सर Juvenile justice Act 2015 sec. 10 में संशोधन कर, ये होना चाहिए की 15-18 की आयु वाले किशोर को बालक कल्याण पुलिस को अवश्य देना चाहिए। और sec.12 में यह होना चाहिए कि जमानत अपराध की कोटि को देखकर दी जानी चाहिए। यदि अपराध का दंड 7साल से ज्यादा है तो 15से 18 की आयु के किशोर को बालक कल्याण पुलिस को एक निर्धारित समय तक भेज दिया जाए। According to Jurisprudence, JJ Act 2015 की धारा 199A में जो fine अपराधी के पैरेंट्स को भरना है उसे बढ़ा कर मृतक को देना चाहिए।(मृतक को मिलने वाले मुआवजे को विभाजित कर monthly कर देना चाहिए) ताकि मुआवजे का एहसास हो सके ताकि अगली बार कोई भी किशोर गाड़ी देने से पूर्व दस बार सोचे। धन्यवाद सर🙏

Bilkul sahi. Instead of criticizing Judge, it is important to criticize and rationalize LAW. There is a big difference between Law and Justice. Effort should be made to bridge that gap. As per internal reports :- Yerwada Pune police officials give VIP treatment to the accused, they served Biryani & pizza.... Accused father hired Advocate Prashant Patel who was the same advocate who was hired by Suraj Pancholi in Jia khan case.... Advocate Prashant also represented Ajit pawar & Jacqueline Fernandez.... Acc to section 15 of Juvenile justice act a 16 to 17 yrs old Juvenile also treated like an Adult if he/she committed a heinous crime.... But what about Nirbhaya Juvenile who was main culprit ( most cruel among all 6) but our Judiciary free him with 10,000₹ &:with one silai machine.... On other hand In foreign Judiciary is really appreciable in Cameroon heirren case where that accused was 17 yrs old but still punished for 24 years.... Indian Judiciary is myth.... Specially lower Judiciary.

Govt should do appropriate amendment in law so as to give freedom to judges to punish appropriately the guilty. How sad two young engineers lost life due to this loafer son of a rich builder.

16yr se zyada umrawale bacche ko kuch na kuch saza ka prawdhan Juvenile kanoon me zarror hona chahiye kyonki ye bacche achhe aur bure ki samaz rakhte hai. Condition sirf etni honi chahiye ki saza zyada hard na ho. Aur saza bhi tab di jani chahiye jab kisi ki jaan ka sawal ho baki chote chote mamle me saza na ho to bhi thik hai. N K Tiwari Advocate There are many cases where Apex court, High Court or other Courts exercised their power. In this particular case social media says that judge has given favor because he was son of a powerful person. If this kishore belongs to rickshaw Pooler , may reaction of judge may be different. Bail given to kejarwal is an example. In same nature of crime court denied the bail to Hemant soren. About 5 crore cases are pending in Indian courts. Can you have any opinion on this?

Sir,section 12(1) of Juvenile justice act.2015 also says that"provided that such person shall not be so released if there appears reasonable grounds for believing that the release is likely to bring that person into association with any known criminal or expose the said person to moral,physical or psychological danger or the person's release would defeat the ends of justice. Section 12(3) speaks that when such person is not released on bail ,board shall make an order sending him to an observration home . Under Section 18 (3) of the JJ Act,Board may pass an order that there is a need for trial of the said child as an adult and order the transfer of the trial of the case to the children's court .

सर किशोर के उम्र के साथ-साथ उसके सोचने और समझने की शक्ति और उनका हिस्ट्री पर ध्यान दे कर punishment देना चाहिए। और ये बात भी सही है की छोटे मोटे अपराधों में किशोर को सुधार गृह भेजा जाता है तो ऐसे अपराध क्यों नहीं? इसमें judge सहाब का कोई गलती नहीं है क्योंकि judgement तो according to indian law है।

मेरे अनुमान से किसी भी नाबालिक के इतनी बड़ी घटना को अंजाम देने पर , उस नाबालिक के पेरेंट्स को 50 लाख तक का जुर्माना, या कम से कम 10 साल तक की सजा का प्रावधान होना चाहिए। क्योंकि अभी सिर्फ दो लोगों की जान से ये टल गया है, ऐसे में गाड़ी से काफ़ी लोगों की भी जान जा सकती थी। ऐसे में 90%अहम रोल पेरेंट्स का ही होता है।

