Andy turns 16 this year, which means a whole load of stuff that we weren't quite prepared for until we met with his Paediatrician and Social Worker this week, including applying for PIP (personal independence payment) and the need for Power of Attorney. It's especially worrying as none of the professionals involved seem certain about what we'll actually need to do! This weekly vlog also includes a trip to Grantham, some new tea for Anna and our continued efforts to get fit at the gym!

I'm a 37 year old KZbinr from the UK. I've got a cracking beard and I'm currently going through the autism diagnosis process. I started this channel back in 2017 and by the time I left my full-time job as a Computer Science teacher in July of that year, my partner Anna was trapped in our house by our son Andy, who is autistic and had refused to go to school for 18 months. Our daughters Lucy and Amy and our dog Dave hardly saw me because I was always working to try and solve all our problems! As someone that is on pip and has been on it for quite some time ,be prepared for stress in the beginning and pay close attention to the questions as some of them are made to trick you ,the advice I was given was to answer the questions as if it is his worst day not his best day. Took me for years to fight for PIP. Kept getting 0 points until tribunal and scored 27! It's a really difficult benefit to get. I wrote my worst days etc and the DWP just didn't care. Keep fighting. Good luck x

I have been on pip twice and it was a nightmare both times because the assessor lied at my assessment and then I appealed and it got taken to court and from that date they said I would have PIP for 2 years before being re-assessed but they sent for me to be re-assessed a year early and then again at the re-assessment they asked me stuff that was barely related to Autism and lied and twisted everything I said on the re-assessment form

@@livsephton9 I'm sorry you had to deal with that ,sadly it is very common for them to twist what you say to them or full out lie ,also it's good to note they are testing you even before you go into the assessment room (if you go to the assessment centre) as they leave you waiting for a bit on purpose to test your response, I'm very bad at waiting long periods of time as every minute I'm there my anxiety grows and during one of my yearly assessments I ended up having a break down and panic attack in the waiting room.

One of the ways out of dealing with the fact they might try to lie is to record the assessment in some way either just by voice or picture (camera or voice recorder will do the job easily) although I do believe you may need to tell them in advance that they will be recorded (you might get some push back but dont give in)

Good luck with the PIP Assessments, I do hope they go Well. I can only give the Same Advice as everyone Else when it comes to the Assessment, now, some of this is going to sound a Little Harsh, but it really is the best Way to ensure that He gets a High Level of PIP Payment. You need to Answer every Question as if Andy is having His absolute *Worst* Day and Pay attention to every single Question in Extreme Detail as they will use a lot of Trick Questions to Trip You up so they can force Andy into the Workplace, because getting Him into Work is what they are there to do! that is their actual Job! So to get PIP, You have got to avoid every Single Trap they will Set, and some of them are Properly Sneaky! Believe Me! Let them know Exactly how bad the Meltdowns are, as no way would the Workplace be able to Cope with some of the Ones we have Seen on this Channel in the Past, they are just not Trained enough to do so :( Let them know that He doesn't Know How to Tie His Shoelaces.. as that one is an "Instant Write off" for the Workplace apparently! so its a Good one to Mention.. I was told that in My Pip Assessment when I told them that I can Tie My Laces by Myself (I Learned in the Last Month of Year 6, when I was 11) , as they said "Pity... because if You couldn't, that is actually an Instant Work Place Write off!" Let them Know absolutely Everything He Struggles with, hold Nothing back, the More it is Clear to the Assessor that Andy Struggles with Day to Day Life, the Higher the Level of PIP they will place Him onto. Let them know if He has any Mental Health issues as well, one of the things that got Me put onto a Very High Level of PIP is the fact I have a lot of Mental Health issues, I wont go into them here however. Let them know about the Developmental Delay, don't be worried about Embarrassing Him, these Kinds of assessments are a "Cruel to be Kind" Situation , as the Workplace, basically, is like that Gym You went to, it Just isn't Equipped to Handle someone who still has the Mentality of a Child, the Fact I am only 10 Mentally (as I also have a Developmental Delay) is one of the Reasons I was classed as "Unemployable" and Placed onto a very High PIP Band. Let them know absolutely Everything and like it is on His absolute Worst Day. Swing the Lead a bit and make Him seem Worse than he is if You have to, Remember, the Assessor isn't there to Put Him on PIP, He is there to Put Him into the Workplace, so to get PIP, You really have got to let them know Exactly how bad Andy is when He is at His Worse, as, basically, the Workplace wont be able to Cope, and when that is Clear to the Assessor, they will Probably place Him in one of the High Bands for PIP Payments. With any luck, by following the Advice Everyone has given to You, You should get the *highest* PIP Rating (I am Second from Top) and He will be Placed into the "Support group" (meaning He doesn't need to Find work unless He actively wants to do So), where I am also Placed, as that is basically, with one or Two Changes, what Me and My Parents did at My Two PIP Assessments (One when I was First put on it when I left School in 2002, and another back in 2016 when they bought in this *Unspeakable* "Universal Credit" System (don't worry, I wont get Political, I know You don't want that) and I had to be Re-assessed) and then You will need to never Worry about Finding Him a Job or getting Him enough Benefits Money or having any more Assessment Appointments again! At the Moment, My Parents have Power of Attorney as I have been Judged as "Unfit to make Legal Decisions" and they were given it Automatically, because, again, I have the Mind of a 10 Year Old and just don't Understand things well enough to make Legally Binding Decisions, but they are handing it over to a Solicitor (as they are getting very old Now) later in the Year. Sorry to be Harsh, but, its the only way I can really Advice You, and I do Hope that the Advice Helps.

