The plaintiff moved from Oregon to New York to attend college. When she got there, she says there wasn’t a working sink or kitchen, and the defendant let himself in all the time. The plaintiff is suing for a refund on the security deposit, rent, and aggravation. The defendant argues the plaintiff lived there for three days until she moved out. He’s countersuing for wasted time.

Judge Faith actually would allow the person to keep the money. She also would make people pay for a vehicle even if the seller jumped title. It's so interesting to see the difference between judges.

​​@@anjuelle3997 She shouldn't. You can't sell a car when you don't have clear title. It's illegal, because it's not legally yours to sell.. Makes me wonder if that person is a real judge. This one is. Not anymore. Her and Judge Judy are binding arbitrators now, but they were both real judges (JudgeJudy is not a good one anymore). I was shocked when I heard that Judge Mathis was a real judge, when he actually defended a person who used her sister's car without a license and without permission. Parroting what she said, well she just needed to go to the store. If he's a judge, he should know damn well that if the sister got into an accident and hurt someone, her sister who is actually following the rules, could lose her house. Some people shouldn't be judges.

I used to watch People’s Court on TV all the time. I’m so used to there being 2 cases for every episode, so when Harvey Levin says, “Litigants for the next case…,” I get psyched up for it. 😄😄

The good thing about this arbitration ("court") is that the show pays the judgment. The losing party must pay the show back. The show has more resources to collect the money if the choose to enforce it.

Who the hell does that landlord think he is? You can't walk into a renter's place unannounced. And you can't rent a place that isn't habitable, like not having access to a sink or kitchen, even a makeshift kitchen. He had no right to rent that place out in the first place, and should be charged for it. She definitely has a right to get all of her money back.

Happy she got her money back. Many have been brought up that someone's word alone is good. Unfortunately, that's never the case. Always, get it in writing. This landlord says he's helping her out. BS! He saw an opportunity to take advantage of a young woman moving far from her home. Fortunately, she found another place, which was very lucky. She'd been stuck if she hadn't.

I am tired of being over taxed by the government, but I think having proof of a current Certificate of Occupancy for every new tenant would cut down on illegal apartment renting. It should be a part of the leasing process. It might also help cut down on slum lords or absentee owners.

Uh directly contradictory judgement to what Judge Milian has ruled countless times before.. If its an illegal contract, the LL can't get extra unpaid rent or even put the deposit towards unpaid rent, but the judge does NOT reverse rent already paid for an illegal appartment (much the same as money paid for poor quality cocaine)

Meh. The plaintiff got lucky because it was an illegal apartment. Hope she learns her lesson that she can’t just blindly rent a place without asking proper questions and then move out 3 days later and expect all her money back. If it wasn’t illegal, she wouldn’t be entitled to her first month rent. Last month and deposit yes, but not the first month.
