Consequently, he cannot interfere in the governance of Parish Churches by appointing Vicar, Priests, Deacons, Prelates (High Priests) etc. and thereby cannot create a parallel system of administration. The appointment has to be made as per the power conferred under the 1934 Constitution on the concerned Diocese, Metropolitan etc. (vii) Though it is open to the individual member to leave a Church in exercise of the right not to be a member of any Association and as per Article 20 of the Universal Declaration of Human Rights, the Parish Assembly of the Church by majority or otherwise cannot decide to move church out of the Malankara Church. Once a trust, is always a trust. I (viii)When the Church has been created and is for the benefit of the beneficiaries, it is not open for the beneficiaries, even by a majority, to usurp its property or management. The Malankara Church is in the form of a trust in which, its properties have vested. As per the 1934 Constitution, the Parishioners though may individually leave the Church, they are not permitted to take the movable or immovable properties out of the ambit of 1934 Constitution without the approval of the Church hierarchy.

​@@floccinaucinihilipilification0 ആദ്യം കേസ് കൊടുത്തത് യാക്കോബായ വിഭാഗം ആണ് (case number OS. 95) സുപ്രീം കോടതി വരെ പോയി കേസ് നടത്തിയവർ ആണ് ഇരുകൂട്ടരും(Orthodox & Jacobite) ..... കോടതി ചോദിച്ചു... ഇത് വിശ്വാസ തർക്കം ആണല്ലോ so.... ഈ പ്രശനം നിങ്ങൾ ഇരുകൂട്ടരും സംസാരിച്ചു പരിഹരിച്ചുകൂടെ? അന്ന് യാക്കോബായ പക്ഷം പറഞ്ഞത് ഇത് വിശ്വാസതർക്കം അല്ല അതിൽ ഞങ്ങൾ ഒന്നാണ്... ഇത് ഭരണപരമായ കാര്യം ആണ്... ഞങ്ങൾക്ക് കോടതിയെ വിശ്വാസം ആണ്... കോടതി പറയുന്നത് പോലെ അനുസരിക്കാം എന്ന് കോടതിയിൽ എഴുതി കൊടുത്തു .... atlast 3rd July 2017 സുപ്രീംകോടതി വിധിച്ചത് (വാദ പ്രതിവാദങ്ങൾക്കു ശേഷം എന്നത് വിസ്മരിക്കരുത് ) ഇവിടെ നിയമപ്രകാരം means.. ഭരണഘടനപ്രകാരം (1934 constitution) നിലനിൽക്കുന്ന സഭ... മലങ്കര ഓർത്തഡോൿസ്‌ സഭ ആണ്. അതുകൊണ്ട് മലങ്കരയിലെ എല്ലാ ദേവാലയങ്ങളും ഈ constitution പ്രകാരം ഭരിക്കണം...... അപ്പോൾ യാക്കോബായക്കാർ പറഞ്ഞു ഇത് ഞങ്ങളുടെ വിശ്വാസപരമായ കാര്യം ആണ് (പറഞ്ഞത് മാറ്റി പറഞ്ഞ്... sentiments workout ആക്കുന്നു) അത് കൊണ്ട് വിധി അംഗീകരിക്കില്ല... ഇവിടെ ഒരു സഭയെ ഉള്ളൂ.... അതുകൊണ്ട്.... യാക്കോബായ എന്ന വിഭാഗം തട്ടി എടുത്തു നടത്തി വന്ന ദേവാലയങ്ങൾ എല്ലാം 1934 constitution under ൽ വരും... ഇടവക അംഗങ്ങൾ അവരുടെ ദേവാലയങ്ങളിൽ മുൻപതിവു പോലെ തന്നെ തുടരാം .. ആരെയും ഇറക്കി വിടുന്നില്ല..... അങ്ങനെ ചെയ്താൽ അത് ഓർത്തഡോൿസ്‌ക്കാർ ഈ court order ന് against ആണ് പ്രവർത്തിക്കുന്നത് എന്നത് സ്പഷ്ടം...... എല്ലാ ദേവാലയങ്ങളുടെ ഇടവക വികാരി 1934 constitution അംഗീകരിക്കുന്ന മെത്രാപ്പോലീത്തായാൽ ചുമതലപ്പെടുത്തിയ പട്ടക്കാരൻ ആയിരിക്കണം.. so only change in administration level. ഇവിടെ ജോലി നഷ്ട്ടപ്പെടുന്ന യാക്കോബായ മെത്രാപ്പോലീത്തമാർ ആളുകളെ ഇളക്കി പ്രശ്നം ഉണ്ടാക്കി താങ്കളുടെ സ്ഥാനം ഉറപ്പിക്കാൻ ഉള്ള ശ്രെമം ആണ് എന്ന് തിരിച്ചറിയുക....... തർക്കം ഉള്ളത് കൊണ്ടാണല്ലോ കോടതിയിൽ പോയത് (യാക്കോബായ വിഭാഗം കൊടുത്ത കേസ് ആണ് എന്ന് മറക്കരുത് ) അപ്പോൾ പരമോന്നതമായ കോടതിയെ അനുസരിക്കണം എന്ന് ആദ്യം മനസിലാക്കുക. യാക്കോബായ പക്ഷത്തിനു നീതി കിട്ടണം എന്ന് ആണ് ഇപ്പോൾ എല്ലാവരും പറയുന്നത് ..... ഒരു സംശയം ചോദിച്ചോട്ടെ , ഒരു ജനാധിപത്യ വ്യവസ്ഥിതിയിൽ ആർക്കെങ്കിലും നീതി നിഷേധിക്കപ്പെട്ടാൽ എവിടേക്കാണ്‌ പോകുന്നത്? എന്റെ അറിവിൽ കോടതിയിലേക്കാണ് . അതുകൊണ്ടാണല്ലോ നീതിന്യായകോടതി എന്ന് അതിനെ വിളിക്കുന്നത് തന്നെ . നീതിന്യായ കോടതിയുടെ വിധി അനുസ്സരിക്കുവാനും നടപ്പിലാക്കുവാനും തുടങ്ങുമ്പോഴല്ലേ നീതി നടപ്പിലാകൂ ? പതിറ്റാണ്ടുകൾ കേസ്സു നടത്തിയിട്ടു ഇപ്പോൾ സമരം ചെയ്യ്‌തും, ഓർത്തഡോൿസ്‌ ക്കാരെ തെറി വിളിച്ചും, നിയമം നടപ്പിലാക്കാൻ വരുന്ന അധികാരികൾ തടഞ്ഞും നീതി വേണമെന്ന് പറയുന്നത് എന്ത് അസംബന്ധമാണ് ? ഇവിടെ ആരെയും ഇറക്കി വിടുന്നില്ല അങ്ങനെ ഇറക്കി വിട്ടാൽ അത് ഓർത്തഡോൿസ്‌ സഭയ്ക്ക് എതിരെ കോടതി അലക്ഷ്യം ആകും. Administration according to 1934 constitution. കോടതി വിധി നടപ്പിലാക്കണം അത് അല്ലാതെ വേറെ ചർച്ചകൾ നടത്തി പ്രശ്നം solve ചെയ്യാൻ സർക്കാരോ മറ്റ് മാധ്യസ്ഥരോ ഇടപെടരുത്. വിധി accept ചെയ്‍തതിനു ശേഷം എന്തെങ്കിലും ammendmend വേണം എങ്കിൽ ഇരു കൂട്ടർക്കും സംസാരിച്ചു ammend ചെയ്യാം. ഇതാണ് കോടതി പറഞ്ഞത്. എന്നിട്ടും ഓർത്തഡോൿസ്‌ സഭ വിട്ട്വീഴ്ച കാണിച്ചു പലവട്ടം ചർച്ചയിൽ പങ്കെടുത്തു എന്നിട്ടും jacobite group and government വിധി ആട്ടിമറിക്കാൻ ശ്രെമിച്ചു. ശാശ്വത സമാധാനം കോടതി വിധി നടപ്പിലാക്കുന്നതിലൂടെ മാത്രം ലഭിക്കുകയുള്ളു. അല്ലെങ്കിൽ വരുന്ന തലമുറകൾ ഇനിയും കോടതി കയറി ഇറങ്ങും.. 