Always get a Phase I for commercial property transactions. You cannot rely on a previous Phase I unless the EP and the former reliant party grant reliance in writing. Also, they are only good for 180 days so you need to make sure it is in that time-frame when you close. I cannot count how many times I have seen a client have a previous Phase Is that missed things like underground storage tanks or a historic dry-cleaning facility near by. Make sure you are hiring a reputable EP and not a report mill that is going to tell you what you want to hear.
