She explains it at 11:30. "You're about to lose, *even though I think you're right*." That's why she allowed plaintiff to get more time - judge thinks plaintiff is right. Long story short, judge is acting in good faith by giving plaintiff an opportunity to get what she needs to seal the deal.

She wants to argue with a professional about what needed to be done. The guy has been doing the pools in the neighborhood for many years and you’re the only complaint. The plaintiff is nuts. The testimony given by the guy and the reason for not installing the chlorinator is reasonable if the debris is not cleaned out of the pool. He also said that it was not even connected when he arrived in the first place, which is on the other pool guy. She should not have gotten a dime back if she cut it off before the job was complete.

I’ve worked with pools, my moms worked with pools, my mom has a pool it’s in amazing shape. There’s no point having chlorine running to the pool if the pool is full of debris and junk. Get the debris out, shock the pool a few times, vacuum, shock it again and then add chlorine. Or the best route, empty the pool, deep clean the pool, add new water, chlorine, go on with your life. It’s not difficult to take care of a pool

If you have a lot of big oak trees in your yard, your pool cover and pool will have a lot of leaves, branches, debris, when you open it in April. I had lots of huge trash barrels that i would fill up with leaves and 2-wheel them across the street to the woods. As far as backwashing, those trashbarrels would be full of that swampy pool water, & 2-wheeled to the woods. I usually dropped about $200 on pool chemicals, acid wash the filter, which included lots of shock and it would take me about 2 days to get the pool water perfect. I would start getting the leaves off the cover in March. When i finally cut down the huge oak trees, i had plenty of firewood for my wood stove and it only took me 12 hours to get my pool clean.

@@katiemilady4232 At 7:20 you can see the cell-phone photo of her pool with a custom pool cover on it. There is a lot of leaves, branches & pollen on top of the cover. All of that needs to be taken off the cover, by the pool owner, then the pool needs to be vacumed and the pool filter needs to be backwashed and all of the dirty water needs to be pumped out to the street or woods. Then its time to have the filter acid-washed and then you put pool chemicals and plenty of shock over a 2 day period and it will be perfect. This guy was charging top dollar on everything. I did everythingmy self for 20 years before i sold my house.

I grew up with a pool, and had to open ours up every spring. we had a backyard full of birches and maples, and it never looked anywhere near that bad. I bet it had been like that for more than a year. With our old sand system, once the thing was cleared out it took at least a week to get the water to clear. There's no point in having a chlorinator on when it is that murky, all you'd do is waste the chlorine pucks. You have to shock it, clear it, backwash it. And at each stage, you have to leave it alone for a day or two to let things work. It takes two weeks on a messy pool- if you want it faster, you can pay to have a company set up a portable industrial filter to blast though it. It costs a fortune.

Her old pool guy mickey moused everything and now it was time to pay the reaper. I had several huge 40 ft oak trees, that dropped a ton of leaves, branches, dead animals, and pollen on top of my pool cover.I would start in March, getting all of that crap off the cover & by april, i started to vacum all of the crap at the bottom of the pool and by May, i would start putting my chemicals/shock in the pool and my filter was always acid-washed before i opened it every season. It took me 3-4 days tops to get the pool water clear. Once i took the trees down, it took me 12-16 hours to get the water clear. These pool guys were charging her top dollar every step of the way. When the water is warmed up with the solar cover, the chemicals work quickly.

2 weeks is about right, ours was improperly closed and was a mess that took that long to clear up. From a swamp to baja blast to Fresca to clear in the shallow, to finally clear all the way. Not fun, but we’ll be sure it’s closed right next time. They didn’t even ask where the peg things are the hook attaches to. We were out of the country when it was closed and only got back a few weeks prior to when you’d open so couldn’t fix or mitigate the problem at that point. Smdh.. but pools are worth it in the end imo. Just need to know who you’re dealing with or know how to do it yourself

Want a HUGE headache? Own a swimming pool! I had a 100K gal clover leaf shape pool when i lived in Ormond Beach, Florida. NEVER again! For the little use they get the expense is horrendous!! And if you think a pool enhances the property value you're WRONG! People in that price range aren't generally stupid and actually AVOID homes with pools because they already KNOW the hassles! The defendant under quoted the estimate to clean up her pool, and then the plaintiff got upset when the costs added up to more. Perhaps the defendants could have stopped earlier and canceled the job when they knew it was going to end up costing much more. The plaintiff can’t get her money back for the work the defendants did.

