The car accident story when the guy told on himself in court reminds me of a friend of mine and her ex. He was trying to have her arrested for assault, and then openly admitted in court that it was because he tried to basically kidnap their son. He actually told the judge that he was trying to take his son, whom he can only have supervised visits with, home with him because he didn't like paying child support. Dude lost visitation.

Sadly UPS in the UK did that to me for a £1000 tv that I paid £80 shipping for, and then claimed it was MY fault it arrived damaged, the tv was smashed literally in middle and it was a metal and glass tv not a modern led tv! and kept making excuses, I never got chance to take it to court due to other reasons so lost over £1000!

The UPS story reminds me of a problem I had years ago when I ordered a BBQ replacement part that had to be imported. The first time they tried to deliver it they were requiring a $200 import fee on a $30 part. This seemed crazy so I asked to the customs paperwork. They claimed it was a $770 flamethrower. Firstly, I don't want to spend $200. Secondly, I don't want the government thinking that I'm importing flamethrowers. I refuse delivery and send it back and tell them to figure out their paperwork. The next day they try to deliver it again with the same paperwork. Again, I refuse. They repeat the same thing two more days. He next day the driver just drops off the package and leaves. A few days later I get a letter requesting payment plus another service fee. I email them and explain that I'd be happy to pay the correct amount once hey figure it out. I didn't hear back from them for over a year when I go another letter from them. This time I phoned and spoke to their collections representative. The representative old me that they had already paid the government the import duties and they had no method to claim them back and had no way to determine the correct fees. They suggested I just reimburse them and attempt to file a claim with customs. I laughed at them, pointed out that I have documentation to prove I refused delivery and suggested they start listening to their customers. It was a small victory.

Closest I had for that was ordering a £400 item and panicking on the potential customs costs, the driver handed it to me without asking, but a year later the courier company demanded payment. I wasn't sure what to do and also the item was returned anyway as it was faulty after all that.

the scammer in the first story reminds me of a guy that run over my grandma while she was on a bike... well more he pushed her. She was in a lot of pain but mr was in a hurry and he had important business so he told her she wasnt injured, she'd be fine and left her his card and drove off. When she had to go to the er and therefore press charges he claimed that she was fine and that he saw her bike away and there was no way she was injured enough to need to go to the er... what he didnt realise is that her bike was so damaged there was no way she could have biked away.. he got charged for running away and for non assitance to an endangered person because he left a 75yo woman in the middle of nowhere, not even knowing if she had a phone... she had a broken arm, bruised ribs, busted knee and a concussion.. luckily she had not forgotten her phone for once and was able to call my mother or else who knows what would have happened.. Oh and the sweetest part is because he was responsible for the accident and ran he had to pay for whatever fees wasnt paid by social security, pay her wages (she was still working) and had he not ran away this could have been concidered a work incident for her and the social security would have had to pay all this..

Hijacking this comment to tell my own emberassing car ding story. I wanted to open the passenger car door, in the good mood that I was, I opened it quite swiftly... ... and banged it HARD against a really small metal fence thingy that was about 30cm off the ground. The car I did that too? My bf's (at that time, now ex) car, that he loved, while I stepped into that car for maybe the 3rd or 4th time. We parked there together. I opened that door like an hour before that and DIDN'T ding the door. I REMEMBERED the fence like 5mins prior to that. The only good thing was that the metal hit exactly where the plastic bumper stripe was on the door, so the damage was minimal, but I felt so stupid and my ex was so mad. Breakup was like 9 months later due to unrelated stuff lol.

Other lawyer was probably just shit and didn't request the document. Since it was only the contract that would need to be brought up, very easy for a shitty lawyer out to scam people to not realise that its listed and then not request it. Discovery isn't "Here's a copy of everything we have" its more a "Here's a list of what we have and plan to use, would you like to see any of it?". Some documents a copy cannot be made and as such you organise to see it in person while monitored.

