I have a personal experience for intoxication while carrying. I went to a restaraunt to get something to eat and drink(no 51% requirement), since I was going to drink I left my gun in the glove box. When I left I was very tired and tipsy, I fell asleep at a traffic light and was awakened by a police officer. He found me to be intoxicated and he knew I was LTC. When he searched my car he found my gun in the glove box. He stated that even though I did the responsible thing, it was still unlawful. So I was hit with an unlawful carry charge that was dismissed by the judge. I do agree though, if you are drinking don't carry a gun. First of all, your judgement is altered and so will your aim when firing the weapon.

The sad thing is the “gun grabbers” in Texas happen to be the senior republican leaders in the Texas senate. They try to kill most pro gun bills.

All the prohibited persons apply to LTC holders as well just because you have a LTC doesn't mean you can be a prohibited person and carry like this portrays. Go to texas dps wesite and read the law yourself don't rely on what others say. Ptint out the applicable laws and print them out if you haven't got a printer go to office depot or kwic copy etc and have it printed out.

Yes. A non resident permit that Texas recognizes actual has more protection and rights than constitutional carry. A non resident permit has ALL of the protections that the Texas license has except for school zones and you don’t bypass the background check when buying guns. You have trespass protection and all of the other stuff though.

Walmart has a subchapter h chapter 411 sign. Does this apply to constitutional/permitless carry? I don't plan to open carry in Walmart, but I want to know what that means.

There are 2 signs that deal with subchapter h. The one you see is probably a 30.07 prohibiting open carry...So, when it comes to "permitless carry" you don't have trespass protection like you do with a license. Carrying past any sign that hints at prohibiting carry could be bad for you.

I am now much more confused I just completed my LTC and it’s was written that you can’t carry while intoxicated period and that any amount even under .08 could then be considered intoxicated by the “their” definition of intoxicated

It's not surprising to me because about 97% of LTC classes across Texas teach outdated laws because most instructors don't keep up with law changes. I am involved with almost every laws in the Texas legislature that deals with firearms. Any info you get from me or from my class is 100% correct.

2024 you can now “Texas Residents “ constitutional carry in most states that have constitutional carry without a permit.

Be carful. There are several states that "reserve" their "constitutional carry" to residents of their state only and require non residents to have a license to carry they have reciprocity with.

@@PointBlankCHL actually all but one allow non resdients to permitless carry but states like south carolina require you to meet the eligibilty to get a poemrit if you were a resident to carry wihtout it so no violent misdeamnors or duis however in states like ky any us citizen who canlegally own and 21 or older can conceal carry 18 or older to open carry under 21 that are military can carry jus tlike 21 and older as well

So, an open carrying drunken permit holder can walk to the door of a school to pick their kid up, as long as they have a ride - but CANNOT leave the gun with the driver unless the driver has a permit. Sometimes the attorneys who write the laws don't actually have safety in mind, but control and anti-2A restrictions as their goals.
