Grounds of disqualification art 102 and art 191 1. Unsound mind 2. Insolvent (Example Vijay malya) 3. Antidefection 4. Not citizen of india These are made by parliament 5. If he hold office of profit except for post of president, governor and vice president 6. If any MLA and MLC or MP got convicted for any offense in which punishment is more than 2 years or more (LILY THOMAS CASE) shall be disqualified from immediate effect. 7. Speaker can disqualify MLA or MP if he remains absent from meetings more than 60 days. 8. Hatred and violence 9. Untouchability 10. Crime against women 11. Banned item import or export including narcotics 12. Involving in terror activities 13. Booth capturing. 14. Illicit practices related elections. 15. Not giving full data of expenses made by candidate during election but in this party can make unlimited expenses. 16. If holding more than 25% equity in any government company. 17. Involving in corrupt practices 1. Governor and President shall have to work on aid and advice of election commission. 2. In antidefection case MLA, speaker of legislative assembly takes decision or same for MLC decision is taken by speaker of LC In case of MP, lok sabha or vice president takes decisions Remedies 1. Apply in court 2. Other than corruption election commission (324) can reduce penalty or absolve the suspect. Election commission is quai judicial body. Parliament is also quasi judicial body.