I don't know how it works in USA but most of the time here where I live police won't even bother to come at the scene unless someone is hurt or aggressive. Usually it's best just to take plenty of pictures, write a document on scene explaining the accident and get both parties signature on it.
@survivedandthriving
@survivedandthriving 2 жыл бұрын
Like with @Varma Krapula, where I live (not the US) the cops only come if someone is injured enough to go to the hospital (and probably also if someone at the scene is dangerously aggressive). We just need to take pictures of everything and exchange information with the other people involved. BUT it is important and wise to report the accident immediately to our insurance company and to go and make a report at the accident reporting centre (the police). I think these reporting systems might now be possible online? (I haven't owned a car in a while, and it was a good long while before that since I was in an accident (I was rear-ended at a stop light so totally not my fault), but I think someone told me we can report online now. Either way, it is important to make a report of what happened with the insurance and the officials. Bonus: the scammers generally fail to make these reports and that tends to count against them if/when they try to scam for more money.

The bailliffs had gone not to one of the banks, but rather the main office building in the UK. Barclays still wouldn't pay up so the Bailliffs started listing property which they will take. Computers, desks, chairs etc. In the end a dozen or so high ranked staff members started paying the bailliffs off their own personal credit cards. The amount came to a few hundred thousand pounds.

In regards to Story 1, my brother once got into a minor fender bender. He was going 5 mph and rear-ended the other person because he had a sneezing fit. Even the cop who responded to the call considered it the literal definition of an accident. Well, the woman tried to make our insurance pay for previous damage to the car, such as the ski rack ON TOP OF HER CAR! Obviously, that didn’t fly, and our insurance paid out for only the damage my brother caused. In regards to Story 2 (or Story 3, if you count rSlash’s own story as being Story 2), I’ve known FedEx to manhandle items marked as fragile, resulting in damage, but rarely from UPS; the recent story of hundreds of FedEx packages being tossed into a ravine because the delivery driver was “going through personal issues at the time” (seriously, what a lame excuse) particularly comes to mind. On a personal note, I have bought valuable statues of video game characters from UK/Hong Kong-based First4Figures, and FedEx is the company they contract with to ship them. My statues weren’t damaged, but I’ve seen photos of fellow customers (we’re all part of a Facebook group) who were not so lucky. Usually, UPS is the better shipping company, from what I’ve heard, so it’s a bit surprising to see this.

Honestly UPS is the most shit company. I remember my mother buying a brand new surround sound system & it was shipped by UPS. Now we don't live in the best neighborhood but it's not the worst either. On the day our package was supposed to arrive we get a knock on our door. A woman asks if we ordered a surround sound system & I looked at her confused & said yes. She said it was delivered to HER house TWO blocks away. The street names are nothing alike. Let's say our street is called Eagle Ave, they delivered it to Mill Ave. I walk over with this woman to her house to pick up the box. She tells me she has no numbers on her home indicating what the house number even is. Furthermore the people who sent the system didn't even put it in a brown box. It was sent in the store packaging with pictures of the surround sound ON IT. God forbid this lady wasn't a nice person she could've just hauled it into her home & UPS wouldn't have done jack shit about it. They most likely would've tried to blame US if it were stolen when THEY delivered it to the wrong house. Yea, we don't use UPS anymore & we try not to order from companies that use them.

For many, many companies, it's not. They pay or refund or just generally bend over backwards to keep in your good books. It's much appreciated when it's done, and I try not to abuse it when I find a company willing to do that. They'll sometimes suck it up and make nice even if it's your fault, which I've always found kinda sad. My parents always taught me to pay for anything I break but I've broken a few things in stores and had them refuse to let me pay for it. I only manage it if I sneak the product through the checkout! Weird, I know... but it makes me feel better and sometimes I can fix the broken item so it's all good.

it's actually hilarious that you dinged the car. Our brains work very interesting, so whenever you don't want to do/think of something, you brain doesn't process the don't part. You have to think of an action to avoid something like that. Like be careful/cautious of the other car. This is also great for teaching children. If they are doing something negative, it is good to let them know that they should do something ELSE instead to avoid that behaviour for example. Instead of... don't step on Emma's art work on the floor, say please be careful around the artwork so we don't step on it. :) Positive reinforcement! This works great with talking to anyone imo.

