable for him to have shot Reva if she had come home early and he had not expected her. I just don't believe that. I do see plenty of evidence that have put large holes in the story OP has presented.

Around 3:40 where he says he shouted, "Reeva call the police" to let the intruders know the police had been called or whatever - this makes no sense. The supposed people in his house would not know who is in it. Why on earth, if he wanted to protect Reeva, would he make it so obvious to the supposed people in his house that she was there? If something happened to him, as he walked down that passage, and he was killed... they would then know that there was someone else in the room and attack them too. If they didn't know she was there, they likely wouldn't search for her... she could hide and be safe. No sense whatsoever. He says he thought so carefully about he safety that he disregarded his own. It's a ridiculous thing to assert.

Its in the prosecution's best interest to adjourn. If you notice, Nel often asks him if he's ok. That's because if he goes down, it will be on record that Pistorius accepted that he was ok to continue giving evidence. Otherwise, he might have grounds to appeal claiming that he was in no fit state to answer, under too much emotional stress, answering under duress etc.
@pdenigris110 жыл бұрын
05:30 NAILED IT. He puts Reeva's "life in danger" as the motive! Game over.
@islaarundel374110 жыл бұрын
I think Nel may have missed something - I haven't watched it all yet, but we've passed by the point. Pistorius says he yelled "Get out" when he was inside the bathroom, facing the toilet door, before he fired. He testified he fired because he heard a noise he interpreted as the toilet door opening. If he'd shouted "Get out" then the door opening would hardly have been a surprise to him, a shock to elicit sudden gunfire, would it?
@islaarundel374110 жыл бұрын
You know another possibility? He was eager to play with his gun, macho man in combat mode, he's actually rather deflated that there's no one in the bathroom and he's so thoughtless and reckless he doesn't even think about where Reeva is. He discharges his firearm (thinking no one's there) just because he wants to, possibly because it'll give him an entertaining story to tell his mates the day after etc. Of course, my version falls down on one big fact - him being on his stumps. You don't play macho man on stumps, do you? I don't know, maybe he does, but his claim of vulnerability is uncomfortably plausible, and I don't see how they could have been having a fight if he *was* on his stumps, which I believe his defense says it can prove (given trajectory of bullets). If you were having a humdinger of a row, you wouldn't take them off and put yourself at a physical/height disadvantage during an argument, would you? I wonder if it can actually be proved he was on his stumps. If it can, clearly there's no case for pre-med. But there's no getting away from the criminal recklessness of his behaviour, imho. Although, to be fair, you *do* have to factor in the stumps equation. Balance, height, scrambling about using stumps and palms... has to be considered.
@islaarundel374110 жыл бұрын
Holly Brook I think if you plan to kill someone, if you're acting calculatingly, then you're in control of the situation, no? On his stumps, Pistorius isn't in control of anything, even his own balance. If he planned to kill her and carefully deal with the aftermath, I can't see why he wouldn't have put his prostheses on first. Being on his stumps indicates to me that he was in an unexpected situation. Like I said, I think he's guilty of murder - he intended to kill whomever was behind the door, I just don't believe he planned to kill Reeva. I think he simply didn't think about her at all. He just thought about himself.
@islaarundel374110 жыл бұрын
Of course, all I'm saying is that if he intended to kill her, it would make more sense to take the 20 seconds to put on his legs so that his balance/aim was completely unimpeded. More to the point, I still don't understand why he'd have taken them off if, as prosecution contends, they'd been arguing since she'd been eating - 2 hrs before her death. I just think the prosecution should've stuck with what they could definitively prove. They can prove murder. They can prove he fired at the door, knowing *someone* was behind it, they can prove he had no real necessity to fire and could have taken a number of different options. By going for pre-med, they're leaning heavily on circumstantial evidence, and the danger is that the focus will be shifted away from the elements of their case that are concrete and watertight. I can't see him being convicted of pre-med - I just hope the case for culpable homicide hasn't suffered from lack of focus.
@kalikrome154310 жыл бұрын
~totally agree, we can flush fight or flight down the toilet along with GAD.
@pps1fan10 жыл бұрын
Holly Brook 100% agree with you and think Gerrie Nel has done a great job of proving this point on more then one occasion, OP had time to think, time to reflect and decide on what he was going to do...after that video was leaked last week he had reasonable balance on his stumps, plus surely the buck of the gun when he fired would of unbalanced him if he were really unsteady on those stumps, the bullet impact holes on the door look pretty neat and close together which tells me he was steady enough to aim, fire and hit a target without losing balance. If he had lost balance then there would of been bullets fired in all sorts of directions. This is just way I see things...not saying it's necessarily the truth ;-)

