I'm surprised no lawyer has sued the state for the 4h amendment violation that this clearly is. It's funny that the Terry case law that's often cited in the city by the police is actually what prevents them from doing this. Terry v Ohio states that an officer is allowed to detain, frisk and identify a person whom they have reasonable articulable suspicion is about to, has, or is commiting a crime. So what it also inadvertenly states is that if those circumstances aren't present then they have no right to identify you. This means that the act of wearing a mask and not identifying yourself to the police can't be the primary reason for why they detain you but rather there needs to be another crime for which they have RAS before they can order you to identify yourself. Now i'm referring to the mask rule imposed by crane. They did have RAS in this specific situation because he was leaving a shots fired scene, but him offering to be GSR tested would technically have dispelled their suspicion so i still feel it could be fought in court.

If crane says you can stop, identify and frisk anyone with a mask then it's not a violation of their rights. Even if all they are doing is wearing a mask. There are Dozens of cases that went to court where people like Wrangler started with just the mask stop and frisk and got to DT and it was found guilty.

@@wavemoon The reason there are cases where wrangler started with the mask detention and ultimately won the case is because no lawyer brought up that it's a 4th amendment violation and that all relevant case law, including Terry v Ohio which is recognised as relevant case law in the city, supports that it's a 4th amendment violation. In order for an enacted unconstitutional law to be overturned a lawyer or person actually has to bring a case where the argument is actually laid out with all relevant case law presented before it can be taken into consideration, and so far nobody in the city has done so. This is something that happend regularely irl and is built as such to prevent tyrannical laws from being enacted.
