I think the Plaintiff was using that line as a cover/substitute for the N-word. The movie dialogue was fitting because it's supposed to be an insult but i think the Plaintiff used the excuse of k-nig-ihts (knights) as a "PC", veiled attempt to refer to the defendant in a derogatory way and get away with it. I've seen the movie and agree that the line is funny in the movie but he was just a bigot for using it in this context. He knew what he was doing and acting like it was unrelated just makes him look foolish.

I dunno, I think it is more telling that the Defendant's position was "I just went over to apologize and then left" but then later when asked about the laptop/briefcase in his own words he said "I dunno what happened to it, it fell on the ground." If there really was no altercation, why was the briefcase even on the ground? Did the Plaintiff just...drop it? If it was just a chat then why would he have dropped it? I think it is far more likely that the Plaintiff was either exaggerating the attack (possibly due to not being accustomed to being accosted aggressively) or the rip itself was actually relatively minor. He did say it was around the pocket area-- so it is possible the pocket was pulled out of its stitching slightly which would be hard to see on the video. However, most importantly, in the video: the briefcase, which we KNOW was there based on the Defendant's own testimony that it was "on the ground" when he left, is now not being carried by the Plaintiff. If he was lying about his briefcase being stolen, wouldn't he still have it in the footage? What, did he just leave his own briefcase in the parking lot? The Defendant is lying about stealing it, it makes no sense otherwise. Unless we are going to claim that the Plaintiff decided to set his own briefcase off to the side off-view, rush in and fake a flustered reaction in front of the door cam just so he could then frame the defendant for money to replace his not-stolen laptop? Why? Some guy he didn't know walks up to him, rambling, and his reaction is to try and set up a scam via the hassle of small claims court? He had no reason to lie whereas the Defendant had every reason to. The Defendant was there to try and get his money back, not to "apologize". We don't know what was said during the convo, but I think it is far more likely that the Defendant realized he wasn't getting a refund and decided to steal the case in hopes to recoup some losses (or just out of spite). It takes far fewer leaps of logic to assume that the Plaintiff was slightly exaggerating about his shirt rip but telling the truth mostly than it is to assume he lied about the whole thing. Correct ruling.

I see a lot of people in the comments being caught up on the "barely ripped shirt" as proof that the plaintiff is lying. And even if he is exaggerating quite a bit, that does not mean the defendant is telling the truth. A huge part of solving any mystery good enough for small claims is trying to figure out if someone would even have a motive for doing what they do. Then, if there are two conflicting stories, determining which of the two requires fewer assumptions to be true. Personally I think it is an easy call between "plaintiff lied about his briefcase being stolen just because he wanted to drag some stranger through the court system in an annoying hassle multiple times since he is cruel or has nothing better to do" or "plaintiff exaggerated the attack but his briefcase WAS stolen, then looking back he got really angry at being mugged and did his best to try and bloat his experience when retelling it to be even more in his favor to get a sense of justice over the situation" For small claims court there doesn't need to be a huge amount of evidence. In cases like this mostly the judges rule on human nature and what logically follows. Plaintiff had no reason to lie about the stolen goods. Defendant did. Motive alone nearly seals the deal the Defendant is guilty.

Music - Exactly right. First of all in this type of court it’s done by “a preponderance of evidence”, and if this cannot be established they go by who is telling the truth or more honest. Plaintiff got caught in a lie as none of his clothes even look like it’s been touched let alone torn or ripped. He looks like he’s lied about things, exaggerated things, and not kept his word, throughout his whole life. His privilege allows for him to get away with this.

I think the attorney felt threatened, overreacted and threw the briefcase at him and ran (Fight or Flight). The briefcase could've been stolen by a passerby in the parking lot, or the briefcase may not have been taken at all. -The judge totally relied on the plaintiff's word with zero evidence, and also in the video the plaintiff's shirt is NOT ripped or even disheveled.

