I am the 4th generation of my family who's in legal metier, where the 3rd ones have instructed me to start mentioning (just completed my degree) but dont bulge rather rebuke me if I ask about the proper process of mentionong (although I have seen it in process in courts, I must know the clear procedure before I start it for myself). Thankfully you were here to help me in time. Will start from 3 days after.

Please refer to the court's practice being followed. Court practices may vary. So it's best to confirm from the lawyers practicing in that particular Court about which you want information.

For that you need to check the roster of judges published by the High Court for that period. The roster indicates which court is assigned with which type of cases.

That's correct. Tagging a case along with another case is just like clubbing one matter with another, or consolidating two matters together for common hearing. Different words but same meaning.

Sir, if a petitioner wants to request judge for speaking from box, then she/he needs to address the judge as "my lord/,lordship" or just "Sir"?

I don't know what do you mean by "speaking from the box". Probably you are referring to what is shown in the movies where it is said by the judge ki aapko jo kuch kehna hai witness box mein Aakar kahiye. But whenever you address the judges it would suffice if you address them respectfully with a simple "sir". If you are an advocate practicing before the courts and if you are practicing at high court or Supreme Court, then you may address the judges as 'my lords' or your lordships' or even simply 'sir' as per your choice. If you are a lower Court Advocate and addressing lower Court judges then you can address them as 'your honour' or simply as 'sir' as per your choice.

Precedence means seeking preference in hearing over other matters when the matter in which precedence is sought is already listed along with other matters, on the cause list of the court. This is done in case of urgency of the situation. Seeking circulation is making a request to the court for listing the matter on the cause list of the court at a time or day on which the person seeking circulation is making a request in view of urgency of the situation. So generally in case of precedence a case is already on board, but the party wants urgent hearing for that day before the other matters are taken up whereas circulation is in a situation where the case is not on the board but the party wants the case to be taken on board for hearing.

It appears that your case is pending in the court, meaning that you also have engaged a lawyer. So under the circumstances it is best to ask your lawyer. All the best।

Normally it is done verbally either on phone or by meeting personally if possible. There is mutual trust in such matters, and the same is expected even from a litigant in person. No need to take written consent, its very exceptional...I have not ever seen anyone taking written consent in such matters.

The first thing is that to know the reason mentioned by the judges you will have to look into the order that is passed on that day. If the order does not show any reason then it can only be guessed. The common guess could be that that is the reasonable time within which the case should be listed. Beyond this there is no way to know. The best thing you can do is to ask your lawyers conducting the case.

Prior to mentioning a case before the court, it is a good practice to first inform your opponent or the Counsel for opponent either on phone or through other means of communication that you will be mentioning that case before the court for whatever the objective of your mentioning would be.

Also, I want to associate with any civil advocate at High Court (Lucknow) during Court timing. Because already I am at the age of 36. So, I want to study and practice together. Is it possible?

You may join the office of any advocate who is practicing in court already. You may be able to observe and learn from him that is all. But you will not be able to practice because for practicing law as an advocate you would need a licence from the bar council which you can get only after getting the law degree. Therefore it may not be possible for you to both study and practice law at the same time. As I told you while studying you may only be able to learn in the office of an advocate in addition to your college studies. Best regards.

महोदय यदि कोई उच्च न्यायालय इलाहाबाद का स्टैंडिंग काउंसिल गवर्नमेंट ऑर्डर के विरोध में प्राइवेट मुकदमे की पहली कर रहा है और स्टे आर्डर को बढ़ावा रहा है केस का निर्णय नहीं करना चाहता है ऐसी स्थिति में रेस्पोंडेंट क्या करें

अगर कानून के हिसाब से ह्यूमन राइट्स कमीशन के जूरिसडिक्शन में केस बैठता है तो और अगर केस गुणवत्ता में अच्छी हो तो केस करने में कोई गलत नहीं!

जी! कमेंट के लिए धन्यवाद! जी ऐसा नहीं है! जहातक हो सकें मै रिप्लाई जरुर देता हु. आप देखिये कई कमेंट्स और पोस्ट्स के निचे मैंने अपने डिटेल जवाब दिए हुए है. हा यह बात है की मै हर एक सवाल का जवाब नहीं देता. इसके कुछ कारण है. पहला: कई बार वह सवाल इतना पूर्ण नहीं होता की ठीक से समझ आये. दूसरा: की अगर समझ भी आये तो वह मेरे काम के क्षेत्र का नहीं होने की वजह से मुझे उसका सही जवाब पता नहीं होता. तीसरा: मेरे कार्यक्षेत्र के कुछ सवालों के जवाब देने के लिए थोड़े गहराई से रिसर्च करना जरुरी होता है. मुझे भी अपनी व्यावसायिक व्यस्तता है. वहा भी पूरा ध्यान देना पड़ता है. तो ऐसे में गलत जवाब देना ठीक नहीं. आशा करता हूँ की आप इस बात को समझेंगे. - अधिवक्ता नहुष खुबालकर -
