I was conducting a 1st Amendment Audit at the United States Post Office in Ravenna, Ohio. Postal employees and Postmaster were extremely rude and tried to escalate. So uneducated on their own Rules & Regulations. Ravenna Police were cordial and didn’t escalate. But ignorantly opened themselves up to a lawsuit for trespassing me from the lobby and denying services.

I am currently working with an attorney to file litigation. As you know, I try and stay as calm and cordial as possible. I have dealt with many real tyrants as you know. I didn’t get bad vibes off of these officers. But make no mistake ordering me under threat of arrest to stay out of a public lobby and denying me public services will earn the city a lawsuit no matter how nice officers were. You could see the gears in that government employees head start moving while you were subtly explaining that need a memorandum of understanding to enforce law on federal property and that this is easier to clear up in civil court. Unfortunately, they didn't start moving fast enough for him to correct his unlawful order and civil rights violation.

It's absolutely mind-boggling that at this point after thousands of videos multiple lawsuits and KZbin just crawling with post office audits. That the US Post office hasn't sent out a flash memo and made every post office sign off that they read and understand the rules regarding photography and public photography in the post offices. When people show up doing so, welcome them, encourage them to keep filming. These audits would be done then. No more. People don't watch them to see auditors get welcomed and encouraged. This isnt rocket science. I also love how people and cops will say " he's trying to bait us" and then they bite the bait as hard as they can and make fools of themselves.

@Robert Ray in the hundreds of post office audit videos I’ve watched, this is the first where anyone has tried to make the distinction between an official retail space and a public lobby. Many have made the “it’s putting payment info at risk” argument, which is ludicrous for so many reasons. By this rationale, photography should be outlawed in all places where one could pull out their credit card. No more family photos at county fairs, I guess. No video at your kid’s birthday party at the restaurant. LIL, like every other auditor, maintains a reasonable distance from the registers, doesn’t film over people’s shoulders, and merely films the larger public space without disruption to individuals and their business. Any disruption or security concern is manufactured by the sensitive and unfriendly staff, whose mental gymnastics to create boundaries where none exist remains a constant. The word “interpretation” got thrown around a lot here, which will save them in court, but my guess is that a clarification of layout and public use will still come of this, should LIL pursue. You owe damages for that dropped mic, by the way. They’re very sensitive to that kind of misuse.

This should scare Americans. That cop is visibly uncomfortable making this decision, yet sides with a postmaster. In this position a cop should always er on the side of precedent that filming in public is ok. What this means is that would "follow orders" and enforce whatever edict a perceived authority instructed him to. This is dangerous.

@@SilentEliminator - Restaurants have created a "public invitation" and the private ownership is invalidated by this. If you are coming for the purpose for which a public accomodation has been created, you cannot be trespassed if you are behaving in an orderly manner.

Postal employee here, there is a really bad lack of training. Supervisors are not trained how to handle situations like this. They should be professional and not engage.

Great audit …..and a good move not to get arrested, since you have enough cases that needs resolutions first. Hopefully another auditor will continue where you left off. For a Postmaster he’s sadly misinformed of the rules , or he thinks he can make it up based on feelings. Total power tripping because he’s rarely challenged , and the local police side with him. @@wbtravis5152 then there is the homeland security memos stating photos and videos can be taken of all fed properties inside and out with similar stipulations as those on the post office rules and regs...why the memo??? Because they lost in fed court to someone who they didn't allow to film(pretty sure they grabbed the camera man's gear as well) so all this behavior has already been ruled on as a violation of our civil rights so everyone's misinterpretation is of postal rules and regs is beyound pointless

I get why SOME people hate cameras. I hate them myself. The difference is how one reacts to them. There's no way I would freak out about being recorded. I have resigned myself to avoiding them when and if possible. If not, oh well.

The entrance is the FOYER. The part that has the glass wall and door is the LOBBY, it even says it on the door, "RETAIL LOBBY"! Guess the police nor the post master can read.

Even though the cop was wrong. I still like that he was willing to look into it before jumping the gun and freaking out like alot of others have done. Most cops will not be honest and say that they don't know so I give him that but It still amazes me how little they know and I'm glad that you don't let em get away with violating your rights

@Robert Ray I think he said it was the first time he had to handle this situation so he was going by his interpretations. While he seems to be a good cop the restriction by signage, security force personnel and authorized personnel are not the postmaster or security guards or supervisors. There is no signage and there is none in any post office as it is allowed by the rules. Also the restriction mentioned can only be applied by a postal inspector or an authorized person that can modify the rules and regulations of the post office. The postmaster is not authorized to modify poster 7 to prevent photography for news purposes. The post master only has control over other photographs.

