My parents who are alive divided property to my brother and me, They gave me 1 part and my brother gave all the remaining share more than (father share+ mother share +4 parts to my brother) When I asked my parents, what they've divided is incorrect they say it's according to shariya they've divided . My parents thinks that they give all their share to my brother as they gonna stay with my younger brother. I left what's right and wrong on Allah. Alhamdulillah I am happy as I am not one among having someone's HAQQ in the name of shariyah .

Kindly clarify on transfer of property where there is no son. Property belongs to women. After she died, she left behind her husband and 2 daughters. Husband also died leaving behind only 2 daughters. Now as daughter in Islam has right to inherit only 2/3 share in property, then who shall inherit remaining 1/3 share in property as the family is left with no close relatives. Who shall be the distant relatives to claim 1/3 share in property

Two daughters get half the shares. 1/3 rd share to be given as charity is not compulsory. But if a person ‘wish to donate some thing’ the max share of charity shall not exceed 1/3 rd.

My mom passed away a year and a half back and the reason of her death was my only brother who is also the eldest misbehaved with her very badly that she had a stroke and then she lost her senses completely. It was my elder sister who took care of her for few months before my mom passed away and I helped them financially and paid for everything (for all the expenses) as they were back home and I was far away so I did whatever I could to save her and my sister did her best to save her but we couldn't. Now, although I have listened to the whole video but I still want to know, does my brother really deserve to get half the share from her properties, the person who never took care of her own mom and never took care of her expenses? Allah says that mom has the highest status of all. 1, 2 and 3 goes to mom and then the 4th goes to father so I know its only Allah who can spare a life and who can take a person's soul away and its in his hands only but the person who became the reason of her death, does he really get half the share of her properties?

By this stupid logic what you are really saying is that your sister took care of her mother for greed. And that IS happening. Had she been alive and her son was a shithead then what she should have done is distributed the property to you in her lifetime leaving some amount for her son but the majority between the daughters. ONLY if the son really gave her a lot of trouble. Now that she is dead you cant do anything. 1/3 rd can be played with so the most you can do is take 1/3rd for yourselves and then the remainder will be divided as per law.

By saying it verbally it doesnt count for anything, mufti tariq masood has said that the only way to accept a womans word is if the property was handed over to her, such as signed document, or the rent went into her bank account, she received that money and STILL she handed it back then said i dont want any of this.