Here's a beautiful thing Nel missed, or just didn't want to pursue, but the point of the questioning is how P would expect the intruders to leave his house ..."Get Out Get out!" P says either through the window or toilet door. Nel asks, or comments that if they used the toilet window they'd fall two stories, meaning to me that they knew there wasn't a ladder there, so in order for the intruders to escape without P needing to shoot them would be come out the toilet door, climb through the window and descend the latter! All the time P standing there watching them as if a truce has been called in the break-in! This would negate his defense even further and reinforce the allegation that he was there to shoot because he gave them no escape possible. Of course, he knew he was shooting at Reeva. You saw the way he fired guns in the film. Very Good.

So according to OP; in his guarded gated secure development an intruder broke into his house that has alarms and dogs roaming outside in order to climb up to the 2nd floor and lock himself in the bathroom. Then he states Reeva was in the bedroom calling the police as he told her to, according to him, then how did Reeva get into the bathroom without him seeing her leave the bedroom and go into the bathroom? He murdered her in cold blood, it was Valentine's Day and he found emails between her and an ex and he erupted into a violent homicidal rage, as he has done many times in the past. He denies every single story from people who know him well, everyone is wrong and he is the only one who is right. He has an ego the size of Texas. He refuses any and all responsibility for his actions. And why would he have to hit the door with the cricket bat? He copuld just shoot the door open. He attacked Reeva with it which is why it had blood all over it, she ran and hid in the bathroom in terror and he finished her off.

It doesn't make sense that Reeva didn't warn him that it's HER in the toilet, I mean she knew all about the fucking gun, that he EXTREMELY trigger-happy and in that moment she knew he was coming towards her - towards the blind end - while screaming at the door aka. intruders. Tim Schweizer there is no proof she knew he was trigger happy....she would have known there is a gun under the bed but if she is in the toilet room going pee in the middle of the night, she isn’t going to think he is going to shoot her, especially since in her mind she just talked to him . She would have assumed he saw her get up ....especially if she took her phone to use it as a light....

@robertus911 With OP being the sole survivor of that evening, he can basically tell anything he wants of his "recollection" of the events of that evening, and we know for a fact that there are many gaps in his testimony; 1. Reeva ate something between 19:00 and 03:00, that's proven beyond doubt. 2. How could he not have noticed her going to the bathroom while being within 2-3 meters of her, alledgedly moving fans around. 3. Why did Reeva not react a single time to OP's shouts, not even as she was standing in the toilet with OP about 1,5 meters away? 4. Why didn't he make sure Reeva was secure prior sending bullets in the door ? 5. Why is everything out of place in that bedroom? why does not a single physical evidence match OP's "recollection" of the events ?. 6. Where were the fans plugged? in particular the small one as we know that there was no spare room in that white extension?. 7. What did OP do for a full 5 minutes before breaking the door open? Does it need 5 minutes to realize Reeva wasn't in the bedroom? I'll tell you what; she was fed up with his possessive & overly jealous character (see Whatsapp messages). Nell proved that OP is basically obsessed with himself and what Reeva could've, should've done for him. And, yes ... Religion sucks dicks. It killed more people than anything else in humanity's history.

Does anyone have any idea why Judge Masipa asked to see Mr.Nell outside after the lunch adjournment? ? Do you think she was warning him about how Mr.Nell grills the baby, Oscar, every time he gets "emotional"?? I have grave concerns that the judge is being more biased to Oscar and his over the top emotional acting. I think it's clear Oscar killed Reeva knowing and wanting so after an argument, rage, jealousy. I'm worried she will let him get away with murder due to displaced remorse.