The act need to be amend as well as presiding officer need to be aware of circumstances and fact bcz the sentence like this is affecting over the believers of judiciary. जिस तरह से वर्तमान सामाजिक परिस्थितियां परिवर्तित हो रही हैं उनको ध्यान में रखते हुए सर्वप्रथम ये आयु सीमा जैसी चीज को कानून को बदलना चाहिए, प्रिंसिपल of natural justice should be followed. केस में एक एक फैक्ट की भूमिका अहम होती है, उन पुलिस वालों के खिलाफ कार्रवाई होनी चाहिए जो केस के एविडेंस को कमजोर करने में मददगार होती है चाहे वो delay in blood sampling ho ya vip treatment ho. उन mla ko bhi सजा मिलनी चाहिए जो पुलिस पर दबाव बनाने की कोशिश करते हैं। रही बात जज की तो जज को प्रोपोर्शनलिटी टेस्ट के आधार पर डिसीजन लेना चाहिए न की मात्र un कानून के आधार पर जो बस लिख दिए जाते हैं। क्योंकि ऐसी डायनेमिक सोसायटी जहां सोसाइटल वैल्यूज इतनी तेजी से बदल रही हैं वहां इन चंद कानून के अनुसार जजमेंट नही देना चाहिए। और चलिए मान लेते हैं की लड़का नाबालिग था ऑन पेपर but उसके फादर या अभिभावक पर पूरी तरह कार्रवाई होनी चाहिए, वरना कहां तक जस्टिशिएबल है की ड्रिंक करने के लिए माइनर नही Rush driving ke liye minor nahi Bas jab penalty ki bat ati hai tab minor. Warna is juvenility ki आड़ में ऐसे केस कमजोर होते हैं और प्रमुखता ऐसे केस इसलिए rafa दफा होते हैं क्योंकि rush driving karne वाले पैसे खिलाने में समृद्ध होते हैं। Every law can not be written merely on paper because there are many conditions that decides the case and here principal of natural justice takes place. Where law fails ethics comes. Where ethics fails then morality comes. वरना चाहे निर्भया दिल्ली केस हो या ये केस हो चाहे कितना भी जघन्य अपराध हो बस जुवेनिलिटी के नाम पर रिहाई होती रहेगी और न्याय व्यवस्था पर प्रश्न उठते रहेंगे।

There was part B in section 12 of JJA that the child can be kept with a probationary officer or any fit person...so he could have been placed in remand home or Borstal school under watch of probationary officer or even an NGO who is a fit person under the above provisions...which does not appear to considered by the Hon judge and granted him bail...this is my understanding...pl. comment sir ....

कोर्ट काआदेश है, हॉट को मालूम है की नाबालिक के साथ क्या करनाचाहिए, अगर कोर्ट ने गलत आदेश दिया है तो कोर्ट के ऊपर शीघ्र कार्रवाई क्यों नहींशुरू हो गई, कोर्ट पर उंगली नहीं उठाई जा सकती, अगर कोर्ट ने किसी भी प्रकार की गलती की है तो हाई कोर्ट उसे क्यों नहीं तुरंत बर्खास्त कर जिसने इस प्रकार का आदेश दिया है ,

Under Sec 15 of The Juvenile Justice (Care and Protection of Children) Act, 2015 read as (JJA) Viz., "Preliminary assessment into heinous offences by Board" read with Sec 18(3) of the said Act. Sec 18(3)_"Where the Board (JJB) after preliminary assessment under section 15 viz., for henious offence, pass an order that there is a need for *trial of the said child as an adult* , then the Board may order transfer of the trial of the case to the Children's Court having jurisdiction to try such offences"_ In this case I do not understand why did the Board did not consider him as adult after preliminary assessment and why was he not on trial as an adult. He could have been very well sent behind bars under Judicial Custody (For adults) until the trial lasted and surprisingly he is released on bail. I can state this as a mockery of the system and statute under consideration.
