Since A is governed by the law applicable in Delhi, on a notional partition as mandated by Section 6, HSA, the intestate A, his father F, his mother M, his brother Br and his sister Sis will get 1/5 share each. 2. Now A's share will pass through succession. Since A diedleaving behind class I heirs, his share will go by the ruleslaid down in Section 8, 9 and 10 of HSA. Therefore, A's share(1/5) shall devolve on his class I heirs- M, S and D in equalparts as follows:- S = D = 1/15M = 1/5 + 1/15 = 4/153. S has a coparcenary comprising of SW, SS and SD. His sharewould be divided in this sub-coparcenary as under:- S = SW = SS = SD = 1/60 Similarly, D has a coparcenary consisting of DD and DS.

given the second part of first question: what would be your answer if A Died in 2001? how would A's sister (sis) be entitled to the share of Ancestral property? as before 2005 daughters were not considered to be coparceners right so in 2001 the coparcenery share would be 1/4th right , during Notional Partition?

Ma'am, The 1/15th share that S got in the partition, will not be his "Self Acquired" Property? I thought S's 1/5th will be divided among W, SS and SD in 1/45th as per succession. Because 2005 amendment Section 6 states property to to devolve by testamentary or intestate succession. Please clarify? Thanks! Also CWT v. Chander Sen states it will be his separate property.

Exactly the same doubt. 1st partition among A, M, F, BR ,Si. Second partition between A, S and D of the portion that A got through the above partition. Third by succession between M, S and D ... That's how it should be

As far as i know, the notional partition doesn't change the nature of the property, the property would be separate property for other collaterals but for lineal descendants it would be coparcenery property. It has to be divided between the lineal descendants as well to get the separate share. Correct me where I am wrong.

2nd notional partition second generation aur third generation k bich hoga {A,S,D (agar S ki mother hoti to usko v ek share milta)} 1/15 each. Ab 1/15 of A’s share is his separate property which will desolve on class 1 hiers(S,D,M)……Yaha mistake hai