He didn't pull the trigger in the restaurant. He didn't pull the trigger when shooting out of the sun roof. He didn't pull the trigger when shooting Reeva (the gun went off - yeah, right). There is NO WAY that his legal team would have left out the door slamming part from both the bail application and plea explanation when Pistorius is now making such a big deal about it. And his legal team is always to blame for omitting things ("I mentioned it to my legal team at the time, I don't know why it is not in there") - he can simply not take responsibility for ANYTHING. I'm sorry but with the best will in the world and trying to give him the benefit of the doubt, there is no way he is not totally lying his head off. He is as guilty as all get out.

This is getting monotonous, every time he whimpers they adjourn. Buck up and answer the questions! Such a waste of court time. Now the prosecution is asking for a break to point out his emotionality as if to say he's stalling.

I agree 100% David. Seems like "my lady" has a soft side for OP. I'm Canadian but I'm pretty sure if this case was happening here, guaranteed - the court wouldn't adjourn every time the witness started crying like a baby.
@paulawhitlock203510 жыл бұрын
It is monotonous but it doesn't serve the court well to treat the witness with a heavy hand when he or she is in pieces. OP may be acting or not be acting but the judge should not be making that judgement or seen to be making that judgement at this stage.
@Garmez12010 жыл бұрын

Judge is being very far from nice to him. What's your definition of nice? If she decides on a murder verdict and gives a harsh sentence, she can show that she has been scrupulously fair in court proceedings and given OP every chance to defend himself. Plenty breaks so he feels up to par in the witness box and doesn't mistakenly incriminate himself. She also agreed to the Prosecution's request for forensic evaluation during trial, which means that OP's defense team cannot claim after the case is over that his psychological state was not taken into account. What she and Nel are really doing is closing off doors for an appeal.

He does this because OP keeps changing his version. When you tell the truth it flows easily. When you lie you struggle and can't keep your story straight. The way I see it. The prosecutor is very manipulative in the court by attacking everything the defendant said that doesn't fit his one-scenario assumption, even including the defendant's emotion. Repeatedly saying things don't make sense when they could. First, Not all person (if any) scream like how actors play in dramatic movies when they see their loved ones' life is in danger. Notice Pistrious did say Reeva was struggling on breathing, if that were true, since no one can say Reeva died immediately with the last shot, then what is the point of scream loudly instead of trying to save her(which Pistorius claimed he did)? Second, while Pistrious screamed to Reeva to call the police out and in the bathroom, Reeva could not see him, or where the intruder is through the door. If I were her, I'm not sure I will scream back to expose my location when I don't know where the intruder is and the situation in the bathroom. I'd try to call the police, hide behind the door, face the door, lock it in case the intruder come in before my boyfriend or the police take care of the situation; or, I could try to open the door if I'm really curious about the situation, or want to help my boyfriend. Third, I, as a girl, do lock bathroom doors when I use toilets in the beginning of a relationship before I get too comfortable with the idea my BF could accidentally see me excreting; or I could lock the door simply because I'm afraid of the dark at night. Forth, the prosecutor assume Reeva was going to leave Pistorius, now with the evidence of Reeva's card and gifts to tell Pistorius she loves him the same night, it would be a 180 degree mood and decision change for her to then decided to leave him/break up with him for one single fight. Which I doubt she is that moody and emotional. The prosecutor should give solid evidence as to why and what could make Reeva wants to leave him in one night and really done so, before he keep telling the defendant and the court that's what happened. What I'm saying, is that there could be hundreds of reasons why things happened. And since no one knows what really happened the night except Pistorius, a prosecutor's job should be to process the case based on evidence, other than his own assumptions and knowledge. The worst way is to lead and persuade the court to believe his interpretation regardless of the truth, which is to frame someone whether the prosecutor is consciously or unconsciously doing it. While some people accuse Pistrious faked his tears and vomit, which is silly since not even the best actor/actress can fake an involuntary reaction and even the reporters smell the stench, why don't they accuse the prosecutor making a personal show when he speak sarcastically and cocky and have his one shoe on the bench? We can always find reasons to blame someone if we can't let go our prejudice and prejudgments.

@jcavanagh596210 жыл бұрын
yeah...it "just went off" four times. The pull on the trigger of that weapon has a lbs. pull. It doesn't "just go off".

