@marqueizel You’re totally wrong. Donna shared an important piece of information by mentioning Jessica’s investment in Harvey, but that was not enough for Rachel to make a convincing case. What’s interesting here is how Rachel was able to build on that element to dig further in the history of the firm in order to develop a strong line of negotiation, using effective persuasive argumentation techniques to meet her objective. That’s what impressed Jessica and Harvey. Donna did not do the tougher job. Like @ghstking6838 said, the show is riddle with epiphany moments triggered by interactions similar to the Rachel-Donna chat about Louis’ betrayal. It’s not so much about how you get the info/thought, but how you use it to solve a problem.

@@TheMigider ok so it might be a comment not an argument. I felt that Jessica was trying to say something like “hey Rachel you cannot use uncommon knowledge in your argument, so, according to the firm’s records, no one was paid for law school until this day” and that Harvey’s confirmation before the leading partner and an employee would make this uncommon knowledge to be common and official. It's not all it's cracked up to be. Whoever has the financial backing to push the most paper wins. The courts are bias to what benefits their payroll. Most all lawyers are corrupt - triple billing for the same hour of time, not telling clients critical information that impacts how much clients get out of settlements, creating evidence, unethical hiring and firing practices. And you come out arguing for a living with no guarantee that all the money you sank into putting on your client's case will render you a verdict or judgment in your favor. And don't get me started on the tuition debt you'll spend decades repaying if you aren't related to Daddy Warbucks while all these realizations come to light. Only the very largest law firms consider even contributing to law school tuition. Oh, and then there's the public image and divorce rate of lawyers. Think again.

This scene affirms what i said all along about Harvey's idiotic decision to bring mine in as a fraud. All he needed to do was bring him in as a fu¢king paralegal! This would have legally resolved every single issue both personal, and professional for all involved. While it is easier to get up paralegal position with a degree, it's not required in any state including New York. Yes,a degree or certificate is "preferred" and "suggested" but not required. So if Harvey just had a bleeding heart for Mike, he could have hired him as a paralegal which at a firm like Pearson-Specter would pay pretty well. In addition, Mike's supposed "genius" would still have been at the firm's full disposal. He could be doing the following- *Conduct client interviews & general contact with the client. *Locate and interview witnesses. *Conduct investigations, statistical and documentary research. *Conduct legal research. *Draft legal documents, correspondence and pleadings. *Summarize depositions, interrogatories and testimony. Attend executions of wills, real estate closings, depositions, court or administrative hearings and trials with the attorney. Author and sign correspondence (provided the paralegal status is clearly indicated.) So his skills would still have benefited, they still win all of his cases, and nobody is on the hook for anything. AND THEN, As Harvey knows personally, the firm will pay for law school for the right person. Yes, the series would be less dramatic, but someone with Harvey's supposed intelligence would have known this path existed right away and not constantly risked his firm, his license and that of everyone else in the office, and Mike would have never gone to jail.
@mitchellely65682 жыл бұрын

"Make sure to have all signed or recorded" You will think that is that easy. Well is it not. All depends in the situation, for example doubting a persons' word is equal to distrusting them, making the relationship turn cold, and having that cold relationships with clients or other people makes the day to day work difficult. Consequently, the more dependant a work enviroment, or situation is on soft skills the more difficult might be to make someone sign a contract or have it recorded. Also, take into account that making a record unilaterally depending on the country or state is illegal. Furthermore, the situation is even more complicated depending on the leverage you have for it to make it happen, and threatening a legal action can break relationships in a hard way, therefore anything related to a legal situation can be viewed as the same thing. US does have a culture of suing for everything, but even then that is situation dependant. Just try to work again in a bussiness you have sued, or try to remain in the same bussiness you are suing if you already work there.

No one gives credit to the awesomeness of Donna in this scene. She clearly is the source from whom Rachel came to know that Jessica paid for Harvey's tuition.

Yes, but that was not enough to make a whole convincing case using effective negotiation techniques, which Rachel did. The show is full of interactions where characters use or act upon something that someone said to solve an issue they’re grappling with. It’s part of the show makeup. What is interesting to observe is the strategic thinking process from the moment the idea germinates in the head of the character who hears something to the outcome. Donna has also been on the receiving end of someone else’s thought so there is nothing wrong with acknowledging Rachel prowess in this negotiation.