Don't spread misinformation. PIP is not there to get you in to work. PIP is not work related whatsoever. The fact you're talking about the support group makes me think you just have PIP and ESA confused.

Chances are I do have Personal Independence Payment and ESA Confused, I am not the Brightest Spark in the Explosives Warehouse, not by a Long Shot. However, it is a Fact that the PIP Assessment comes *After* the Fitness for Work Assessment, so, even if My Advice is wrong for the PIP Assessment, it is, according to several other People on the Spectrum who are far more clever than I, absolutely Spot on for the Fitness for Work Assessment. So, Hopefully, it will still be of some Use to Mr Chapman and Andy.

@@simeonyves5940 Again, this is not correct. Fitness for Work Assessments have absolutely nothing to do with PIP and don't even exist anymore. The PIP process is you make a claim over the phone, they send you a form and once the form is returned they refer you for a PIP assessment. Once the assessment is complete they assessors send a report to PIP and PIP make a decision. PIP never has and never will take into consideration whether you can work or not. You can be a millionaire working a full time job but as long as you meet the PIP criteria, you will get it.

@@Kitumi578 If Fitness for Work Assessments no longer exist then why did I have to have One (meaning I have had *Two* of the Blasted things!) when they Government changed over from Regular Benefits to Universal Credit? so either they have only been dropped within the last 2 Years (as Mine was 21 Months Ago), or You have got it wrong Yourself and they still Exist. I still thank You for Explaining how PIP actually Works, as I didn't make the Call as I am Extremely Anxious and Awkward on Phones, to the Point I will often just Shut down and Become Non Verbal, and Nor did i fill in the Form, it was filled in for Me as it would not have been even Remotely Legible had I Filled it in Personally. However, I had both the Second Fitness for Work Assessment and the PIP Assessment (due to the change from DLA to PIP that came around at the Same time as UC) on the Same Day, in the Same Office, just with Different Assessors, which might Explain why I, Personally, Associate them with Each other. I can only go on My own Personal Experiences and those of others who are also on the Spectrum. If those Experiences are incorrectly Perceived due to Confusion and a Lack of Intellect, or they are Out of Date, then Misinformation is Inevitable, but again, Misinformation was *Not* My Intention. My One and Only Intention was to try and Help Andy to get the Benefits He is going to need, at a High Pay Level so He gets a good quality of Life, and to keep Him out of the Workplace where they will never cope with Him! Has it become illegal to Try and Help someone out these Days?

