भारत की न्यायपालिका.... दोतरफा चरित्र का बेहतरीन उदाहरण 1)भारत के न्यायाधीशों की सैलरी टैक्स फ्री होती है ,ये लोग टैक्स नही भरते,लेकिन इसी न्यायपालिका में टेक्स चोरी पर केस चलते है..... 2)भारत की न्यायपालिका में मीडिया allow नही है,मीडिया किसी भी केस की सुनवाई को cover नही कर सकता,ये एक अपराध है,मगर भारतीय न्यायपालिका मीडिया की आज़ादी की बात करता है.... 3)आज़ादी से लेकर अब तक भारत के जजों की या न्यायपालिका की कोई नैतिक जिम्मेदारी तय नही की गई जिसे judicial accountability कहते है। मगर यही न्यायपालिका आम आदमी पर जिम्मेदारी थोपते हुये उसे सजा सुना देती है.... 4)भारत के सुप्रीम और हाई कोर्ट जजो को पद पर रहते हुये गिरफ्तार नही किया जा सकता। इन्हें महाभियोग द्वारा ही हटाया जा सकता है लेकिन यही जज आम आदमी को निरपराध होते हुये भी जेल में ठूस देते है.... 5)भारतीय न्यायाधीशों(सुप्रीम कोर्ट, हाईकोर्ट) की सैलरी जहां 2.5 लाख से 3 लाख रुपये महीना है,इसके अलावा भत्ते इत्यादि मिलाकर ये सैलरी 5 या 6 लाख रुपए/महीना हो जाती है किंतु ....किन्तु...…..अगर कोई आम आदमी सालाना 50 हज़ार भी कमाता है तो उसे हाई कोर्ट में फ्री वकील का हक नही है क्योंकि भारतीय न्यायपालिका के अनुसार सालाना 50 हज़ार यानी महीने का लगभग 4 हज़ार कमाने वाला गरीब नही है....जबकि महीने में 5 से 10 लाख खर्च करने वाले हमारे जज गरीब है।। 6)भारतीय न्यायपालिका के अधिकतर जज महंगी शराब पीते है किन्तु शराब बंदी को ये लोग जायज ठहराते हुए शराब बेचने वाले को जेल में ठूस देते है। 7)भारतीय न्यायपालिका के अधिकतर जज गौ मांस,सुवर का मांस(पोर्क) खाते है ,और हम इनके पास गौ हत्या रोकने को लेकर याचिका लगाते है। 8)जहां हर नौकरी में योग्यता,लिखित परीक्षा इत्यादि का प्रावधान है भले आप कितने ही काबिल क्यों न हो.....मगर भारत की सर्वोच्च न्यायपालिका और हाई कोर्ट में ऐसा कोई प्रावधान नही है।। 9)न्यायपालिका अक्सर लोकतंत्र की दुहाई देती है मगर भारतीय न्यायालयों में ही लोकतंत्र नही होता। वहां आप खुलकर अपनी बात नही बोल सकते। जजो ने अपने स्वयं के मापदंड बना रखे है जो जजो की व्यक्तिगत सोच मात्र होते है। 10)लोकतंत्र में आप सभी का विरोध करने का हक रखते है मगर आप भारतीय न्यायपालिका का विरोध नही कर सकते,अगर आप ऐसा करेंगे तो आप पर contempt of court की कार्यवाही हो जाएगी।। 11)अगर कोई जज किसी तरह का अपराध करता है तो उस पर मीडिया ट्रायल नही चलेगा,यानी मीडिया अखबार इत्यादि उसकी खबर नही दिखाएंगे ,उसे बदनाम नही करेंगे। अगर मीडिया ऐसा करता है तो मीडिया पर अदालत प्रतिबंध लगा देगी या पत्रकार को जेल में डाल देगी। मगर आम आदमी के मीडिया ट्रायल पर कोई रोक नही।। प्रश्न ये है कि क्या ऐसी न्यायपालिका न्याय देने में समर्थ है??? भूतपूर्व मुख्य न्यायाधीश जस्टिस ठाकुर ने कहा था कि "निष्पक्ष और सस्ता न्याय फिलहाल कोसो दूर है" वही कुछ दिन पहले सुप्रीम कोर्ट के ही एक जज जस्टिस गुप्ता ने कहा कि "जब तक आपकी अलोचना नही होगी तब तक आपमे सुधार कैसे आएगा,न्यायपालिका की आलोचना भी जरूरी है" इस भारतीय तथाकथित लोकतंत्र में वो दिन कब आएगा जब न्यायपालिका सच मे एक मुक्त संस्थान के रूप में कार्य करते हुये जाति, धर्म,क्षेत्र,लिंग,भाषा इत्यादि से परे फैसले देगी और लोगो को न्याय मिलेगा.....
