The difference between both cases between the first and second is in the 1st case your primary intention is to save the 5 and you ignore the other person, you can pretend not to even seeing him, the second is that in order to save the 5 you have no other choice than to focus your intention to sacrifice the one, but in both cases is the same and I think that both should be responded to the same, if you let things happened than you are innocent of any wrong doing it's something that was beyond your hands, but then if you chose to save the 5 and kill the 1, then you are making a decision on who should live and who should die, and who are we to decide that?

The difference is that the single person in the second case was never in any danger. You had to put him in danger. But debatable bc he was never in danger in the first case bc the train was heading the other way.
