There are other grounds for punitive damages other than malice: the one applicable here is gross indifference. He threw the 3rd goldfish after eating the first two, AND seeing how the plaintiff reacted. The judge failed the plaintiff on this one.

"He took a gerbil and a tube and... It was just a prank. There was no malice." I think Judge Milian would have punished them for their oblivious stupidity. I've had a couple of oblivious douche "friends" like this. They get stupid obnoxious and then ask, "What's the matter?"

Defendant had no business doing what he did. Even though they were goldfish it was still cruel. I felt Judge Wapner should have awarded more to punish the guy for doing something like that. Prank or no, it was inconsiderate and cruel.