I seems to me like this lady wanted to open her pool for the summer, her usual pool guy was laid up recovering from hip surgery and she hired this guy and it turned out that her pool needed quite a bit of repairs to prepare it for the summer and she lost patience and sued them. Only she can't prove that its JUST $250 either because she lacks that proof from her other guy. She seems very impatient and impulsive. She wants it NOW and the guy can't give it to her NOW because her pool was nasty and full of debris. Maybe if she kept her pool covered better during the off-season, she wouldn't have to spend so much time and money clearing it out in the summer.

Also the cover doesn't totally prevent debris etc. I am in Australia and last summer after a long drought, a colleague who lives in a more country area, had 5 kangaroos in the pool despite the cover. due to drought they were looking for water.

Ummm judge wasn't arguing that clarifier would fix it the plaintiff was. And if you own a pool and open up your own pool LIKE A NORMAL PERSON you will have knowledge of how it works. She was surprised he hadn't hooked up the CHLORINATOR which you need to get your water where it has to be to keep your pool clean. Two completely different things!! She is actually one of the best about deferring to someone when she doesn't know so I'm not sure what you are talking about.

I totally agree with the judge’s ruling. Pools aren’t that easy to care for, especially once you’ve let it get so bad. The parts to the pool, and filter also have to be kept in good shape because they don’t last forever. This includes the filtration system.

Should not put in chlorinator before cleaning, that is how you clog/damage the chlorinator causing more work. Get things up and going and then let the clean(ish) water run to the chlorinator.

I don't understand the plantiff you kick the defendant out from cleaning your pool and get upset that they didn't connect whatever needed to be connect...you told them to stop working...

She thought she’d win and use that money to pay the other guy who MOST LIKELY was gonna charge way more than $200. When JM gave her time to call him for proof of the charge, she didn’t want to because it would contradict what she was claiming in court

Plaintiff thinks that because she saw the work, she is qualified to judge what was necessary. If so, you clean the pool that you didn't bother to maintain, lol.

The plaintiff needs to understand that it’s the ASSESSMENT that’s hearsay, not the fact that she saw that the chlorinator wasn’t hooked up. Dan the mystery pool guy needs to testify that the defendant installed piping that wouldn’t allow for the chlorinator to work at ALL, therefore proving that the defendant did faulty work and caused her pool to remain cloudy. What the judge is trying to explain is that there’s a big difference between “the defendant didn’t hook up the chlorinator” and “the defendant messed up the piping in such a way that the chlorinator COULDN’T be hooked up. That’s what she meant when she said “You only know that because someone else told you, which is hearsay.”

That lady only heard what she WANTED to hear. Judge coulda sat all day and explained it to her in kindergarten terms with crayons and small words and she still wouldn’t get it. Cause she understood all right...she just didn’t want to HEAR it.

even her eyewitness statement though is hearsay as she could say anything, she needs proof and her saying she saw it is not proof.

The pool had been mickey moused for years & now it came time to pay the reaper. It needed a new filter & super pump and PVC piping & valves. Granted these new pool guys were charging top dollar and her particular pool had all kinds of trees around that dropped leaves, branches, and pollen on top of the pool and there were open gaps around the perimeter of the pool where a lot of the leaves, branches, dead animals were in the pool water. There's a lot of work involved when you have lots of oak trees. Everything has to be taken off the pool cover and the pool needs to be thoroughly vacumed before you start applying chemicals and getting the pool water warmed up with a solar cover so the chemicals work better. No trees and it takes 12 hours tops to open a pool and get the water clear. My oak trees were dying and i cut them down and i had enough firewood for 8 years for my woodstove.

I bet her pool guy said 'no way am I getting involved and no I never said anything that you say I said' and that's why she said she couldn't get a hold of him. She lied from the start, that pool had been abandoned for years, if there were dead animals, the water was toxic...

EnTITLED. "I SAW it your Honour- THAT MAKES IT TRUE!" Hmm. Maybe not, this time, Karen. When she first started talking I thought it was some kind of special municipal pool for the public or special needs- not just a regular domestic back yard version. Like the comment below- she had neglected that pool into a complete mess and needed and wanted a cheap as chips complete pool overhaul.... uh uh.

Her usual pool man probably wasn't available because he didn't want to deal with her for another season. Why do the most obnoxious people always own property?