*except where prohibited by official signs or Security Force personnel or other authorized personnel or a federal court order or rule. Other photographs may be taken only with the permission of the local postmaster or installation head....it's not hard to understand, the Postmaster is "Authorized Personnel" who can restrict photography.

You should make it a point to state, the government does not issue credentials. There is no office to file for a press pass. The 2010 homeland security memo gives expressed consent to film in public areas of federal buildings.

The idea that any federal employee has the power to have someone trespassed because other people feel “uncomfortable” is really stupid. It would mean that if you’re a certain race, or dressed in a way that identifies your religion among other things, and people feel uncomfortable, any federal employee can have that person removed by simply stating that others feel uncomfortable. It would give federal employees the right to discriminate because they wouldn’t need to verbally express their prejudices. All they have to say is that they’re uncomfortable. Poster 7 is not the law, it is a poor attempt to represent the law, if you read the actual US post office law it is very clear that the postmaster can forbid filming. 39 CFR § 232.1 - Conduct on postal property (i) Photographs for news, advertising, or commercial purposes. Except as prohibited by official signs or the directions of security force personnel or other authorized personnel, or a Federal court order or rule, photographs for news purposes may be taken in entrances, lobbies, foyers, corridors, or auditoriums when used for public meetings. Other photographs may be taken only with the permission of the local postmaster or installation head.

All areas in front of the counter and any area that isn’t specifically marked as restricted are public! Why don’t they phone up the postmaster general and they need postal police to do the trespassing. The postal police should be called unless the police have a special arrangement with the local LEO’s. As I’ve noted elsewhere, the postmaster and the police have already incriminated themselves on camera. LIA left there under his own power with his cameras in his possession, and the evidence - this video - intact. I expect he and his lawyers will be filing a civil rights lawsuit within days.

Yea, this bs is getting old. You'd think they would just verify that all postal employees acknowledge these rights with a SIGNATURE. Also, when auditors act like they're here to buy things like a stamp, cards etc.. this is not the point. He's allowed to be there, plain and simple. He's allowed to film inside just to film, provided he stays silent and out of the way. Clarifying this is important because usually the cops will try to get him to make his purchases then bring up the fact that he has no more "business" to conduct, then run him out of the building.

Even the postmasters of numerous local offices have had to be reeducated on the rights within the post office. Wait, that's not the only camera in the world, and you can't destroy them all. You sound like a real genius. You might want to also consider the moment you touch either the auditor or their equipment, they now have the law of self defense on their side and however they decide to do so is your cross to bear.

Some of these post offices are simply gorgeous! I’m always a little sad that a beautiful building like that is used for a post office.

It's absolutely amazing how many Americans in government employment (at all levels) are so thick when it comes to the U.S. Constitution and the amendments thereto. Especially those in law enforcement and other parts of the judiciary (again, at all levels.)

Actually that officer was cordial and seemingly none egotistical but, he is wrong in his interpretation of federal law. Retail lobby written right on the door defines exactly what is written and read by the officer, lobbies, foyers and publicly accessible areas.

Is it "poster 7" that is supposed to be up on the wall at post offices? Doesn't that specifically state that it is OK for you to take pictures in all publicly accessible areas in the post office?

Unfortunately their interpretation of "public lobbies" is askew. They're defining a public lobby as the foyer area. Then the retail space as a separate area altogether and not covered by the lobby portion of the post office

That postmaster is really rude doesn't know the law probably doesn't know about poster 7 we need to do something about these people especially the post master. He's the rudest man that I've seen yet. How did these people get their jobs. Everyone needs to report this to the post office. They need to be educated.

Maybe things are different here in 🇬🇧 but where service is given and you purchase items we call that the retail section of the post office a lobby or foyer is the area you first enter when you walk in to the post office ,respect Sean Long Island audits 👍

Should have asked that officer how many times he has interpreted the law or rules and what gives him the right to interpret and not KNOW the law... and the Constitution. Ignorance of the law is no excuse.... interpreting the law when you are not a lawyer/judge ... oooof.