J Cavanagh as a matter of a fact...it has a 5-7 lb. pull in order to fire
@ositaokpala193310 жыл бұрын
your interrogatory in case you don't know strengthens OP's case...because the prosecution has to prove that 4 bullets is necessary to kill anybody and everybody? or to answer the question, how many bullets does one have to shoot to kill a person?
@jcavanagh596210 жыл бұрын
I don't know how you conclude that. The groupings of shots indicates he was aiming. It appears he was following her with the weapon and firing. The only shot that missed is while she was blown back by the first shot. Also, why was he going towards the very thing that terrified him? Wouldn't human nature be to run away from the presumed threat?

For the record, I didn't think he meant to kill her - I still don't- but Nel is talented enough to make me wonder. For me, the most compelling piece of evidence that they weren't engaged in an argument is the fact that he was on his stumps. If they'd never gone to bed and were having a flaming row, I can't see where/when/why he'd remove his prostheses. If his defense can prove (by trajectory of bullets) that he fired while on his stumps, then I don't think Nel has enough to indicate pre-meditation. I think he's lying like hell on a multitude of points - but these lies stem from the fact that he's desperate to avoid even the culpable homicide verdict. I think the reality is that he never checked where Reeva was, he only thought of himself, and he was criminally reckless. In a way it doesn't matter whether he meant to kill her, or he killed her through careless, reckless bravado. She's no less dead. But, nope, I don't think he meant to kill her. Nel could make a case out of thin air, though, and heaven knows he has more than that to work with here. Pistorius's legal team have let him down badly. He should never have taken the stand unless he was willing to come clean on culpable homicide, to get up there and say "I panicked, I should have made sure she was safe, but I was overcome with fear and I just didn't think about her." By trying to avoid any responsibility whatsoever, he's in serious danger of being found guilty of something much worse - of something he didn't actually mean to do - and you know what? Given his behaviour, it'll be rough, but poetic justice if Nel nails him for pre-meditation because he lied to avoid the lesser charge.

Please go back over the last 20days of the trial av a look at the comments n ul notice it seems to be women who defend ir believe. I stumbled on that observation. He shot at a threat n left that threat without knowing the outcome of the shots (he was senseless by loud gun n closed door ) he says to check on reva but he said he initially wanted to get between reva n intruder but after shooting at the intruder comes back to reva???? Hmmmmmm ok waiting nel to drop this set of questions on him. After that u can close the case cos no human that has ever lived would fire a gun, shoot an arrow or throw a stone at a threat n then back off unless u thought threat was now reduced or gone. Careful ur judgement seems like could make u vulnerable in life.
@islaarundel374110 жыл бұрын
Garry Williams But Garry, if you as a man were having an argument with a woman... would you want to put yourself in a position of physical vulnerability/inferiority? We're assuming it was a violent argument, screaming and shouting, maybe finger pointing and a lot of physical posturing - would you personally remove your prosthetic legs in that scenario? If you were worried she was going to flee and you wanted to reason with her/continue the argument, or if you planned to physically intimidate her, I don't see why you'd take them off. Similarly, if the row developed (or continued) when he woke up, he'd take the 30 seconds to put them on so he wasn't conducting an argument with a woman more than a foot taller than him, surely. Don't get me wrong, I think he's lying about many things mainly because he won't take the slightest responsibility for anything - certainly not the fact that he was reckless and thoughtless and criminally selfish. But the issue of the stumps is a big one, I think, it's the one piece of evidence that seems to unequivocally support his story of reacting to an unexpected noise, and it's the one piece of evidence which doesn't fit with Nel's version. Either way, she's dead, so to me it's not the biggest issue. Culpable homicide is enough. It's not pre-meditated murder, but it's still murder to me.

Isla Arundel I hear what you are saying......but at the same time I think that they were arguing in bed (hence the prostheses being off). She went into the bathroom with her phone (perhaps she told him that she was going to call/text a future or past love interest, or someone he percieved as being a threat) and he was at his boiling point. She may think that if I find him guilty of manslaughter, there will not be a mistrial but if I convict him of premeditated murder, then my judgement may be challenged and I will have to justify and risk a mistrial. I have one thing to say to the judge if I could. " Don't let this killer get away with murder!" You owe it to Reeva. She cannot speak up. Do what is right.