I'm kinda disappointed in the ruling on this smh Judge Milan normally seems to be great at navigating smoke screens but this plaintiff was obviously lying about that attack smh his shirt was not ripped on the pocket like he claimed (and I insist that this is very clear in that camera clip). He's supposedly so afraid & traumatized that he doesn't even look behind him when attempting to get into his office. I believe the defendant has been misunderstood based on his appearance, for instance his size yet if you listen to his words and observe his demeanor, he doesn't come across as someone who is interested in violence at all but an older, settled man who wants his credit for something he's already been screwed over on. Showing up at the plaintiff's job was a terrible idea yet I don't doubt that it happened as he said, he wanted to request his money back, plaintiff became afraid, having been taken off guard by an unknown large man who he then obviously recognized from their conversations once he'd identified himself (and possibly afraid because of the lyrics to whatever song this was) and he likely was so spooked that he dropped his belongings & ran. Defendant was probably nervous too, realizing he had scared this man, and ran off also. Leaving his belongings to be grabbed by any other random person crossing that parking lot. I have so many thoughts & opinions on this but mostly am disgusted at how the defendant was portrayed overall. He seems to have some sort of delay when responding but none of that is considered for his defense. He clearly stated that he turned his life around and seemed completely transparent when he said that he's a lot of things but not a thief. He shouldn't have come to the man's job unannounced for the exact reasons that resulted yet had explained that he was on a job in the area. This is disheartening.

I think the Plantiff lied and exploited the situation to use the law aganist the defendant. The Plantiff knew what to do. File a police report and then file the restraining order. Who was the Judge at Family court(Restraining orders) is going to believe more, the Clean Cut Forensic expert or the burly construction worker? The judge will believe the first. This happens alot. The defendant have to be careful on what he says and how he handle things. He might had thought he was right in trying to get his money back by going to the location but he will always be seen as wrong and the other party will find their way to spin it on you. The defendant should had just filed a small claim lawsuit in court. It's a life lesson for the defendant.

There's a couple things iv noticed here, the defendant was wearing gloves which yeah he's saying he's working but those gloves are clean, also the glasses and that he gave a fake name when going to his work put that with the I was just in the neighborhood story and find this very alarming but I feel the plaintiff exaggerated a bit because his shirt pocket doesn't look all that torn in the video and the fact he called police Infront of that camera, just think of the walk from the parking lot to the office door and that's not a outside door by the looks of it so that's a fair amount of time where he wasn't calling the police 🤔

Once the defendant talked about Jesus I instantly didn’t trust him. People who talk like that often have mental health issues and have a tenuous connection to reality. It makes me wonder if he is only imagining that his song was being used. I would want to hear the recording people’s side of that story. The defendant’s story that confirms he went there to get money or something of value. The plaintiff may have exaggerated some details, but the defendant is as dishonest as a television evangelist.

So yet another litigant who bought or paid for something they really couldn’t afford! Then want their $ back after a ridiculous amount of time has passed!! I’m sorry but that’s crazy and so not right! It is so sad to see dozens & dozens of cases that involve grown men & women who think it’s okay to put their hands on another person or that violence is how all problems should be solved!! SMH! (I think the Judge is seriously flawed when it comes to awarding amounts for certain cases!! Plaintiff deserved so much more than the measly amount she awarded him as that was seriously a joke!)😮

The seam of the pocket could have popped and continued to lay flat on his shirt, especially of it was starched. Just because it's not fraid with fibers sticking externally doesn't mean it's not ripped. What I do know is an burden of proof was needed to grant the restraining order. That burned of proof was met whether or not we see it here.

I agree with the Judge's decision, but the defendant is correct on one point; Lawyers have written the laws in a language only they can understand and then they charge hundreds of dollars per hour to interpret those laws for us poor slobs who actually work for our money. The Plaintiff's shirt wasn't torn in anyway. He stated that the Defendant tore his shirt. If you look closely at the video provided BY the Plaintiff....his shirt pocket was not torn at all. I think this Plaintiff got scared. The Defendant looks bigger than the Plaintiff. I believe the Plaintiff was lying and eventually the truth WILL come out.
