Sir Article 22 Me Preventive Detention Me Police ek Person ko Jo koi Cognizable offence karsakta hai Usko 3 Mahine tak Police Apni Custody Me Rakh Sakti hai to Phir Crpc 151 me 24Hour kyu Diya Gaya hai, Yeh Bhi to Preventive Action hai, in Dono Me Kya Different hai?

I think Within that 24 hours only the police officer may take the permission from the advisory board and can extend it for 3 months ... But I am not sure of my answer ..

@@sabihabegum121 Mere Hisab se Yeh Lagta hai ke Yeh 3 Month tak ki Jo bat horahi hai wo crime ko Dekh kar Shayad Decide kiya jata ho jaisa ke Election Aane wala hai aur Sarkar ko lage ke Yeh shakhs koi Hungama khada karega aur hamari Politics me koi Rukawat banega to isko Detained hi karlete hai, baaki chote chote crime ke liye koi zaruri nahi hai 3 month tak ke liye, lekin Main bhi Apne Answer se mutmayin nahi hu

See bro crpc sec 151 (2) states that no person arrested under sub sections (1) of 151 shall be detained in custody for a period exceeding 24 hrs from time of his arrest Unless his further detan tion is required or authorised under any other provisions of code or any other law for time being in force So it is clear from last phrase of sec151(2) if any preventive law requires detaintion more than 24 hrs it can do so further. You keep in mind detaintion and arrest are somehow different Part 3 article 22 of constitution clause 4 states that no law for preventive detention shall authorised detention for more than 3 months unless approved by advisory board Substantive law constitution set up limit to parliamentary law limit of 3months
