People are not going to wait to see what it is if it clearly looks like he is reaching for a gun. Dude, it's a clear gun. When I was a kid, like 6-11 I would be running around the neighborhood with a realistic toy rifle. Realistic as heck And that's why I liked it.. No orange tip. Looking back, I'm surprised no one ever freaked out. But we were kids. Columbine hadn't happened yet. And toy rifles were sold at toy stores.

I played airsoft on a playground with my friends years ago, our guns didn't have orange tips or anything, and when the cops showed up they weren't remotely concerned, just took our guns and told us not to do it again. Parents picked up the guns from the police station later. Looking back now we were complete idiots. I'm glad nothing happened and we lived in a small enough town that they knew we probably weren't a real threat. It could have gone a lot worse with a different set of cops.

Is it against the law to open carry in this state, and/or is it posted that no firearms are permitted on the mall property? If not, this kid had his rights violated. In states permitting open carry. (as long as it isn't posted on the property that firearms aren't allowed) This kid did nothing wrong and was within his right to carry a firearm (real or not) while under adult supervision.

It’s sad that we live in times where a kid having a toy leads an adult to call the police on them. And even sadder that once police arrive and see it’s a completely unrealistic clear plastic one, they still treat an 11 year old kid like a criminal. I agree the mom didn’t think it through (she really shouldn’t have to), but the kid is 11 years old. Yes he looked closer to 14-15, but he’s 11 and is not able to comprehend the world we live in and likely has no awareness of the larger world we live in or of past events that have occurred outside of his own little life of home and school. Police speaking to him like he should have know better and acting like he is a criminal, is absolutely ridiculous and shows a good example of the problems within our criminal justice system.

Yeah it's almost like adult irresponsibility and the subsequent murders of hundreds of children has made it so that adults can't even trust other children. This is the America people voted for. He should have known better. That's what they told Tamir Rice. Only difference there was that Tamir was out in his subdivision and he was black, and the police killed him. A 6yo boy shot his teacher at school after bringing it to school for the second time last month. That little boy isn't special and no one's getting close enough to find out the hard way that the gun isn't actually real. No, it's not fair and he can't conceptualize that level of violence. But he should know better because that's the only America he's ever known. His mother and father are idiots for letting him leave the house like that. Because you can guarantee if the cops shot this kid they'd tell his parents they should have known better.

He 11, he should know the danger of holding a fake gun. Most of the kid at his age get shot by police for holding a real gun and pointing it at them. And there are incidents where two kid around his age, holding a rifle and an handgun, start shooting at the police officer. He isn’t 5.
