Thank you once again! I just was deposed and spoke my mind did get snagged on her repeated pretext and had difficulty backing down but whats done is done. It was exhausting then I pre paid to depose Def HR director. She again lied lied and its fine because I have transcripts that show the retaliation etc.

Dear Lucinda, I watched this video again and have a question. The defendent did not disclose a document during that period. This document is a copy of a couple of text messages I previously sent to the defendant long time ago. They disclosed this document two weeks after the discovery ended. In their MSJ they referenced this document in one of their asserted facts. I objected that and explained that per the Judge order xyz, all supporting documents ans references must be disclosed by the end of the discovery and since the disclosure of this document occued two weeks after discovery ended, it cant be used as an evidence. I attached the email they used to discolsed this document as the evidence. Is there any issues with that objection. Also, what is impeachment? If you mean, the sets of questions the defendent will ask during the hearing, can they use that document during the impeachment. Also can I ask the judge to remove that document from the list of evidence? Thanks,

Dear Lucinda, I hope this message finds you well. My case is currently in the pre-discovery phase at EEOC. The Administrative Judge's acknowledgment order stipulates that discovery can only begin with her permission after the Initial Conference (IC). It has been over two months since the acknowledgment order, and the IC is pending. Is it appropriate to request clarification on the IC and discovery status without violating the ex parte rule? Additionally, we engaged in mediation on September 27th, following another order, but no agreement was reached. I appreciate your guidance on the way forward. Thank you

Hi. Be sure to cc opposing counsel with any communication you might have with the judge. Have you considered contacting opposing counsel to see what their understanding is on the status of the case? This could simply things...maybe you and opposing counsel could approach the court together.
