Almost every police-citizen encounter creates a ‘lawful order’ problem. The uncertainty about “lawful orders” and civilians’ rights during police encounters prompted Orin Kerr to write his now famous “‘lawful order’ problem” opinion. He wrote, "Faced with this, a citizen’s cautious strategy might be just to do everything the officer says regardless of whether the officer’s command is lawful. Even if you’re right that the order is unlawful, the officer may not know that. You might decide it’s better just to follow the officer’s illegal commands than to be arrested and spend the night in jail out of principle." The problem few legal scholars admit is compliance often leads to spending the night in jail 'out of principle' of cop’s ego. Police, DA’s and judges all know the financial and social cost to precariat’s for malicious prosecution under nothing more than fabricated ‘contempt of cop’ laws that don’t exist. The deprivation of an individual’s rights by cops under color of law is a crime few prosecutors are willing to pursue. It's part of the prison for profit pipeline that small town nepotism and corruption benefits when cops abuse power because they know, “you may beat the rap but not the ride”. That's the result of a law enforcement system that lacks transparency and accountability and creates complications in vagueness challenges. "Neither state laws nor federal regulations define the term “lawful order” even though it is a crime to disobey such a command." But what they do define is that the public should know the law. "If an officer walks up to you and gives you an order, you’re “presumed” to immediately know every area of state and federal law. And on top of that, you’re presumed to know all the facts known to the officer that the officer won’t tell you." It begs the question, "isn’t a law punishing me for failure to obey an unlawful order unconstitutionally vague?" “It is hard to imagine a more stupid or more dangerous way of enforcing law than by putting those decisions in the hands of cops who pay no price for being wrong.” #EndQualifiedImmunity

I don't think this young lady has an attitude, nor did it change when her father got on the phone. Obviously she knew she could call her dad in this type of situation, so why would it change!?!?! Now this cop on the other hand... his attitude is exactly why he was having the day he was having. Have the day you deserve Officer Lee. 😐 ✌

It's been that way for years with Daytona Beach Police department I used to live in Daytona and got pulled over and they talked to the citizens horribly
@twoblacklabs904 Жыл бұрын
Like Las Vegas cops, they falsely believe everyone’s from somewhere else, and they want the word to spread that their bullshit tourist town is “tough on crime,” and police the citizenry with an iron fist, so the word spreads among their friends who may vacation there in the future. It’s public relations GARBAGE, pure & simple.

Officer Lee, sounds like he may have been on a little, something something. His attitude was absolutely terrible. There is no law or penal code, that says, you have to roll your window down all the way. Then, this arrogant uneducated fool, said he’d arrest or give her a ticket for “obstruction”!!! Officer Lee, you are unfit for policing, go get another job!!!! Thanks for the video sir.

I have long said, given my "training and experience" as a former LEO, NONE of this is allowed unless ENCOURAGED by the very top of the administration. The simple allowance of this without repercussions IS encouragement. It has become a HUGE cultural shift in policing. It is why I had no choice to leave. So sad.
