The Supreme Court of India in its latest judgement in the case of Jatinder Kumar Sapra vs Anupama Sapra, gave a new ground for divorce for husband and wife.
The couple married in 1991 and had two children. After 14 years of marriage, marital discord arose. Jatinder Kumar Sapra filed a petition for divorce under Section 13(1)(ia) of the Hindu Marriage Act, 1955, citing irretrievable breakdown of the marriage. Anupama Sapra contested the petition and made allegations of cruelty against her husband.
Lower Court Decisions: Both the Family Court and the High Court of Punjab and Haryana dismissed Jatinder Kumar Sapra's petition for divorce.
Supreme Court Judgement: The Supreme Court granted leave to appeal and dissolved the marriage based on irretrievable breakdown. The court acknowledged that granting divorce on this ground is not an automatic right, but a discretion exercised after considering various factors to ensure fairness to both parties. These factors included:
Duration of cohabitation and the date of separation
Nature of allegations made by each side
Impact of legal proceedings on the relationship
Efforts at reconciliation through mediation or court intervention
Whether the separation period exceeded six years
Economic and social status of the parties
This case was significant because it highlighted the factors considered by the Supreme Court of India when granting divorce based on irretrievable breakdown of marriage.

If we think of the present modern society,and reversal of values of marriage, couple goals,attitudes, any lengthy legal process is not in the interest of warring couples,who may go to extremity and harm the other partner,to get rid of. If the Family Court is empowered to decide irretrievable breakdown of marriage in any case,it will help the couple from enduring the long legal process,and financial burden.

If one was living separately from spouse, with grownup kids who were independent and had no intere 8:20 st in any other person, would a divorce matter all that much so as to go up to the Supreme Court ?

Sir meri shadi ko 7 year ho gye hai aur 2017 mai marriage hui aur 2018 se abb tak alag reh rhe hai aur usne 2018 se false case kiye hai. Jaise ki dv but vo prove nai hua. Aur dowry chL rha hai. To kya sir mai v direct iss law se supreme court ja kar direct divorce apply kr sakta hoon. Kyuki vo paisa bahut jyada maagte hai. Aur sir court v ladies k favour le rhe hai aur ladki vi divorce liye manti hai but paisa bahut jyada keh rhe hai. Sir 7yr ho gye hai plz reply

Ab woh 498A lagaya.
