Insurance company also made Mr. A to sign that if his car destroyed, insurance company won't pay any damages. This type of agreement is not enforceable coz Insurance company restricting right of Mr.A to claim damages

The points made by you in this video are good but unfortunately whether to grant maintenance/alimony and the quantum of it is left to the discretion of the judge. 1, A better approach is that a boy should never marry a girl who doesn't earn 50 to 70% of the income what the boy makes. This will ensure that the girl is marrying boy for reasons other than money. 2. Never allow the girl to quit her job for trivial reasons. The amount of maintenance a boy pays depends on how much girl earns. 3. Don't buy any property in the name of the girl if she is not contributing financially to it.

I have been doing this so much occasion that put up such conditions that girl should be earning more than me, I even ready to manage household activities. But to no avail luck showered on me. Girls runs after the money it's open truth, look at the matrimonial sites , girls earning Rs.15-20 lakhs per year aging around 40 still expecting/waiting for Prince to come to them earning Rs. 50+ lakhs.

It's a great Idea. However if a girl signs it. She should also sign a divorce scenario to be agreeing upon a lump sum amount based on factors such as husband income, wife current Status whether she was working and left it for marriage etc. Also 0- 5-10-15-20 year time period should be made a clause. This way both genders are protected.

Senior of one my school was married in 2015 , that time there was no concept of Prenup or anything, Within a year wife started hooking up with her ex bf, When husband confronted her she falsely accused him Of dowry and Physical abuse, husband was sent to jail upon hearing that his son is being sent to jail father had stroke and passed right away, he was in jail about nine months when her only mother also passed away as she was alone and none was around to take care, at the end the lawyer and one of his best friend uses honeytrap to find proof against the women and when it was found that the case was false,he was released and women was given 6month of jail period . Equality Huhh? He lost his mother, he last his father, he last his govt job, with almost a year of endless pain and torture, while she got 6month of Jail time.... 🔥🔥 Men and women of our nation must be educated on Prenuptial / Postnuptial Agreement. If #Prenup / #Postnup is not legal here, it should be made legal ASAP on priority basis.. the quicker, the better. Many marriages and lives will be saved, That will sort most of the issues. Without agreements, there are many reasons why a marriage continues, it may be due to fear of arrest, fear of demands, fear of law etc . But when agreements are done, the only reason to stay together is love, knowing that they are legally allowed to be separated without any issues, they still chose to stay together, thats the benefit of prenup/postnup agreements.. love will be only factor why marriage will stick ..

honestly, if the woman or her family have issues with signing such documents, its a pretty clear indication of how they think and what their motives were for the marriage. and if later on they say that "we will sign the documents. please dont cancel the wedding. we will agree to everything. lets not get emotional here." do not let them sign the documents, because if disputes arise in the future, this particular document will definitely be cancelled as their lawyers will argue the point that the document was signed under coercion as they stated that the marriage will not happen if the documents are not signed. put these documents infront of your future wife and future in laws and their reaction will tell you everything you need to know about the marriage.

Right from its very existence to its enactment, the courts in India is (un) intentionally disadvantage innocent men over the generic perception of suppressing the women rights, her dignity and her life. Good advice, the problem is that even if you sign all this at the time of marriage, the girl can still go and say in the court that she was harassed after marriage for dowry etc. All these affidavits will only be at one point in time and no girl is going to sign them on a recurring basis.

I have few questions regarding providing maintenance in case of divorce: 1. If divorce is mutual? 2. If a wife is earning ? 3. If a wife is earning more than the husband? Does the maintenance have to be paid by the husband in these scenarios? Is there any provision where the husband can seek maintenance?

1. No such thing as mutual divorce. Who started it? 2. You still pay maintenance if she's working just a tad bit lower than if she isn't. 3. Then she has leeway to demand even more maintenance and alimony. Hence why it's adviced to marry a working woman who earns 50% or more at min of what you do. Husband can only seek maintenance if he's disabled and can't work which is extreme case.

