California law defines criminal battery as any willful and unlawful touching of the person that he or she finds offensive. Common examples include punching, slapping, kicking an pushing someone. It can also include spitting at a person, poking them or even just touching someone if it is done in an offensive way.
Under Penal Code 242, it is not technically required that the victim have a visible injury. However, the criminal case is always stronger if the prosecutor can show that injuries were sustained.
Battery is a misdemeanor carrying penalties of up to 6 months in county jail.
