@Nathaniel Aoina I mean this situation would likely never happen in real life, but if it did I doubt that the Sergeant at Arms would forcefully remove the sitting President. You have to remember that it is long-standing DOJ policy that a sitting President can not be charged with or indicted of a crime, so this is basically implying that a sitting President is given legal immunity whilst holding office. It is unlawful for an individual to not withdraw from the House upon the request of the Speaker, but again this wouldn't apply to a sitting President. If this were to happen in real life I would suspect that the Speaker would adjourn the session, and then bring articles of impeachment forward for high crimes and misdemeanors as the President intruded on the business of the House, and infringed on the separation of powers.

This is such a well done scene. The camera coverage is super interesting because it seems to follow those who have power in this scene. Notice how Frank is shot rather heroically with lower angles and sweeping applause that covers up the decries from Republicans and the Speaker, which gets zero coverage at all because she's letting things get out of hand so easily. Notice how one of the Democrats covers her up halfway through when he stands up to applaud Frank. Season 5 was a bit all over the map, but this scene is pure quality.

One thing I just noticed, after watching this scene many times over the years: When Frank stands at the podium and starts speaking, he has to bend forward in order to speak into the microphone - symbolizing that he was standing above things before, but now has to speak "down" on the House. If that's intenden, it's a fascinating little detail.

I like how Birch essentially rallies Democrats but then just sits back and enjoys the show. You can tell he sees through Frank and knows what he’s capable of (I mean, when Birch was Speaker, Frank was whip). He knows he stands to gain with this scene, even though there’s a sense of mutual loathing. This show was everything. When Spacey was removed, it just lost its way.

As minority leader, Birch was Underwood’s “ally” in the House so Underwood needed him for this scene. Birch was happy to go along because he stands to gain if Underwood’s scene in the House leads to Dems winning the majority. If they lose again, Birch still remains minority leader.

By the way, as ICO(basically ISIS) is not a statal entity, congress cannot declare war on them. In order for the congress of the United States to declare war on somebody they must be recognized as a state and their borders acknowledged. This gets really tricky with separatist and islamist forces, because to declare formal war you'd give them what they want: international recognition. Makes this scene even funnier because he's asking the congress to do something they literally cannot do while he's trying to make it seem that not doing something legally impossible is proof of cowardice, malintent and borderline treason.

That didn’t stop Congress from giving Bush 2 broad war powers as part of the War on Terror. Congress could have narrowed the scope to just Afghanistan but they left it broad to cover Al Qaeda and affiliates all over. That’s what allowed Bush to invade Iraq and Obama to take action against ISIS. In this scene, Congress doesn’t need to call out war directly against ICO but merely cede powers to the president to take action (whether detailed by the resolution or left undefined) against them. And because Congress still is the ultimate authority in war, they can pass a resolution that revokes that authorization (in essence, take back the war power).

I don’t think this is accurate; I’m fairly certain Congress has declared war on non-state actors before. But even if that was a rule, since the US government is sovereign and can recognize states unilaterally for all legal purposes, Congress could recognize ISIS (or ICO) as a state and then declare war. But as you say correctly, that would be highly undesirable as it grants recognition.

I’d love to see the actual congress being noisy in general and having loud debates. It’s sad that we don’t see that anymore. I mean, the British parliament sounds more like this in general.

@@matthewgigs3456 That's because the British system doesn't technically have an executive branch like the American system. The Equivalent of the President in the UK is the Queen, She appoints the 'Prime Minister', always a member of Parliament to lead her 'Privy Council' in her absence. The Prime Minister has no executive power of their own, it derives from the monarch. Therefore the Monarch cannot debate in the legislative houses, as she/he holds executive power, but her representative, the Prime Minister can.

The President can only go to Congress during the annual State of the Union Address, an emergency Joint Session of Congress (like Bush after 9/11), OR be invited by Congress. Storming Congress like a monarch would possibly get him impeached and destroy his approval rating. The media would be frothing at the mouth if a President did this. This is fun to watch but there's NO WAY a President would actually do this. It's insane.

A president can't. The whole scene with the secret service wouldn't happen. The Sargent at Arms also has more soldiers he can call. If something like this happened the President would likely be removed from the chamber by military police. It would be embarrassing and technically the President is still the head of state..so he would be the boss again of those same MP's the second they got out of the chamber....lol

@Tyler 324 United States Naval Academy class of 2009....I was in the Navy for 14 years...2005 to 2019. We don't swear an oath to uphold the President....the oath is to uphold the constitution. If the President blatantly violates the constitution the vice President is the commander in chief. I'd rather get cm than commit treason!

i know rite from season 1 to 5 it still feels not as far fetch and is grounded in reality something we can picture happening in secret even the killings are either done by dough or the president himself and in such a way that is acceptable to stop any leakage of info or taking advantage of situation or loophole to come out ahead and even the scheming like all the shady deals and cloak and dagger stuff and even when frank was pressured by outside force it was done in such a way that seems realistic but season 6 is insane the outright execution poisoning of frank purging ex cabinet killing doug in the white house office or having a wealthy family outright and physically disrespecting a seating president by out right power moving her to heel

This is good political drama, but are former members of Congress allowed to be on the House floor of while The Members are debating? I think ex-members can lobby on the floor when the House is not in deliberations, if they don't have any thing to gain by business or upcoming business on the floor. (Of course, I'm not counting opening day of a new Congress, when the first order of business is electing a new Speaker. ) I'm not familiar with Parliamentary Procedure, but I would think that if a former member of Congress was on the floor wanted to be a participant in a debate, there might be a either vote on the floor of the House to permit a former member to debate or that a member (or former member) quote a rule of the House on floor rights to ex-members. Otherwise, it might be possible for several hundred ex-members to sit on the floor during deliberations. They might not have voting rights.
