Omg I am a Forensic Scientist and if I was as bad as this one witness, I would resign. Was old Oscar sleeping in court at one point. He has not done himself any favours in this trial. Everytime he is backed into a corner with his forever changing answers he cries.

Roux has lost it, he dragged some old badger from an asylum, told him he was a geologist, and asked him about ballistics, lighting, photos taken last night, and the splinter in his head...this was amazingly unprofessional and embarrassing, and yet, the judge said nothing.

the only person who really tampered with the evidence was Pistorius himself, by dragging the body and who knows what else he did at the time, instead of calling 911 inmediately... The police said there are 2 set of pics, as it is customary in eery crime scene: 1- the ones done immediately after, where nothing is moved 2- the ones done later just trying to get pics of important details... now this is being used by Pistorius and the defense as tampering with evidence, when in reality those pics where the 2nd set of pics.

Is this geologist a comedian? I can't believe I'm listening to this - the man's spent 15 minutes rattling through a list of dubious qualifications, he's then asked about the processes he undertook in examining the darkness in Pistorius's bedroom. "I closed the curtains, I switched off all the lights and I looked around to see what I could see." Well. That's quite magnificent, isn't it. Thank heavens such a task wasn't left to a layperson. Tertiary qualifications are the bare minimum when it comes to interpreting moonlight, obviously. ...Is this for real?!

While we're here, could someone please tell me if the point was ever addressed about Reeva and her phone in the toilet cubicle. I don't know if I missed it, but did Nel ask Pistorius why she didn't phone the police if he was screaming at her to do so? Did she make any calls that night? I'm still not clear that.

Oscar picked her phone up from the toilet......he tryed to use her phone but could not get into it, because it was locked......he then said he went to get his phone from the left side of his bed and then called his friend, which he had to look up his number first.....But i dont no when he got his legs on....because he was trying to get her out the bathroom toilet.....no she did not call the police....maybe she was going to but was shot first.....while locking her self in the bathroom

Thanks! Well if he'd been screaming consistently while inching up the passageway "Get out of my house, Reeva call the police" presumably she'd have had time to dial emergency. Was it ever covered why she had the phone with her in the first place?

Isla Arundel Presumably she didn't call / try to call anybody or there would be a record of it, unless she was in the process of doing that when Oscar fired. Of course this does beg the question why wasn't she calling the police, if he indeed was yelling that she do this. Could it be that in fact he was in 'combat mode' and didn't yell anything? In other words if it was an accident Oscar lies about yelling for her to call the police because he wants to avoid the culpable homicide charge.

@Tina Johnson the witness did not confirm that there was no light in the bathroom. He said that the light switch operated both the light in the bathroom and the light in the toilet cubicle. He said that the bathroom light was working but the bulb in the toilet cubicle was not working. This morning Oscar agreed with the prosecutor that Reeva must have used the toilet and pulled her shorts up before slamming the toilet door so why would she have need of the torch on her phone? Furthermore, he showed photos of the bathroom light working.

It would appear that the lady Judge will have no option but to declare Mr. Oscar Pistorius Not Guilty of Pre-meditated Murder or Guilty of Culpable Homicide. Oscar's version of what happened that night has been clearly vindicated in the trial thus far.

