They still can suggest the max sentence which is probably pretty close, if not equal to what it would be for attempted murder anyway. You can’t charge someone twice bc that would violate double jeopardy. So if u charge him with attempted murder, and he beats that case bc u couldn’t prove that he had intent to kill (he could argue he just wanted to ‘scare’ the cops- then it’s your word vs his), then this guy walks free. You can’t then go back after that and say “ok now we’re going to try u for assault with a deadly weapon and see if that sticks since attempted murder didn’t stick.” He’s already been tried. So whatever he’s charged with, u gotta make damn sure it’s something u can prove in court or else the guy could walk free.

Read other comments. 1st degree assault can carry the same penalties as attempted murder, but prosecutors don't have to prove intent with the assault charge. It's easier to get a conviction.
