This is great info. I’m struggling to find information that is relevant to my situation. I am in the process of retaining an attorney so not asking for legal advice, but would love to have a better understanding of division in this if you were willing. Husband bought a home with marital money. Mortgage is only in his name. During the closing he completed a deed of gift to me for 50% undivided interest in the home (not just when he dies). We lived in the home paying for it with marital money approximately 9 years. We have separated due to domestic violence issues (documented, police report, tpo etc). During the initial part of the separation he was fine with the children and I staying in the home but after being incarcerated he wants to sell it. Closing attorney says he can’t without my permission since I have 50% on that deed of gift. Would a judge consider the entire home marital property to be divided or would he see my 50% as a gift and not include it? I’m looking for just a more generalized answer because I do understand each case is different and such.