@@simeonyves5940 That's a Work Capability Assessment, very similar and designed to replace the Fitness for Work Assessments but they aren't the same, you can literally just google fitness for work assessments and see they stopped in 2018. And as you just admitted, it was for Universal Credit, not PIP. If you had them on the same day, in the same office then it's purely a coincidence, like I've said they're not related at all or even administered by the same people. UC/ESA/JSA and all other work related benefits are administered by the Job Centre whilst PIP/DLA/AA is administered by the Disability Services and Decision Making Directorate. It's not illegal to help and whilst there was no ill intention, people need to realise that no information is better than misinformation. So as harsh as it sounds, if you don't know what you're talking about, keeping quiet is the best way you can help. Especially with people who have conditions of this nature, preparation is everything and if they've prepared using information that is incorrect it could completely throw them off when things are different than expected.

Kev I'm in Scotland so it must work very differently up here but I have to say I found the move from DLA to Pip very easy. I got sent the form, filled it in and a few weeks later got a reply saying where and when my interview was. I found the interview, that was conducted by a qualified doctor, very stress free. About 6 weeks after that I got a letter saying I would be getting the full rate of both components of PIP. During that 6 week period I was still getting DLA at the rate I'd always got it.

Hi Kev, I'm not a legal expert, but I do work in Primary Care. I'd advise you to make an appointment with the Practice Manager, or Operations Manager if they have one at your GPs, and ask how it will be best to work with them in relation to Andy's medical care once he's 16. They have to keep up to date in relation to these things, they should know, plus that will tell you what they'll be looking for, eg if you need a power of attorney.

Pip is a nightmare particularly for mental type disabilities (not meaning to sound offensive I'm just not sure how to word it I mean disabilities that can't be easily seen and tested for) . I've been refused twice currently trying for the 3rd time (assessment on Tuesday next week). Hopefully you will have a better experience than I have with pip. Loving the weekly vlogs and happy to see Andy's making so much progress

Hi Kevin, I turned 16 this year and also got DLA as a child. The DWP will send Andy a letter asking whether you want to apply for PIP, then they send you an application form. I was then asked to attend a face to face meeting to discuss the application further. You will keep getting Andy's DLA money until a decision is made on whether he will get PIP or not. A tip for applying for PIP. Evidence is important. A lot of people complete the form send it back on its own. The assessors review all evidence before they see the customer, if no evidence is submitted all they have to go on is how he is at the assessment and if he happens to be having a good day then the chances are he's going to be disallowed. Send in as much supporting evidence with the form as possible and then even if he's having a good day on the day of the assessment it shouldn't matter.

I don't know how much I can help but I am a transition coordinator for the US. In the us it's eighteen and you don't need power of attorney if he consents to you being there. Since he can provide verbal consent to that. As for financials, in the us there's a type of trust you can set up for him that allows you to help him manage. There's some basic legal templates you can find to set up a contract with him where you outline how you can help him as an adult in different areas, a customized power of attorney sort of and that is what I typically recommend because it preserves as much of his rights and independence as possible while maximizing support.

Hi Kev, Be aware that PIP is now determined by safety and getting out and about - new changes. It'll mean that everything else will be easier to get than them 2 categories. Also be aware that for my PIP, they had all the evidence they needed but made up reasons I couldn't have it in the conclusion. I won it after challenging the report.

You have to go through court normally to get power of attorney. Unless he agrees to you being power of attorney but as you have said its makeing sure he understands what he is agreeing to. The alternative is Social services do an assessment and you also will require a home visit from the home secretary to evaluate his needs I can provide more info if needed you will have to private message me though

PIP advice - as others have said, answer the questions with honesty, but with a sense of worst-case scenario in mind (ie him on his worst days). I know that may be upsetting as it feels like you’re denying his progress/independence (it felt like that for me). However, do try and be realistic and if there are things he is capable of, please write them. I know a lot of that’s contradictory and it’s a real fine balance - and a pre-warning that it can be stressful, although if they think Andy qualifies enough, you may not have to go for interview - but please stay with it, you obviously know how important it is and it will be worth it in the end.