Quite informative indeed, sir. I am law student & familiar with the legal standpoint of prenups in India . The fact the era of failing marriages that we live in, it does becomes sensible & rational to go with notary declaration as recommended by you. But my question being from philosophical point of view, aren't we creating an air of mistrust & manifesting foundation of marriages on it right from the beginning where marriages are failing predominantly for the usual reasons (dowry, job, etc) but also due other major incompatibility issues (with present generation having lower threshold & no compromise attitude) & implementing the recommended solution by you seems to be like a temporary relief from heartburning of going through litigation battle against the spouse but at first instance doesn't prevent or at least delay the time marriages failing (addressing the root cause?)

This is a very complicated topic as a lot of women leave their jobs due to emotional abuse and pressure of unpaid work at home. So even though others did not ask them to quit their job, they end up quitting because of these other various indirect pressures. Can this argument be used against a prenup ?

For the ladies who did signed the clause and still feel pressure to leave the job to do house chores, you must draw the line somewhere. Say you can only do this much and share the work or hire help. At least not financially and that is why they are scared to leave their job because if they left their jobs things at home could become worse because of multiple societal pressures that we don't need to get into. What I was trying to ask was, is there any law against unpaid labor and emotional/verbal abuse that can help people? My example was from a women's perspective but I would like to know if people in general can protect themselves from such domestic cases.

I don't know about others, but what I have seen in marriage in my family & relatives , is we get the each and every item of dowry wriiten and signed by both parties , and there are witness to this , n we share d copy , its on a blank paper

Please Explain : 1) The evidentiary value of this affidavit in the maintenance proceeding. 2) What will happen if the wife comes to court and says that she signed this affidavit under coercion or was blackmailed or threatened to sign in. Also, this affidavit is not a registered document and has no binding value then how can you say that the court will be able to pass any order based on a document the authenticity of which is not known and it has also had persuasive value?

Prenups are not legal in India because in India, marriage isn't seen as a contract. It is seen as two people coming together for matrimony. There is no contract. So it doesn't work

This would ideally benefit the wife, but because of the potential for dowry harassment laws, prenups in India help the husbands. Pre nuptials don't deal with kids. Neither can they affect payment of maintenence. Any agreement between parties in violation of any Indian Law is void. But prenups help to prevent false allegations about excessive expenditure on the marriage, and amounts of stridhan and gifts

@@AmishLegal to be really honest I think that this ( pre nuptial agreement)will help to put down real dowrey cases too. As then both parties do declaration earlier and it will be good if a government employees could also administer the marriage at the same time/ could simply bring a law which states all marriage should be court marriage this will help reduce the expenses and the menace of dowrey also ( real one) also at the same time. And kindly teach girls to close their legs first, and if there is a real dowry case, then she can make a audio or video of it, and can show it in court, if they can call their parents twice or thrice a day, then they can also show proofs, and also since girls make adultery law legal, if they can cheat through social media and can have sex after marriage and continue to have relationship with BF then why they can't show proofs, of domestic violence and dowry cases, such a silly argument.

My no. 2 question is - there are some good laws through which if someone wife filed a false case. Then she will be put in jail. Example - IPC 211 , IPC 182 , CRPC 340. And there is another way to prove someones innocence is that husband can file crpc 91( through which he can also claim proofs whatever false cases has been registered against him) and crpc 97 and section 24 . I mean i am talking about counter cases.

These are very sensitive matters esp in arrange marriages where money is very important parameter the girl's family to fix the alliance. 7:07 Marriage is considered as a leap of faith and not a commercial transaction. By bringing all these points especially in India where things are taken more emotionally, bride's family can consider that as hurting their self respect. Then no marriages can happen unless they are in compulsion. Thoughough there is always a possibility of divorce happening post marriage but it is still less than 5%.

I think sec JUDICIAL Seperation OR SOME ammendment required. Chota mota divorce or seperation if needed it should be allowed the moment it filed . So that 1 could see the need of or importance of partners in that allowed period. 1 could see the other valuable aspect of his / her life. Self respect should be taught earning and building own empire is better than begging from in laws for money
