If the baton was made before May of '86, that would make it pre-ban. While it may require paperwork, it should be legal. Not to mention there are plenty of legal pistols of similar length that fire shotgun shells. Such as the Taurus Judge, which can fire either the .45 Colt cartridge or the .410 shotgun shell.

ATF regulations only say that it is considered a short barrel shotgun if it was modified after manufacturing, you can legally buy a shotgun with a short barrel no problem if it was factory made