Depending on the consequences, I allow my kids to take the action and be annoyed that the consequences happened. Then I ask them what they learned. Example: My Driver's Permit Teenager backed up to get in the road and accidentally side swiped our good car (my fault because I wasn't paying attention to her actions and she's still inexperienced....damage is maybe a few scratches). I instructed her to move forward while I controlled the steering wheel to prevent further damage. She re-did the maneuver and safely got out. My response AFTER we arrived at our destination on time: "What did you learn?" (She gave incorrect response but I told her to check her mirrors. I'll remind her later today.) It's the second car she hit while learning. The first one was also parked so I showed her how to handle it properly (didn't call police....just took lots of pics, left our insurance information, and my personal phone number). I remind her all the time that while I may panic, she is in control. I want her to work through my panicking now and make all the driving mistakes she can now (within reason) so that when things happen while solo driving (or a stupid passenger is just screaming at you due to what they perceive as a dangerous maneuver but isn't....long story...I refuse to drive with that passenger), she has a developed instinct to remain in complete control with confidence. Also to not panic and properly respond when she does cause an accident. I didn't get any of those experiences and had very little support on what to do when they happened to me. I was lucky that drivers (and one police officer) around me were patient enough to explain some things to me every time something happened whether it was my fault or not.

Long Story if interested: There I was, in a carpool (3 generations of family members, kids were 3-8...I'm "JJ", Grandma is in seat just behind Driver and Shot Gun, Hubby is in Shot Gun seat) driving a van from Florida to New York, every adult taking turns. It's my turn, dark outside, traffic is heavy but moving, and I'm zoned in and focused heavily on the driving task, actively avoiding distractions. I got the car on the highway (just after taking over driving) and am looking for a rhythm so I can relax a bit. The right lane is going 20 under the speed limit, the center lane 10 under, the left is consistently going faster than the center. I get us to the center and I'm trying to get to the left. The cars in my lane are speeding up, slowing down, speeding up, slowing down with about 10 mph upper and lower range and I'm trying to find a consistent speed to get out but not have to break too hard and too often. Had a good buffer in front of me for my take off and FINALLY found an opening to safely merge into the outermost left lane that I was confident enough to take. I press the gas, speed up, knowing the truck in front was breaking but I had enough safe distance to either go faster or safely slow down without hitting it. I was 80% confident my left blindspot was clear and I could move over safely without slowing the approaching left lane car too much. Maneuver and actions in progress. G-ma: (Yelling in quick succession) "JJ! JJ! JJ! JJ! JJ! JJ! JJ!" 5-10 Second Timeline Events (TE): ~G-ma does this shouting while I remain calm, observe, look for what she's trying to communicate, and re-think all my safety thoughts and ultimately abandon my maneuver in favor of a hard but safe slow down.~ Me (during TE): (I'm thinking "What's going on? Is there a driver in my blindspot?") ~I try to speak through shouting~ "What? What do you see? What's wrong?" ~After TE, we're slowed down, I'm stuck behind a slow truck in the center lane calming down but highly annoyed at the missed opportunity.~ Me: "What was wrong? Why were you shouting like that?" G-ma: "Didn't you see the truck in front of you? It was slowing down." (I don't remember the exact dialogue after this so I'll summarize.) Basically I explained I knew it was there and I was trying to get around it. Her shouting did not provide me any information and could have caused an accident. Hubby took her side because he couldn't read my mind to know my intentions, only my actions. We got off the next exit. He and I loudly argued semi-privately in the gas station. H: If it was safe, why didn't you do the maneuver? Me: Because your mother was shouting at me and I didn't want to risk hitting someone I might have missed seeing in my blindspot! She communicated NOTHING to me. JJ! JJ! JJ! tells me absolutely nothing about what's going on H: I saw my life flash before my eyes. You almost hit that truck. More discussion followed and ended without resolution and he took the wheel for the rest of the distance to our destination. According to their actions and attitude, I'M the useless one who couldn't contribute because I'm supposedly incapable of driving and I have never received an apology. My teenage daughter remembers it from 10 years ago and is the only one to take my side when she was old enough to understand what exactly happened. Moral of This Story for any Vehicle Passenger: DO NOT YELL AT THE DRIVER FOR ANY REASON! ESPECIALLY NOT THE DRIVER'S NAME OR SPECIFIC ACTIONS YOU DESIRE OF THE DRIVER! Only exception I can see is if you truly don't trust the driver. Calmly ask the driver to safely pull over and stop. If the driver does not comply, slowly escalate to as little yelling as possible for the least amount of time as possible. If the driver still does not comply, calmly let the driver know you're calling 911 and get the police involved (then do so unless the driver stops to let you out).

