Good morning, I have a question, first I want to thank you for the video, my question is whether a migration company offers this way, but in the withholding document it indicates that it will charge after the positive Lmia, is it reliable or is it better to do an offer until when the work permit comes out?

It is illegal to charge based on outcome as immigration companies do not assess applications. It’s IRCC that assesses applications. While most of the good immigration firms know their role and structure the application well, there is no guarantee for success. If anyone is guaranteeing, then you need to be careful. Hope I’ve answered your question. One more thing, I do know of companies that charge an amount upon getting you the visa, but that’s for post landing services.

Hello,Madam,thank you for this nice video. In speak of the LMIA &Job offer through Owner-operator work permit stream ,i learn that one of the essential requirements which must be compliant with is a genuineness of a job offer. But my adviser says i can get LMIA and job offer with open work permt by reistering a company under my name,and i need to find a real job from other company after landing Canada,so my concern is: how could I run the in-my-name-registered company's business while I'm working for other company at the same time? I think there are some legal risks to me. Pls clarify it for me, tks.

Please be careful. There is no way you can just register a company, give yourself an offer and apply for LMiA. What you can do though is continue to work with your employer on your open work permit, register a company, work part time towards that company (freelancing etc..) and then use that company and your experience to apply for a C11 work permit at the end of your work permit validity. Ensure you do this when you have at least 4 to 5 months left on your open work permit. This will ensure you get your closed work permit (C11) and you can then work towards your business that you have been doing freelance for anyway. Just a company registration on its own is useless. The corporation in this case is lifeless. Good judgement is to not do anything that doesn’t sound right to you. Because if you don’t think it makes sense, definitely IRCC will not think it makes sense and they will reject for sure. Hope this helps.

What's the best pathway for someone over forty with a bachelor's degree in English literature but no work experience and all l have is 35 k CAD, can l rent a shop and be self employed or should I study a one year program cause my money won't be enough for two years program, what is the best pathway and what are my chances if l have any?

I don't understand one thing. If IRCC gets really deep into identifying that no eligible candidates (PR or citizens) were available for jobs. How come these laywers are selling LMIA's for crazy amounts for jobs like Subway front desk, Tim Hortons etc. Their LMIA gets approved. How is that possible? I know they kind of do advertisements on Indeed and stuff, but it''s just for the purpose of making their reasoning strong. However, there are PR or citizens can be easily available for the job Can you answer this Priya?

I'm going to respond that's suitable to a public forum - As for your question about low-wage jobs / LMIAs, it might be possible that these positions are being filled in locations where there is a shortage of available local workforce, such as less-populated provinces or rural areas. ESDC might approve these LMIAs if they believe it benefits the local economy and there are insufficient resident workers to fill the vacancies. But, again, this is a general observation and the specifics of how some lawyers might be getting these LMIAs approved for roles that you've mentioned, like Subway front desk or Tim Hortons, would require a deeper understanding of each case's nuances. Perhaps you should direct your questions at these lawyers who are getting such approvals.

The approval rate drastically dropped. There are reasons why these advertising changes were made. The approval rate dropped below 60% for this program.

If you have a majority stake in the business, you can apply under the program. If you are just an employee, then you don’t qualify. Depending on how long you have worked under the closed work permit, you may be eligible to apply for PR.

You will need a work permit to operate a business here. If you have a good business back home, we can convert your visitor status to work permit under an IM program that requires no LMIA. But without it, you cannot work here.

Hello! I just found your video. I'm planning to do this program also. Very helpful. Thanks so much! I just wonder if it's the same as self-employed program (C11) as you mentioned in your website. I think C11 is LMIA exempt but Owner Operator LMIA is not, is it correct?

That’s correct. It’s C11 but is not LMIA exempt.