1958 ലെ ഓർത്തഡോൿസ്‌ അനുകൂല വിധിയിൽ ഓർത്തഡോൿസ്‌ സഭയുടെ കോടതി ചിലവ് യാക്കോബായ വിഭാഗം നൽകണം എന്ന് ആയിരുന്നു വിധിയിൽ പരാമർശിച്ചിരുന്നത് ആ വിധി മാറ്റി വച്ചിട്ട്, കോടതി പറഞ്ഞത് പോലെ അനുസരിക്കാതെ സഹോദരാ സ്നേഹത്തോടെ കോടതി ചിലവ് പോലും സഭ വേണ്ട എന്ന് വച്ച് യാക്കോബായക്കാരെ സ്വീകരിച്ചു അവരുടെ bishops n priest ന് ഭദ്രസനവും ഇടവക ചുമതലയും കൊടുത്തു എന്നിട്ട് അവസാനം സ്വത്തു മോഹിച്ചു വിഘടിച്ചു പോയി 2002 ൽ socity Act പ്രകാരം തട്ടിക്കൂട്ടി യാക്കോബായ എന്ന് സ്വയം വിളിച്ചു സഭ ആക്കി. ഇനിയും ഓർത്തഡോൿസ്‌ സഭ വിട്ട് വീഴ്ച ചെയ്യണം എന്ന് പറയുന്നത് ശെരിയാണോ? ഇതാണ് സുപ്രീംകോടതി പറഞ്ഞത്, ഇവിടെ യാക്കോബായ എന്ന സഭ ഇല്ല, മലങ്കര സഭ മാത്രമേ ഉള്ളു എന്ന്. സുപ്രീംകോടതിയുടെ വിധി അനുസരിച്ചാൽ മാത്രം മതി. ഇനി കോടതി വിധിയുടെ അടിസ്ഥാനത്തിൽ ഉള്ള സഹോദര സ്നേഹമേ അല്ലേ അവർ അർഹിക്കുന്നുള്ളു. അല്ലെങ്കിൽ വരുന്ന തലമുറകൾ ഇനിയും കോടതി കയറി ഇറങ്ങേണ്ടി വരും.......

ഭൂരിപക്ഷം (majority) നോക്കി അല്ല ഏതു കോടതിയും വിധി പറയുന്നത്. യാക്കോബായ വിഭാഗം കൊടുത്ത കേസിന്റെ സുപ്രീം കോടതി വിധി അനേക വർഷങ്ങളുടെ വാദപ്രതി വാദങ്ങൾക്ക് ശേഷം ആണ് വന്നത് യാക്കോബായ വിഭാഗം പിടിച്ചെടുത്ത ദേവാലയങ്ങൾ നിയമ പോരാട്ടത്തിലൂടെ തിരിച്ചു യെഥാർത്ഥ ഉടമകളായ ഓർത്തഡോൿസ്‌ സഭക്ക് നൽകണം എന്നും. ഓർത്തഡോൿസ്‌ സഭയുടെ administration ആണ് ഈ ദേവാലയങ്ങൾ ഭരിക്കപെടേണ്ടാതെന്നും, ഇരു കൂട്ടർക്കും ഒരുമിച്ചു ഈ ദേവാലയത്തിൽ ആരാധന നടത്താം എന്നും, സമാന്തര ഭരണം (Parallel Administration) അനുവദിക്കില്ല എന്നും യാക്കോബായ വിഭാഗം കൊടുത്ത കേസിന്റെ സുപ്രീംകോടതി വിധിയിൽ വ്യക്തമാക്കുന്നു 👇🏻👇🏻👇🏻👇🏻👇🏻👇🏻👇🏻👇🏻👇🏻👇🏻👇🏻👇🏻 🛑Please read the Supreme Court verdict aganist the suit filed by Jacobite fraction🛑 (vi) Full effect has to be given to the finding that the spiritual power of the Patriarch has reached to a vanishing point. As per the 1934 Constitution, the Parishioners though may individually leave the Church, they are not permitted to take the movable or immovable properties out of the ambit of 1934 Constitution without the approval of the Church hierarchy.