It's true. I visit schools in the region for enrichment activities. Whenever the teachers send students to help me carry in supplies, I try to avoid saying 'don't drop this' because, as you noted, or brains ignore the don't. Instead I try to say something like 'please carry this securely using both hands'. So far, so good.

On that second one, UPS SUCKS. They left a power supply I ordered in a PUDDLE when the rest of the porch was completely dry. They also don't like to stay for things you need to sign for. So they'll ring up to the elderly man on the third floor of our building, then immediately turn around and leave instead of waiting for him to come down the stairs. When I tried to complain, they said I can't complain on someone else's behalf because I don't have the tracking number.

You forget that when the Sheriff and bailiff arrives at the door to execute that order, they already owe the fees for that service, and also that already there are auction fees and storage fees tacked on in preemption of this being done, so now the original sum is more than doubled that they are there to collect, and they will not leave till, in their eyes, either they have goods that will cover the cost when they are auctioned off (which often is for less than 10% of the original cost at these auctions, no reserve), but if the auction does not gain enough to settle they will return, with yet another set of fees, and take more to settle this. Plenty of shady people in this line, and often they will deliberately reduce the value ( chairs missing an arm, desk with no drawers or keys, computer with missing case parts, no leads, no keyboard mouse or hard drive) for stuff they want themselves, and get for either a tiny price or for free.

I had someone try to scam me once when they hit my car. They started screaming about whiplash, suing me, etc., etc. I said: two problems i) we're in Canada that whole 'suing thing' doesn't really work like that here; she's been watching too much American TV, and ii) I have insurance, here's the information have fun dealing with their assessors and legal people - I pay premiums so that they can deal with people like her. I didn't say iii) if someone is crying whiplash at the scene then they almost certainly don't have whiplash (you usually don't feel it until the next day). I figured the insurance people would have seen that scam before and there was no need for me to educate the person trying to scam me. I also went straight away and made an accident report with the police. (where I live they only come to the scene if someone is injured enough to go to the hospital). I never heard from the woman again. Either someone talked her out of her scam or she found out from the insurance people. My car had no real damage to it so I didn't even file a claim.

13:24 I have a story about delivery companies... First off, I have a great Dane mastiff dog. He's a year old and over 160 pounds. And he's terrifying. He is a giant slobber monster with a giant scar on his leg (from a snake bite). He's also accompanied by a tiny 6-week old heeler puppy that isn't tall enough to jump on the couch. And this delivery guy has a package in his hand, looks at my great dane in the yard, and TEASES him with it. He teases my dog (who wants to bite his arm off because this guy is LEANING OVER THE FENCE), runs up and down the fence line, then THROWS the package, which was an expensive peice of technology. While the dog is distracted with tearing apart the package and I'm running out there in my too-small shirt and sweatpants, the delivery guy books it. Great times...

Which we didn't it was just the sound of my dad's trailer clanking around and made it sound like something was getting scratched. If UPS had to pay back damages for every damaged product they delivered they'd have to shut down. If ya'll get PO'd by the delivery drivers manhandling your packages, never go into one of the Warehouses. THose people dont give a sh*t about your stuff, and UPS will never do anything about it because then they'd have to admit there was a problem. And we all know big businesses like this won't admit their problems anywhere people could hear them because it costs less to ignore them.

Stupid car stories: last year after a very long day of work my friend insisted we drive back that very same night, because he wanted to get home to his girl. I said I was really tired and not fit to drive, and he said he'd do it, just let him get a feel for my car in the parking lot. Well, he got in, checked the mirrors, adjusted the seat, made sure everything was in order like a good boy, and immediately started backing up at full speed until he hit the single car in the whole lot- the security guard's car. Dude didn't earn a penny for that job because it all went to car repairs. And I don't let people drive my car anymore.

In the UK you can't force County Court Sheriffs/Bailiffs out of your property when they are enacting a court writ of property seizure/getting a payment on a fine/enforcing a court order. To even try will mean they will find themselves in jail awaiting to go in front of a judge. If you call the police on them, the police will side with the County Court Sheriff's/Bailiff's. You either pay up or allow them to seize property to be sold to pay the fine/court order. There are no other options, when they turn up and your name or company name is on their documents.
