Israelito Torreon, KOJC Legal Counsel I am posting here my reply to my good friend and kababayan who is highly-intelligent and smart in order also to answer the oft-repeated “unsolicited” suggestion that Pastor ACQ should surrender. “my good friend, since you are not a lawyer, i hope you will not be offended if I tell you as a lawyer that the Accused has the right to question the finding of probable cause against him especially in this case where the cases were already dismissed previously by the Davao City Prosecution’s Office. He also has the right to question the validity of the Information and the warrant of arrest especially if there is violation of his right to speedy disposition of cases and if his motion to quash is denied, he can file a petition for certiorari before the Court of Appeals and thereafter to the Supreme Court. So his option is not only to surrender my friend. It is also within his right to insist on his innocence without facing the rigors of trial. Why will you require him to go to trial when he honestly believes that the case need not go to trial knowing that he is really innocent in the first place. That was done before by former Senator Panfilo Lacson when a Double Murder case was filed in year 2000 against him in the RTC Manila and warrants of arrest were issued against him. he went into hiding and only surfaced when the Court of Appeals nullified the warrants of arrest on February 3, 2011 (please read Dacer versus Lacson, June 8, 2011 SC Decision, 3rd division). Other personalities also did this in the past such as Satur Ocampo, Gregorio Honasan, Liza Mapa and others. The option therefore being exercised by Pastor ACQ is within our rule of law, hence, you cannot tell him what to do in this case because his choice is perfectly legal. Further, in Pastor Apollo Quiboloy’s case there is also a threat to his life and there is also a clear danger of being extraordinarily rendered to the US because his detractors likewise filed trumped up charges against him there. He previously requested the Philippine Government that it issue a written declaration that he will not be extraordinarily rendered to the US and that US should not interfere in the proceedings in the Philippines yet this was never done. Instead, SMNI was closed, the assets of SMNI, KOJC, Children’s Joy Foundation were all freezed even if the evidences did not link him to the ownership of these properties. Hence, I respect your view my good friend but it would be best if you also look at the situation on the other side of the prism. Now I will ask you, can you please pinpoint to me where in the Rules of Criminal Procedure allowing the police to enter the property not even registered in the name of Pastor ACQ on the ground merely on “suspicion” and after the said warrant had been served previously for more than seven times already and worse, stay there for more than one day (as of today) then prevent their own members from entering the property?