...meanwhile in the real world the only decision the judge has to make is whether enough circumstancial evidence has been produced to find OP guilty. The culpable homicide charge is a fait accompli.
@PamelaValemont
@PamelaValemont 10 жыл бұрын
bg anonimouse I believe it is out of the question that Oscar will be pronounced guilty of murder in the 1st degree: i.e premeditated murder. Culpable homicide is still a distinct possibility, given that he did not conform to safety laws regarding discharge of firearms. However the Judge might take into consideration his disability and the impetus that would have given to his acting irrationally in such circumstances. In a perfect world, one should abide by the gun laws in a situation like this. However, given the violent crime rate in SA, and his disability, we could possibly have a case here of extenuating circumstances. "Circumstantial" evidence in favour of a premeditated murder conviction has been trashed by this witness' (Dixon's) evidence
@bganonimouse2754
@bganonimouse2754 10 жыл бұрын
While I agree that evidence hasn't been provided that OP was guilty of 1st degree murder, the key question is whether the judge has been persuaded by the volume of circumstancial evidence provided by the prosecution to back its theory up. Lets see how effective the defence will be in refuting that circumstancial evidence. Certainly OP has done himself no favours at all with his distortions of the truth, forgetting key things, mixing up his evidence and refusal to take responsiblity. With hindsight it will be seen as a mistake that he didn't plead guilty to culpable homicide imo Taking into consideration OP's character and utterly irresponsible regard with which he handles firearms its hard to see him getting off on culpable homicide. The facts on this issue is quite plain and the law is clear. There is no provision for those that feel vulnarable to shoot through a door at an imagined threat and to kill any real or imagined burglar. He is guilty of this charge and no amount of shooting at the door, rather than the person inside excuses will be accepted.

***** Unfortunately, we don't have the benefit of Mr. Dixon's forensic examination under the table at the restaurant. We do have it in the courtroom as regards the bathroom and toilet door at Oscar's home. That's what we are dealing with primarily- a premeditated murder charge. I don't doubt Oscar has been gungho and gun happy, he is paying for it now. I don't believe he is guilty of murder, but he may be guilty of negligent i.e. culpable homicide. Reckless discharge of a firearm? There's a case for that.

I cant see the point of playing the tape of OPs voice screaming. Under a controlled condition could he not have pitched his voice to that of a woman? And I wonder if his emotional outbursts in court arent intended to fool the judge that his voice is naturally high pitched under stress, and to rid any doubts in her mind that his voice on the tape is staged.

Its odd that you mention that. I have been watching the trial daily and I have noticed that OP has a wide vocal range. I think it was Tuesday or Wednesday that he began to speak towards the lower end of his vocal range, but by Friday and today its back at the high end. I believe he has been instructed or realised him that he must speak at the higher end of his vocal range to persuade the judge that he is capable of screaming like a woman, but under the stress of questioning may have forgotten to do this.

