Article 44 is just a Directive principle whereas Article 25 is a Fundamental right. Also under article 25 necessary restrictions have been provided on the ground of public order, morality, decency etc. Both Nehru ji and Baba sahib Ambedkar ji were in favour of UCC however while implementing UCC it must be noted that article 25-28 and 29 and 30 are not voilated also it has been rightly said that diversity is our uniqueness and thus it must be preserved.

UCC comes under DPSP and it is not mandatory for the states to implement it. Secondly, According to 42nd constitutional amendment act, the supreme court held that "secularism" is a basic structure of the constitution and it cannot be amended by the parliament..

DIVERSITY IN UNITY OR UNITY IN DIVERSITY "Unity comes from togetherness and togetherness is from unanimous decision." The above lines clearly indicates the power of uniquesnes especially when there is no doubt and confusion. India is a country where very large and different classes of people lives. We have vast population with religions attached with it , we are glad enough to have grown at the extent in this diversified nature of the people . This diversification is also stuffed with different religious practices , customs and laws which is somethimes lead to social chaos and disorder and for the very reason the govt of India is planning to adopt a kind of civil code that would be common in nature , which in other world is said as uniform civil code. Well , the country is set to launch a uniformity in civil code but we also know changes are always attached with resistance and that is something palpable at the moment. Thus the critics are - First as per various leaders especially from the muslim community is opposing this as it would bring the cultural significance to standstill . Second critic is that the country is known for its unity in diversity which will be ruined. Third it would be a kind of interference in religion in addition to force to convert law and order of religion which is prohibited as per the constitution. Forth there is a clear resistance from Naga committee as well , the committee is requesting the govt to not implement this because there personal law is different than other parts of the country and it would bring a sudden confusion and blur of law and order. Well critics aside , the main motto of the govt to form uniformity in law and order of the country which is so different that it highlights diversity in unity rather than unity in diversity and if the nation can follow a common criminal law than why not the personal law which is so different that the court sometimes have to take proper side for example there is a case of triple talakh where a woman had to move away from her husband even if he said so under a pressure , the man in such case can only reunite with the women if she marries other man and who than divorse her , this is because if religious law attached with them . This kind of law is there in different religions which doesn't have any weightage thus the govt is purposing a common of all laws ie picking some best thing from every religion and create a uniform law which is feasible and justified. Therefore there should be such kind of framework and after the formation of uniform law , it mi6st be discussed to all religious leaders and unanimously formed , the will bring peace in the country and the world as a whole.

A similar idea was brought by Akbar which later took the form of a new religion “Din-I-illahi” but this did not cater significant following and thus failed miserably. Taking best things out of all personal laws is a very subjective approach. Ideas are not painted as black and white and thus there should be given time and require expertise to achieve a mature uniform civil law. Also bringing consensus seems unachievable. Best that can be achieved is majority support from within the different communities. Jai Hind🇮🇳

Fundamental rights have been earlier limited to elevate the status of downtrodden.... further fundamental rights are not sacrosanct....most of the personal laws are gender biased and oppressive in nature...so they should be eliminated with the time. Also indian constitution prescribes positive secularism that means government can make positive changes in the religious matters. Further on the name of tradition oppressive practices can't be continued.

Why Uniform Civil Code is necessary? Wakf Act 1995, Has many draconian provisions, section 52 & 53 which can declare anyone has encroached & under these sections can order the person to leave with the help of DM SSP, Can that be done by Non Muslims? Do they have these privileges? There are limitations for Hindu deities to knock the doors of Court, it is having limitations with time, whereas WAKF board has no time limitations according to section 108, Is this not the violation of human rights & Equality in connection to various faiths? According to section 89 one has to send a notice to WAKF board before filing a case, it is just like parallel Government. Have you ever heard of sending notice to before filing a case? According to my knowledge it happens if a person is filing a case against Government. Section 4 & 5 WAKF Act, according to this there will be a survey of land that will be done on timely basis, whose expenses are to be bore by tax payers of India. 1991 worship Act, which is also non secular, In continuation, If there are any issues faced by Churches, Temples, Gurudwara it has register a complaint with Police, Whereas WAKF can order the police if there are any discrepancy according to the board & police has to abide by it. Is this true with your respective cases, introspect. WAKF Act, section 40 gives the power to the board in connection to declaration of any of the property as its own. Can a normal citizen do this? Here please correct me if I'm wrong with authentic sources. If there are legal issues faced by Non Muslims then they are suppose to fight in WAKF tribunal which is run by Sharia Kaanoon can they ever get Justice? I don't know, if true please enlighten me with the verdicts so given. So WAKF tribunal is an authority, hence in future if a person gets a verdict from it in favour of him/her & can challenge the opposing verdict given in the same case given by Supreme Court of India, till date it has not been done, but what is the guarantee that it is not done in future? Think. Keeping all these powers in hand, WAKF board is asking the petitioners of Mathura & Kaashi Temple that they should not fight it in Civil court but in Sharia Court A.K.A WAKF board. This is the outcome of the powers so given to the WAKF board. It also has provision of public servant in section 101. All these information so put here are according to the best of knowledge sources, anybody is free to correct me with authentic sources. Thanks....
