Leaving the place of employment only protects them from being forcibly removed. It does not protect them from civil lawsuits or charges for their actions.

I got pulled over years ago for doing 50 in a 50 zone, But the cop assumed I wasn't going to slow down to 35mph that was still 50yrds away. Remove qualified immunity and you'll see cops straighten up real quick.

Me too. I ended up sitting next to the speed limit sign when I pulled over. After an argument and threat to call reinforcement she finally dropped it as I took a picture of the speed limit sign saying you are going to waste a judges time because I'll be challenging this.

except for the part with taking inventory, that would take time and effort. They would send the bulldozer to her house, the neighbor would get bulldozed and when pointing out the mistake, yet an other house would get bulldozed because "this warent is for the house down the street" is ambigouse.

I understand and truly appreciate your answer. I have an invisible hippopotamus who tends to over imbibe from time to time and gets extremely drunk. I don’t let him drive he just stays home, but I can see them purple walking him in an orange suit to their car to take him away. 4 state have eliminated qualified immunity. Colorado., Montana, Nevada, and New Mexico. Have eliminated qualified immunity for state constitutional lawsuits against police officers. Every state should do the same .

The chief did understand and know the law. Anyone with training or not knows drinking in your own home isn't illegal. Nor is a dirty house. They just didn't care. A symptom of lack of accountability.

Well there was an accident on her property though so they would have said she was uncooperative then or any other excuse to harass her they are predators was her landscaping ruined too by the car because they have some knee jerk reaction to victim blame people too. In the UK we have a national barred list for constables for naughty cops. Individuals can be placed on it for a specific period of time or permanently. I know our political systems are different, but I'm sure such a system would not be beyond the wit of imagination.

We do have a "Brady List" where officers are put on it by prosecutors. Those officers are not allowed to testify in court cases. This is a death sentence since any case they are involved in is tainted. The problem is this list is local and only shared with local prosecutors. Similar to my case ,I was arrested for the intent to DUI I was at home doing yard work and barbecue going when sheriff's show up looking for some four wheelers and a loud truck I had a truck but not what they were looking for, I was searched and arrested for having my keys in my pocket and they tried to charge me with intent to drive after I had been drinking 😢 I was let go one week later and charges were dismissed, I should have filed a law suit and showed them they can't make assumptions a crime...

I've been a plumber for over 30 years so , I've been inside many homes for service calls. I found many homes in which unkempt would have been an understatement. It was not any of my business to judge how a person lived so , I learned to accept it long ago. This story is a perfect example of why I don't let cops in my house or answer their questions. They will take photos and make fun of you, even on the internet.

@@lwilton That's the problem, they'll put out the call that you've barricaded yourself inside and are considered armed and dangerous. Every hick police department has a SWAT team and are just itching to use it. They have to in order to justify their budget. Plenty of small departments use the SWAT team to serve traffic and other petty warrants.

Here's a good one for you, Steve. Back in the 70s, I was drinking at a bar, The Mad Hatter, in Underground Atlanta, when ready to go home, I ask the bartender to call a taxi for me, which he did. As I was being driven home, a cop pulled the taxi over for a tail light infraction. The cop smells alcohol on me, asks if I've been drinking, to which I replied, I hope so. The cop arrests me for, I kid you not, "Being drunk in a vehicle." In court the next morning when questioned by the judge, as to why I was drinking and driving, I explained that I wasn't, I was a passenger in a taxi. The judge's reaction was priceless, he raised one eyebrow, and said "Excuse me?" After reading the detailed report, the judge instructed a bailiff to have the officer report to his chambers, turned me loose with an apology, and instructed that my employer be called and told exactly why I was late for work.

Omg , About 10 years ago I got pulled over for doing 25 in a 35 And no matter how I try, I just could not explain that 35 was the upper limit not the mandatory speed and I was promptly arrested for arguing with him. the next morning in court the judge had the exact same reaction as your judge did 😂🤣😂 For me, they waived the fees for towing, and Impounding on my truck. The following week I saw that officer driving a paddy wagon, and just snickered.

