Someone stole my SS# back in February 2012 and used it to file an online tax return. In TEXAS! I’m thinking it was an illegal. The woman at the IRS told me that she couldn’t tell me where the return was filed, where the person filed the return, and said it was for THEIR safety! I looked at her like “WHAT?!?” She said, “I have to get some forms for you to fill out, so don’t look at my screen because the name and address of the person who filed the tax return is pulled up,” and then she winked at me. She left the room, and I looked at the screen! The address was 1234 Happy Drive, Houston, TX!! Yep, sounds like a real address to me! This was back when you didn’t need to verify your identity to file an online return, and when online filing was relatively new. It took me 7 months to get my refund. But after that, the IRS sends me a PIN number every year in January, and even if someone tries to use my SS# to file an online return, if they don’t have my PIN number, it won’t go through. I don’t know why they didn’t do that from the beginning of online filing! A lot of people had their SS#s stolen and used to file in-line returns!!

@@Paul77ozee Sure, tons. Here's one: I had a very good customer that was very bad with his finances. He was a retired gang member with a million tattoos. He started coming in with messages he said was from a girl that he was interested in, but I recognized it as an obvious scam (Typical honey pot style lover scam). The person kept getting him to send small amounts of money to them, even after telling him many times NOT to, and that it wasn't real (It is common for people to not believe you when they are in too deep). Eventually, He came in to let me know the person had sent him a large sum of money, and wanted him to make out a Cashiers Check and send it to them to pay for a car because they didn't have an account. I let him know this was definitely stolen money, and if he sent it it would eventually return and he would be on the hook to pay it back (It was almost $30,000). After an hour of talking to him, he agreed not to send the check, and just left the money in his account. 3 months later, He came in saying the money never returned, and asked me if he could keep it. I told him I didn't recommend that (The money came in via wire transfer.) A few months later he drove up in the new truck he bought, So I just face palmed and went about my business. I moved to a different branch shortly after and never found out anything about it. I think he is still driving the truck though lol.

It your rent is due in a couple days, you need groceries, you need to go to the dr, or get a prescription, your child needs money for school..oh well you aren't going to have that money when you need it. Yeah the banks say 1-2 weeks, it's usually shorter. Still it's not something you should have to plan for just because it's very hard to actually catch the person doing it and even when caught it's treated as a very low level offense.

@lynnhen, I completely understand your frustration with the justice system however in a remarkable irony, it's both cheaper and lucrative to place a non violent defendant on Probation for the following reasons: 1)Incarceration is very EXPENSIVE once you factor in Housing, Medical, Food and Supervision/Staff of the inmate. 2) Probation frees up the all ready OVERCROWDED and UNDERSTAFFED prisons and reduces the back log in the prison. 3)The Government/City/County makes tons of $$$$$$$ from Probation as the Defendant has to pay monthly Probation fees. In this case it's easily $300 ×12 months which is $3600. 4) Additionally, once a defendant is placed on Probation he or she relinquishes her constitutional rights meaning she is subject to Searches 24/7 including drug and alcohol tests which keeps the community safe. 5) Let's say she violates her Probation, she will get to do jail time for the Fraud Charge in addition to the new charge. Trust me, the House always Wins. The best cause of action in this scenario is the Victim needs to sue her in civil courts for monetary damages and garnish her future earnings and wages.

Someone obtained a title loan against my vehicle claiming my original title was lost and got a duplicate to receive loan funds. They didn’t pay on the loan and caused my car to get repossessed. This happened at the end of November of last year woke up walked outside to get ready to go to work and my car was gone thought it was stolen. I’m still fighting the loan company they are holding me responsible for it and have tried to repo my car on two more occasions I have to keep my car locked in my backyard behind a locked gate. I have zero sympathy for identity thieves.

1) They only asked her identity, they didn't ask anything about what she was doing. They're allowed to continue working to identify her after she says she wants a lawyer. 2) they don't have to tell you what the arrest is about until the arraignment. 3) if they had waited to read her the Miranda warning, you'd be complaining they questioned her without her knowing her rights.

My husband received a summons for court one day for cocaine possession. He thought it was a joke. Turns out someone was using his identity and was charged with possession after purchasing a 40k truck with my husband's identity. He obviously never paid for the truck and put a dummy plate on it. They've never caught the guy. Thankfully the cops believed my husband and watched the dash cam footage back, the guy looked like my husband but obviously wasn't him. 8 years later my husband's credit score is still recovering and they've never caught the guy to our knowledge. I've never seen him so stressed as he was when he was trying to prove his innocence and try to set this right with his credit score. One major bank won't deal with us because the truck was purchased with a loan from them, and it's difficult to prove it wasn't my husband. People like this woman don't care about anyone else and any consequences, ruining people's lives.

