If the person guilty of adultery committed this offense while being abandoned without justification by the offended spouse, the penalty next lower in degree than that provided in the next preceding paragraph shall be imposed. Lesson 20 Good day Attorney, Thank you for making this video. In this lesson I've learned the difference of adultery and concubinage. Who prosecutes adultery and concubinage? -Only the injured spouse has the authority to submit a complaint against the perpetrators of adultery or concubinage, as I learned here. In-laws and children have no legal standing to bring a case against a marriage. Adultery and concubinage can only be committed by two people, thus I learned that not only one person should be convicted in this case. You can't even bring a case against the mistress by herself. They can both sue if the aggrieved spouse files a case. You will no longer be able to prosecute these people after you have allowed and summoned them. - Adultery and concubinage offences will not be punished unless the aggrieved spouse files a complaint

Good morning, Atty!! Thank you for another interesting lesson. Lesson 20: Who prosecutes adultery and concubinage? I discovered here that only the offended spouse has the authority to file a complaint against the perpetrators of adultery or concubinage. When it comes to initiating a lawsuit against a couple, in-laws or children have no standing. I also discovered that in this scenario, not just one person should be prosecuted because adultery and concubinage can only be committed by two persons. You can't even file a case with just the mistress. If the offended spouse files a lawsuit, they can both sue. However, once you allow and summon these persons, you are no longer able to prosecute them.

In this video, I learned that based on rule 110 section 5 rules of court that all criminal actions shall be prosecuted under the direction and control of a public prosecutor. Also, this general rule has an exemption wherein section 5 under rule 110 the crime of adultery and concubinage shall not be prosecuted unless the complaint is filed by the offended spouse. Furthermore, you cannot charge the affair of the accused only instead the both of them will be in jail if you filed a case. LESSON 40 According to Section 5 of Rule 110, all criminal cases shall be prosecuted under the direction and control of a public prosecutor. As all criminal cases are considered as Public Crime - true victim are not only the offended party, but also the Public of the Philippines. The only exemption to the general rule regarding criminal cases, are Adultery and Concubinage. These cases shall be filed ONLY by the offended spouse. However, the offended spouse cannot file only against the third party only, it should include both guilty parties. Good day sir! Upon watching this video, I remember our lesson on our previous subject that the real victim was the People of the Philippines and was represented by a public prosecutor. Today, I learned that all criminal cases must be prosecuted by a public prosecutor but the exceptions was for concubinage or adultery the complaint must be filed by the offended spouse and must be filed to both guilty parties unless the offended spouse pardoned both. As a general rule under rule 110 section 5- all criminal actions either commenced by compliant shall be prosecuted under the direction and control of a public prosecutor. Section 5 - the crimes of adultery and Concubinage shall not be prosecuted except upon a compliant filed by the offended spouse. As a continuation of our discussion in the requisites of Rule 110, I learned relevant information on who is the authority who must prosecute criminal action. Moreover, it was emphasized in the video lecture that it is the public prosecutor who has the authority to prosecute all criminal action either commenced by complaint or information. However, as mention in section 5 of rule 110, the crimes adultery and concubinage, which part of crimes against chastity are not be prosecuted except upon a complaint filed by the offended spouse as an exception to the general rule. Hence, it was a concise and fruitful discussion widening our knowledge about rule 110 of the revised rules of criminal procedure as its general rule and its exception. It was joyful to watch because personally, I also dreamed and wanted to become a prosecutor someday if God would allow me.
