passenger should not have been arrested, the person driving is responsible for the speed of and control of the car. I learned this when i was arrested as a passenger, because my friend ran. I was also charged with fleeing, but i was only the passenger. I won my case and was awarded 10k for damages and false arrest in my civil lawsuit. Cops can not charge the passenger for the actions of the driver. She can and should sue for unlawful arrests being the passenger.

She assumed she had enough of a head start and kept up enough speed for long enough that they would just give up pursuit. She should have gotten off the road at the first opportunity when she wasn't visible. She didn't expect them to do 130mph for four minutes to catch up to her. And she stopped when she saw them because she knew the game was up. That is the smart thing to do, instead of making things worse. She had a chance to get away, she failed, and she recognized it immediately and gave up. I wish more criminals would be that smart. Although that would deprive us of much entertainment.

Don't fire him if it's the first time but make it very plain that THAT abuse doesn't fly and if it happens again they should fired on the spot. Cops wield a lot of power and it takes a very special individual to know how to use it properly and when NOT to use it. It's NOT a job for everyone. Depends on the prosecutor to stick her with the charges and then either she takes a plea deal or let’s a judge or a jury decide. Or if they decided to interrogate her and she was smart, she would say that she told her to stop and then she would be walking out of there. It’s not rocket science to know your laws

As far as detaining the passenger. By blowing through the checkpoint and fleeing at high speed the police have to assume that they may be fleeing a crime ( not mommy and daddy's curfew!) The police will exam the car, heck, there might be a body in th trunk! They will also if check " on the look outs" matching that car or the driver and passenger. That's why they can't just let the passenger walk.

Always wondered, Yeah I know passenger has to be handcuffed and possible go to the jail after a high speed chase. But, What type of Charges would be placed on the Passenger. I would assume No charges would be placed on the Passenger and would be released from the Jail after investigation was done. But being the Passenger and all. I mean what could they actually do, Jump Out? Tell the Driver to Stop(but wont stop)? Pull the steering wheel and make driver crash(but, that would risk your life and drivers life and anyone else that happened to be around)
