It is illegal under immigration law and the US Constitution (and the US Constitution still apply as these people were on US Land or Waters initially) but is illegal to hold without charges. If they have immigration hearings then that is lawful until the hearings are over but right to a speedy trial still exists and you cannot continue to continue a case because one country will not accept deportations.