Google power of attorney vs deputyship order. They are the same thing but power of attorney can only be applied for ones self. Such as, you could apply for power of attorney for yourself, in the event of you becoming incapacitated. However deputyship order is where someone like yourself can apply for, for someone else. Hope this makes sense. Mencap charity have loads of information on it and uk wide seminars for parents and carers to attend. I'm currently in the same boat with my son so doing all the fact finding I can. Good luck

Suggestion ask for home assessment state why like he wouldnt be capble of travling by himself at all, also the stress out weighs the benefits as alot of preparing would be needed and use you feel the meeting may be cancelled as depending on mood it can go one way or another but generally something new usually results in an meltdown. You can ask for the meeting to be recorded and for an copy. If you have diagnosis paperwork use these as evdince, any prescription medications he takes an repeat copy would be fine, get as much back up evidence you can get Gp, consultant special education statement, don't prevent his behaviours too much, allow him to dress himself no matter how ridiculous he may look. Say the worst possible out come you have to really say the effort and measures in place to prevent him not melting down. Include any injuries sustained usually scares them say it will take at least 2 of you. Look on line so you can see questions as some you may tick but something more relevant worth more points is in other questions. Some questions like reading are ridiculous as one person read 2 words out of an whole paragraph (A and we) apparently can read adequate. Don't be afraid to challenge an decisions especially if you disagree mandatory reconsideration they will say you need extra evidence you don't generally any extra will help you. Use anything no matter what as prove.

I met you in Blackpool I think it was last year for the meet up. My son is autistic and needs so much help, doctors and medication and his pip application was dismissed after DLA for indefinite. Appealing today but it looks like people who go all the way to tributal win their case, but that's taking 12-18 months. This is a nightmare as now I'm not classed as a carer so all benefits are stopping and we will be evicted......

Unsure with children's services but with adult's social services with someone like Andy you'd be better off going down the line of a mental capacity assessment (MCA). If it was deemed from the MCA that he doesn't have the capacity to make his own decisions and fully understand the consequence of them you'll be able to get power of attorney.

We will ask you to sign a recording agreement. This tells you how you can later use the recording, and helps us keep your details confidential. You will need to use your own recording equipment. To protect all parties, DWP restricts approved devices to those that produce two identical recordings simultaneously. Please note that this does not include laptops, tablets, smartphones or MP3 players.

the social workers should help with both pip and power of attorney. we didn’t seem to have much of an issue with power of attorney since they usually make an assessment again for pip and they decided then and there that my brother wasn’t capable of managing money or making decisions so that may also be the case for andy. it’s something to discuss further with maybe his school and anyone else involved in his care

You can apply for appointee so yous could get Andy’s money. However, I’m confused as to how that would work if Andy can’t say he wants a appointee. I guess you could just explain the situation with Andy. Good luck!

If school dress codes didn't exist, everyone would wear hoodies to school. At my high school, they were allowed for doing PE outside when it's cold and the Leavers hoodies for Year 11, that no one could have until the minute we left on the last day, don't get why. Good luck with PIP, it's torment to apply for and get the right money (being through it 2 years ago) but keep fighting and never give up, even if it goes wrong. I recall on when my Mum started applying for my PIP (She is my carer and appointee) an advisory from the social came to our house to discuss about what will happen when I turn 16. I refused to come downstairs at the meeting as I am no good with strangers and new places, but the adviser after having talking with my mum about my level of choice making (which is poor) agreed she can be my appointee and make choices about money and dealing with people (In medicals/social meetings). I'm sure they will make a meeting with Andy (AKA. You and Anna) to discuss his level of decision making and if you tell them that he can't, they should do the same. It is 16 I had the same problem with my autistic son, I did it through dla/pip they came to the house to do an assessment. They assessed my son as not being able to manage his money, so I was set up as his nominated appointee. Hope this helps x

This is not the same as a Power of Attorney. Being made an appointee by the DWP only makes you his representative for DWP benefits. Being a Power of Attorney includes pretty much everything.