Someone using my identity got me in massive trouble with the IRS. This was years ago, but a person used my return label with my address and information on their tax forms. The IRS told me I was hiding my actual income so I wouldn't have to pay the appropriate taxes. They came after me and told me I owed tens of thousands of dollars in back taxes. It was a nightmare for the longest time. They ended up auditing me and found out what happened and who they really needed to go after.

The moment she said, "I need to talk to an attorney," the interaction should have instantly ended. If they were going to arrest her, it had to be at that moment. Everything that happened after that is AT BEST on very shaky legal grounds. It could very easily be construed that her fundamental rights were violated the moment he asked her "What's your social?" There is NO WAY that any court was going to rule that she wasn't detained after having Miranda read to her. NO reasonable person would think they were free to go. And, of course, if she said, "I'm not under arrest or being detained???.. Ok, bye," and turned to walk away, she would NOT have been allowed to leave. 100% for sure. That being said, she is clearly guilty. She went into a bank, tried to withdraw a bunch of money, got delayed by a bank employee so they could get the cops there, she saw the cops come in, went to the bathroom thinking it would break their attention/focus on her, and then tried to leave without getting her transaction finished. "Why are you leaving without getting your money?" would be an interesting question, rather than all of the runaround about who she is. Obviously guilty.

Came here to say the same thing, however I believe they’re allowed to question in the pursuit of establishing identity - which was essentially the entire course of the conversation. Still, you could tell the one cop knew it was time to stop, and kinda looked around for reassurance from the other cops - that’s a little sketchy, but perhaps he wasn’t sure about stipulations regarding establishing identity. Worst case they throw out everything she says - in some cases that’s enough to remove initial probable cause and thus anything determined or discovered afterwards, in this case the crime was already established and documented so there’s nothing to prevent that evidence from being admissible. This is also why most cops don’t mirandize that quickly, there are a lot of questions that need answering, even if you can’t use them in court, you now know a lot more about the situation.

@@EstorilEm She can 100% still be convicted, even if everything she said during this video is thrown out. Denying her rights doesn't actually mean she can't be convicted. It would simply mean that nothing that she said during the video after invoking her rights could be used as evidence against her. That doesn't mean other things can't be used. But she still could sue them for violating her civil rights. Nothing prevents both things from happening... a conviction AND a successful lawsuit could both occur. In Florida, there IS a "stop and ID" statute, but it only pertains to "loitering and prowling." She was doing neither. That means that even if she is being detained under reasonable, articulable suspicion of a crime, she does NOT have to identify herself. That eliminates any argument about the need to identify her. Plus, even if the statute was broader, in this case, specifically giving her real identity would be part and parcel of incriminating herself, and there is an exception to ID mandates if the person can establish that doing so would itself incriminate him/her. The cops play fast and loose with people's rights constantly, all over the country, and that is a huge problem. Too many courts have allowed the police to more and more get away with an ever increasing amount of unconstitutional bullshit. Again, I am not saying that this woman isn't guilty. She clearly is. But they have to go about investigating, arresting, trying, and convicting people the right way... NOT what is easiest/fastest for them.

I think the state was Michigan. When the guy said "I asked for my lawyer so you can't ask me anymore questions" they told him they weren't asking any more questions, just talking to him. He ended up either being convicted or pleading, don't recall. So in that case the additional conversation with the guy didn't impede him being in prison. In this situation it was 1:30 in the morning so no attorney may have been available. Thanks again.

Investigate your family. Someone KNEW he was passing and had that money. You need to dig deep. Don't tell any family members or friends about what you doing or you will fail. And your investigations will be compromised. Loose lips sink ships. Probably one of your fathers siblings or thier children. Don't accuse. Ask the right questions in the Investigation. Good luck.

She is inexperienced and had no idea how to BS her way through it because she's not a professional scammer. Note that after they got the phone away from her she gave her real name in a low voice, as if she was afraid she'd be overheard. She got off with light charges probably because she gave the police information about the person who is behind the identity theft. If this is really what happened, I hope she has learned to not participate in criminal behavior because she's no good at it. If I'm wrong and she's a full partner in the fraud, I hope she realizes she has a record now and is no good at it and will be caught if she tries it again.

She’s a runner for an organized crime ring. She probably gets $100 and she was probably on the phone with the gang boss who was probably near by to collect the cash. Our business account was compromised and there was women showing up in different locations trying to cash checks and a police investigation was trying to track down the gang leaders for months. The real gangsters never show up anywhere. They recruited her somewhere online and she was probably reporting to the boss while the cops were talking. Yeah, you heard them say that the phone was live on a call the whole time and they just found out when they finally grabbed her phone. There’s thousands of runners out there. This person’s account is still going to get hacked. The gang probably gave her the ID as well. They’re probably supplying her with drugs or something.