See, my theory is that there have always been jerk cops because out of 100 plumbers, you are going to find one or two jerks! There will always be some. However NOW A DAYS my theory is that if you are a jerk cop, it's rewarded and backed up by the courts. We have here two examples where the court caught the cop and did the right thing, but I have heard about countless examples where the courts back up the corrupt cops. I blame Carl Marx. Straight up. It's happening all over the world. Not just the United States. It's tyranny. Plain and simple.

This is a prime example of the difference between an intelligent person and an educated person . This police chief has a masters degree and was at the FBI academy . This seems to be the kind of police state our country is turning into. I had a very similar experience. After taking my girl out to dinner, she wanted to stop for a few drinks. I was driving, so only had sodas all evening, while she got quite intoxicated.and started a fight. I left her at the bar and went to a nearby hotel for the night since I didn't want to put up with her any more. Once settled in for the night, I had a few drinks to calm the nerves and relax do I could sleep. A couple hours after I had checked in, I get woken up by the usual cop knock at the door. Cops were there to "investigate" a disturbance at the bar by my girl. Apparently, they found my car in the lot, so knew I was there. After asking a bunch of questions, they took me to the parking lot, gave me the roadside tests, and arrested me, and impounded my car. Cost me hundreds to get my car back after several weeks of storage because cop claimed he needed it "for his investigation." Not to mention the high cost for an uber to work and back during that time. This was dedpite the fact they had video from the bar of me NOT drinking all night, but their claim I "might" have been drinking before I arrived at the hotel. It cost me roughly $14k to finally beat it in court. But this shows nobody is safe from police misconduct even behind closed doors.

There was a DWI case a number of years ago, that basically got swept under the rug as the saying goes. Officer had arrested some guy who was dating his daughter, and used the excuse for DWI, getting behind the wheel, with an open container. Hell, when I heard this, I knew not only will this guys life be over, the dad doing the arrest found an iron clad way, to stop his daughter dating. That was until I found out the wheel he was behind, was an arcade driving system, and the arcade/restaurant sold food and alcohol, so the open container had no chance as well. I believe this took place in Arkansas?

Resignations mean she walks away from her police job avoiding the repercussions of her actions, is free to work anywhere else, and still receives a life pension from the city. I was present for one of these. It was a family member who didn't live there, a daughter-in-law IIRC, who called police and EMS on a guy who was only marginally inebriated in his own house. My partner and I were the EMS who showed up. After understanding what was going on - seemingly an over-controlling daughter or daughter-in-law, I took my partner aside and told her that "being drunk in your own home isn't something to be arrested for, nor be drug to a hospital for." My partner agreed, so I told the police that we weren't going to do anything to the "patient." The police decided that they weren't going to do anything with the "suspect," either, and instructed the woman who called us all to leave this man's house.

They gave this lady a breathalyzer that found she was only slightly above the legal limit to drive. While there may very well be times when police should intervene in a situation, they went out of their way to collect evidence that should have told them not to.

Running the plates sounds like work. He's an important official who doesn't have time for that. I suspect it wasn't even an assumption. He really is working a drunk driving case, and she really is drunk and part of the case. Add in a stupid lazy cop, and he just arrests the drunk person associated with the drunk driving accident without ever considering what her role might or might not have been.

The core reason for this ludicrous situation is quotas. The police in the States have been incentivized to meet quotas for arrests. This means in areas where 'business' is slow, you have officers phishing for anything they can turn into an arrest. Even if the case is later thrown out, that officer will have been rewarded for his bad arrest. This is also why officers take it personally when the public refuses to provide identification which would be used to seek further reasons to escalate trivial situations. What we see without recognizing it is the absurd consequences of 'zero tolerance' policing. This is what happens when you have numbers dictating policy. You have something similar in sports where meaningless statistics are used to measure the contribution of a player in a game. Its the same here. You have police departments, divisions, and states competing for funding based on this idiotic misuse of statistics with no one knowledging the underlying cause. What you have here are officers pressured into making bad decisions. Instead of acting for the public good, they act to further their careers or meet their quotas. Someone ought to look again at those numbers to see if there is the necessary counterbalances are in place to quantify the growing volumes of wrongful arrests, eg the unquantifiable costs of bad policing. Otherwise, you create a cynical oppressive regime geared to producing offenders for an autocracy of fines and senseless incarcerations. Automated organ of the state : 'feedme'