Hi. When applying for PIP, before you get the form sent out to you you get a form sent out to fill in to say that one of you is going to be the carer responsible for his money etc. You post that off and then they send a letter out confirming you're acting on his behalf. A guy from DWP came out to get my bank details etc and to ask my son was he happy for me to look after his money, my son nodded yes and that was it. After that they send the PIP form out for you to complete. I found its best to complete it over a couple of nights a week rather than all at once as its a tough form to fill out. Hope this info helps a bit. I've just completed a PIP form for my son and just waiting on date for home assessment.

Pip is notoriously hard to apply for. Please get help in claiming this, remember its about what Andy needs to get around in daily life. I help people with this and the constant appeals. My advice would be to get the support of Andys key workers etc. Turn To Us have a good guide on how to do this

Also theres something alternative to power of attorney which is appointee much better option and free as not permanent as if he became capable of looking after his own money or you became ill. Only one of you can be it if you became ill someone else can be it like other one of you or professional. He will need assessment insist on been present but say your there incase he becomes to distressed not to interfere with questioning. They then ask you get form filled out with you ect. The if accepted which not many refused this as you technically need to be able to understand money and budgeting ect Which he can't do. You will basically be expected to do anything he would if capable like changes in circumstances and spend the money in his best interests

Good luck with the PIP, I had to take them to court (autism, EUPD, ADD, severe depression) so be prepared to fight for it. Power of Attorney is cheaper if you do most of it yourself via www.gov.uk/power-of-attorney (Office of the Public Guardian). Ignore sites that offer to do it for you, you'll be heavily charged and it isn't that difficult these days ;)

I work for citizens advice and the PIP forms are horrible, make sure to keep a diary of how the descriptors all affect your day to day life as evidence and prepare as best you can for the assessment!

Power of attorney is super easy in Cornwall if you call pip they will send someone out who will have a chat you sign a form as Andy doesn't have capacity ( he still needs everything decoding for him and wouldn't understand the question effectively ) you should just have to sign it I stayed there for about 5 muniets

That's an appointee, not a Power of Attorney. Power of Attorney is done through the courts.

@@ajwaring448 8 or more * and that's correct, you wouldn't get the benefit if it doesn't effect what you can or can't do. As harsh as it sounds, the benefit isn't there to make you feel better. It's there to help people who can't do basic day to day activities due to their condition. They didn't refuse you just because you can dress and wash yourself. The daily living part has 10 activities, you mentioned just two of them. If you only scored 2 points it's because they think you can do 9 of those 10 activities without difficulty and you have minor difficulties with whichever one you scored 2 points for. Also keep in mind that PIP does account for people who need prompting to dress and/or wash themselves. The same goes for eating and drinking, taking medication, preparing a meal etc. So even if you can physically do those things but you don't do them because you lack motivation to do them due to your crippling mental health then you would still score points as long as there is evidence to back it up.

DramaticLT I needed the pip do get my assistant dog as I can’t leave the house with out my dog but he got taken away because I got arrested for having him in public library and not being a registered assistant dog Hense why the pip was asked for as I have crippling illnesses that stop me from being able to do things yes I can walk 10 meters unaided but ask me to shop alone and I’ll have a full on panic attake stop breathing and be in hospital (that’s how bad my anxiety and ptsd is )

The truble, with a lot of social workers, thay no nothing about Autism, my last social, Woz uesless, he told me, I no more Autism then him, so how can he help me, I lost my support, I had for 16 year's, saw to him, had to fight for 3 years to get it back. I lost my funding for my rest bit.