That used to be a great way to get their identity, and a whole lot faster than going down to the jail, using the livescan, waiting for the prints to come back. Nowadays there’s a portable fingerprint reader. Returns it instantly.

She didn't take an "Uber" to the bank as she said. The way this crime operates is that the criminal who is running the scam finds a person to go into the bank, creates all the fake docs, takes them to the bank and waits in the car. As soon as they saw the police car, they drove off and left their pawn to take the fall. She will not know who they really were or how to find them, they already destroyed the burner phone and will be trying to find someone else.

Undercharged. Should have been charged with bank fraud (attempted). Spoiler alert: There was never any Uber coming. Boyfriend on the phone was going to pick her up when she gave him the all clear signal. Note the wrist brace, cleverly donned in case her signature doesn't match the one on the victim's account. She intended to claim injury results in a non-matching signature. We'll call this one "Crafty Christina."

Good. Throw the book at her. I'm an elderly disabled lady living on a small, fixed income. Since I'm disabled, I've had to rely on ordering many things online. One supplier that I purchased from (based in the UK) an employee took my ID and card info, and booked a weekend in Paris, including airfare. Wiped me out, left only about a hundred dollars in my account--they took a vacation that I'd never have been able to afford for myself. I have no pity for people like this woman. I know this won't punish the people who stole from me, but I always feel gratified when thieves get caught.

I have a pre-pay cell phone and used my card to buy airtime. Last month someone used my card to buy airtime for their phone. It's happened to other customers too according to BBB. There's a scam a minute these days.

60 days is a long time for theft, honestly. I’ve seen people do less than 10 for unaliving someone. Yes, what she did was abhorrent and absolutely should be punished, but she now has several felonies chasing her, and she’s young. Give her time and she’ll be in a state pen for an extended stay.

You need a fine proportionate to your income and assets. If you only have $10, the state takes $5. But if you have a car, a house and all the rest of it, the state takes 50% of the value. You want the deterrent to be meaningful.

I've had my identity stolen they got a got credit card an apt a phone which they ran up a bill of $1400.( which required a credit check) and frequently checked my credit score which LOWERS your overall credit score I was on chemo @ the time so I wasn't even aware I didn't have 1 of those credit keeping score things on phone I only learned of theft after applying for a credit card believe it or not because the their HAD ALL my info the cell/ credit card tried to make me pay even though bills were going to a different address handwriting on apps. We're different I filed multiple police reports come to find out out it was a b.f I had for a short period of time ( they pulled tape from cell phone store) it took me putting fraud alerts on everything I pay attention to EVERYTHING now it suxs

I had my credit card number stolen by a Walmart employee. Those geniuses went on a 3k shopping spree and had the items mailed to their actual home. Police laughed so hard. Karma baby

I've had my card data stolen. Visa said I was in NY, and charged my credit card for parking, a meal, and parking again. I wasn't in NY, but they claimed the data from the mag stripe was read by the Point of Sale equipment. I had to contact their fraud dept, and submit a sworn affidavit that I didn't make those charges. I mentioned the issue to a colleague in TX; he checked his statement, and found a huge charge for electronics in another state. I asked a colleague in CA, and she said her debit card was drained. Turns out a worker at a card processing center sold the data collected from the network in CA to thieves who made copies of the cards for their gang. The 3 of us were in CA to work on various projects, and our card data got processed by the same center. I used my MasterCard until I got a replacement card from Visa, and had to update all my autopay accounts.

@@oahuhawaii2141Get a bank that has an app, and you can set it up to receive a text, everytime a transaction is made, weather it's big or small. I have this setting on my debit card and all of my credit cards. Nothing gets by me anymore. I was a victim as well, my bank account was drained in 2018, the week before Christmas, and I wasn't able to get my kids anything for Christmas. Hopefully this will help everyone for now on.

I'm sure her lawyer used a *5th amendment rights violation to render any of her statements inadmissible in court. As soon as she asked for an attorney, the cops should've stopped questioning her. Highly illegal to continue doing so. Edit: @supriseimblack pointed out that it is actually the 5th Amendment, not the 4th, that gives protection against self-incrimination.
$4K is a lot of money... she should have to do $4K in work for the city as punishment.

When you get booked into jail once formally charged, there is a bill that begins to accumulate. The jail charges you for your stay, meals and medications. Probation costs over $1,000 in most cases and the court will charge you around $150 for the arraignment and sentencing hearing. That lady should have to reimburse the stolen funds, no mention of a grand total just it was the 3rd attempt to steal funds and the real identity spoke with the bank. Honestly with all the precautions out there, if someone steals from a big bank, the account holder shouldn't be a victim of the loss. When we put money into the bank there is an unspoken agreement that they won't give it to conmen/women! I'm sure TD bank can afford to reimburse $10,000 or whatever. TD bank is one of the worst big banks for alot of reasons.