*Breakfast FOOD for thought..* *KEY EVIDENCE to CONSIDER??* 4/15/14 posted (9:05am) The DEFENSE is carrying on as IF the light was NOT working. However, Oscar could have dismantled the light after the shooting, or just SHORTLY BEFORE when he PREMEDITATED murder. In the heat of an argument, Oscar could have told Reeva that he was going into the restroom to cool off but then when he got into the restroom, he could have dismantled the light so that when he COERCE Reeva into the restroom, it would be dark AND by it being dark, that would have made Reeva even MORE fearful as Oscar stood there in front of the door THREATENING REEVA with his gun and the TERROR of all of that could have accounted more for why Reeva screamed as horrifically as she did. Also, with the projected photos, the DEFENSE is carrying on as IF Oscar was on his STUMPS. As I mentioned before, I strongly believe that Oscar had on his LEGS WHILE shooting and that Oscar simply KNELT DOWN to shoot AND he leaned against the wall to make it ACTUALLY (SEEM) like he was REALLY on his stumps while shooting. I also believe that Oscar was telling Reeva that he was doing those things as he was doing them and that further TORMENTED and TERRIFIED Reeva and made her SCREAM for her life EVEN MORE. Also, when the witnesses saw a man walk past the window, did they see Oscar at the height of his (stumps) OR did they see Oscar walking on his prosthesis?? Either way, Oscar could have walked passed the window while KNEELING DOWN (WITH) his LEGS ON. On the other hand and just for the sake of argument, who’s to say that the witnesses did NOT see Oscar walk across the restroom door (AFTER) he allegedly RAN and put on his legs. Either way, I believe that Oscar was wearing his legs when he walked passed by the window, regardless if he was kneeling down or standing up. Inasmuch, Oscar testified that at some point, he ran and put on his LEGS and came BACK to kick the restroom’s door in. Anybody with common sense would know that you CAN’T kick that particular door in with PROSTHESIS / FAKE LEGS that can FLY OFF and Oscar knew that too but to make his story seem plausible/ believable, he did so while at the door BUT perhaps Oscar WAS dumb enough to think that he could kick the door in with prosthesis, JUST LIKE he was DUMB ENOUGH to PREMEDITATE MURDER and KILL Reeva and hand the court an ELEMENTARY / BUBBLE GUM STORY about what happened. Also, as forensics stated before, the sock material and MARK that’s seen on the door, COULD HAVE come from when Oscar picked up Reeva’s body and then walked over the door panel which was laying on the floor. Oscar could have slipped on the wood while carrying Reeva and the heavy weight of Reeva *and* Oscar (on) Oscar’s prosthesis, could have caused Oscar’s prosthesis and or sock material to rub off on the door panel as it layed on the floor. Inasmuch, I think that Oscar TRIED to kicked the door down to SEE his FINISHED WORK! Oscar had an AGENDA and he WANTED to see his FINISHED WORK. He did NOT want to SAVE Reeva's life and he didn't. Also, I would think that when Oscar allegedly went into his bedroom to put on his legs, it would have made sense to grab the cricket bat at that point to break the door down. I strongly believe that Oscar ALREADY had on his legs when shooting but that he KNELT DOWN to shoot and afterwards, STOOD UP and kicked the door with his prosthesis and when THAT did NOT work, Oscar FLED to his bedroom and grabbed the cricket bat, came back to the restroom’s door and broke the door open with the cricket bat. On another note, I don’t’ recall the witnesses being asked as to HOW SOON it was AFTER the shooting that they seen Oscar walk across the restroom’s door. We must remember that Oscar’s balance is TERRIBLE and that it must have taken time for him to navigate back to his bedroom and then put on his legs and run back to the restroom. So, were the witnesses asked HOW SOON WAS IT after the shooting that they saw a man walk by the window and were they asked how TALL the man was that they saw at that time?

