I just looked it up. So if a company was to find someone a position that has that ultimate earning potential I don’t think that 60% of one months salary is an unreasonable fee. I think the problem here is that people respond To the 60% of one months salary as a fee as being very high when actually securing a job with such earning potential and benefits makes that fee very reasonable.

i work in the staffing/recruiting industry and absolutely never work with an agency charging YOU. the business pays the agency to find someone for them. i’ll tell you there’s nothing more satisfying then getting someone a job that has been out of work or in a bad job, and that smug look the plaintiff made when she realized she was going to win was disgusting. honestly i don’t know how they even manage to stay in business because so much of agencies’ success comes from getting referrals from candidates you’ve placed and no one is ever going to recommend these people. sixty percent of one month of a teachers salary is disgusting and they should absolutely be ashamed of themselves

In teacher recruiting, the school pays the commission BUT if the teacher breaks the contract and resigns before the year is up, the teacher has to reimburse the school. In this instance, she broke her contract. Since the school never paid the recruiter, she can’t reimburse them and instead has to pay the recruiter directly.

The reason the agency sued the teacher and not the school is because the teacher broke her contract with the school. If a teacher breaks contract with the school, the teacher pays the commission (either by reimbursing the school or directly to the agency, depending on whether or not the school already paid the agency).

Worked with plenty of recruiters in accounting. They generally get 30% of the annual salary. So yes 12-18k for placing someone is not uncommon. Except the employer pays it, not the recruit.

The issue here is those fees are usually paid by the employer, not the job-seeker. She shouldn't have agreed to this, unless she wanted a very specific type of position she couldn't secure on her own.

The type where the employer pays is an agreement between the recruitment firm and the employer (e.g., the headhunter has an agreement in place with the given employer). Here, the employer and the recruitment firm were at arms-length---the applicant can't contract on their behalf. The defendant agreed to cover this fee.

The judge explained how when you sell a piece of real estate it’s the same way when you list with an agent.

Teachers, you don’t need these placement agencies!!! These companies used to be ways for prep schools to find highly qualified, specialized talent. Now, they just want to place you in charter schools because it’s quick and there are a million openings (because charter schools have horrid turnover). Usually, the school pays the commission, BUT if you leave the school before your contract is up, YOU end up paying the commission. Plus if you apply on your own, you can often negotiate a higher salary because the school doesn’t have the expense of paying a commission.

Very much like those car lots that pay you cash for your car and give you about 10 percent of the value. Usually the company that hires you pays. And it is alot. 60% of one month's salary for navigating the NYC public school system actually sounds like a steal if you want a job in NYC. Most of the recruiters I work with charged companies 30% of an annual salary. So 12-18k fee is not uncommon.

The plaintiffs sent out the defendants resume originally but the defendants resume was "overlooked" therefore the defendant WAS NOT hired at that time. Then the defendant sent her resume to the school herself at a later time & was hired. So how do the plaintiffs get the credit for the defendant getting a job? And a little over $2800 seems a bit much for their "commission". I would sign no such contract unless it was guaranteed they could & would find me a job.

my main piece of evidence and making that decision is the letter from the school itself saying that they did not consider her until she sent them her résumé. If they had received her résumé for the other position and she didn't get the job but then they had her résumé on file and referred to it to reach out to her offering her a different position or offering her to apply for a different position based on the résumé that the staffing agency originally sent them then I would say yes the staffing agency gets a cut but that's not how this one went down

This is an iffy case and I tend to understand the perspectives of both sides but considering that the school said they didn't consider her at all when the staffing agency sent her résumé and didn't consider her until she sent it to them on her own, I would say she found herself that job and therefore doesn't owe the staffing agency anything.