On April 9, session 5, 41:16 - 41:20, O.P. testifies, "THEY DIDN'T KNOW THE FAN WAS WHERE THE ACCIDENT HAPPENED", evidence from Oscar Pistorius that the "ACCIDENT" started in the BEDROOM. The statement happened so quickly that Prosecutor Nell did not catch it. Photo evidence at trial showed "BLOOD SPLATTER" on the bedroom carpet and on the duvet.

I'm pretty sure if it was so dark in that house, a relative stranger would need a light source to navigate the bedroom/hallway/bathroom and toilet, to navigate the route safely. One would certainly switch the bathroom light on once you arrived at the bathroom so you can use the toilet comfortably. Showing an image of the witnesses balcony window with the curtains closed is a problem why? Its early evening, and the light is still on inside, we would pull our curtains back on ties when it was hot, but only when we turn the lights off so no one has a clear view into the house. The image of him on his knees looking out the window is No way to scale, Pistotius is at the very least a foot taller that that, and he probably had his legs on anyway. How high off the ground was the photographer standing when he took the bathroom shots, window hight, or no? same hight as the witnesses. The light in the toilet may have been when he cracked open the door slightly with the cricket bat.

One does feel sorry for Oscar Pistorius for the mess he has got himself into and his remorse for the consequences of his actions but not for the actions themselves. Fact remains that regardless of the reasons, he did chase Reeva and hunt her down like an animal, but all that is for the court to decide. There is not just one but several gaping holes in defense's story. Oscar wants to be tried not on the basis of raw evidence and motive but on the basis of his his own story and his own presumptions. But again, one can't be blamed for trying to save his own life from the court's imminent verdict, it is normal human instinct. First, he states that he was screaming for the intruder/intruders to get out and screaming at Reeva to "call the police". Reeva did not say anything to him like "I am calling the police, Oscar" or "be careful, Oscar" or "don't go there Oscar, let's just call the police from the bedroom first before going down the passage to check out the bathroom". That would have been Reeva's obvious and natural reaction and response. But Reeva did not even whisper back to Oscar. But yet, petrified, terrified, hopeless and helpless as he was DESPITE being armed with a gun, DESPITE not knowing for sure if there is a single intruder, 2 or 4 or 5 intruders or NO INTRUDER AT ALL or it's Reeva in the bathroom, he still goes out there alone, armed and pumps several bullets in a relatively small "group" in the language of firearm ballistics! I can very well understand if a woman or an unarmed person feeling that way but it was not the case. I am an owner of several firearms ranging from pistols, revolvers, rifles and a AK-47 assault type rifle. Also, I am a medical doctor, a M.D. Pediatrician but as a Medical Student and later as a Resident I have attended, assisted and even performed (under attending Pathologist supervision) several autopsies- medical and forensic- where to aid in coming to a conclusion of the cause of death- you have to know as much as possible the surrounding circumstances like the perpetrator's and victim's medical, mental and drug histories, about the scene of the crime, the weapon used and many other things. I have also examined and treated several rape, assault and accident victims, children and adult. Of course, I can never compare my limited knowledge to that of a qualified Pathologist or Forensic expert but with my fundamental knowledge of medicine including Pathology, Anatomy and Physiology and Criminal Justice COMBINED with my knowledge of civilian firearms of all types and related muzzle and terminal ballistics, I think it's safe to argue that Oscar did it with full knowledge and with homicidal intent. He may have been in rage, anger, passionate mode or even temporarily insane but that is besides the point, here. About the bathroom door, cricket bat, bullet holes in the door, bullet first or cricket bat first, for each one of the defense's expert witness's theory the prosecution could reasonably put forward 2, 3 or more counter-theories. Good luck Oscar, there is no winner or loser here because everybody has lost something or someone but may justice prevail and the guilty be punished. And everybody is innocent unless proven guilty. Oscars argument was that he heard the window in the bathroom open, he got out of bed telling Reeva to get on the floor and call the police. he put on his legs, got his gun and headed off towards the bathroom with his gun pointing forward. Somehow Reeva ended up in the toilet and he shot her. How did Reeva on being told by Oscar to call the police miraculously walk past him and enter the bathroom and went to the toilet and Oscar shot her mistaking her for an intruder? Nothing makes sense, not the defense, the prosecution, this idiot forensic scientist or this court case run b

NO NO that is not correct he did not put on his legs on first.He found the gun took it of it's holster,told Reeva to take cover and hobbled to the bathroom shaking like a jelly. Does anyone have any doubt that a cricket bat hitting a marante door sounds like a gun shot?
@danielking9830
@danielking9830 10 жыл бұрын
It can make a different kind of bang. What they should have done is played the two different kinds of sounds to the witnesses so they could say "ahh, that noise is the first one i heard = gunshots, that other noise is more like the second, = bat". Also it makes a difference if it's one gunshot on its own or three in rapid succession so you can get weird reverb effects off other houses etc, so it become harder to count the number of them precisely. Bat probably is much less explosive and at a lower volume - but we won't know since defense didn't present their tapes!

this is so sad for many reasons, a beautiful girl , full of life and her whole world to live is dead, a handsome man , with everything to live for, with the world at his feet, both their families destroyed and their friends lives will never ever be the same. I have tried all along to see things from Oscars point of view , but at this time , I truely feel the prosecution is correct. Its just a shame, and a waste , so sad. a moment of maddness and jealousy has destroyed so much .

So, according to OP, Reeva went into the bathroom and closed the door to the toilet, where the bulb was not working, and thus chose to pee in the pitch black. This guy says the toilet room is completely dark with the door closed. Who would do that? She not only closed the door but locked it, obviously for self protection. What a joke.

The cricket bat sounds an awful lot like gunshots. Interesting and important for the states defense.

Mr Dixion is a useful witness. Hasn't got a mean bone in his body. well spoken. non aggressive AND he gave Mr Nell a spare photo when Mr Nell misplaced his copy. Mr D does not hold grudges. God bless his little soul.

This Dixon guy is so amateur its unbelievable. He's a geologist and a geological forensic guy who did a few courses in forensics. mmm, lets see OP bring in a historian for the next defence witness Nel will eat this guy for breakfast.
