I guess if you are a lawyer you have a better understanding of the law than most of us. I don't think anyone siding with Rattle even remotely claims to be a lawyer. This is just simple entertainment for most of us. I find it hard to believe anything Rattle did ever affected Sean's personal dealings or image more than a second glance. Slander this or slander that.... I don't even care about Sean or any of the ppl on here doing potentially nefarious things as it has no correlation to my life at all. If anything it will rely somewhat on people in the know coming forward to testify on both sides. Now when anyone searches sean's name or business on the internet 20 videos pop up saying he is a scammer which severely damages his business. Not to mention the harassment from rattle's double digit IQ goons. He is likely going to get creamed in this lawsuit and have his wages garnished since he has nowhere near 2.5 million. If he somehow wins the lawsuit he will likely have lost hundreds of thousands in lawyer fees which is money he does not have. Win or lose he is more than likely screwed.

I do have a question. In the lawsuit he does claim that Rattle is mentally ill. Can rattle turn that around on him since he is not a mental health physician to diagnose something like that?

It depends on (a) the quality of the representation, (b) how long the lawsuit drags in procedurally, and (c) whether Rattle gets anti-SLAPP protection. So, it's difficult to estimate. My guess is that at the first stage, at least several thousand dollars. But I'm not sure because there are a lot of factors involved. Maybe I'll dive deeper into this question for a future video.

The key is going to be SHAUN proving beyond a reasonable doubt. The burden is on shawn, not rattle. The judge is going to be pissed shaun is wasted courts time. Also shaun on slippery slope if district attorney gets involved......shaun opened a can of worms on himself. ❤

Thanks for watching. but, to clarify something, the burden is not beyond a reasonable doubt. In a civil case, the burden is a preponderance of the evidence. The DA has nothing to do with the case because this is a civil case. It's not illegal to sue someone (even if the lawsuit is poorly supported).

Go over trademark laws and how all pokemon youtubers using the name "Poke" or "Pokemon" in their own business dealings are definitely at risk. Lets hear it cant be biased now can we? Also profiteering off said trademarked name. I want to hear your input.

I need to look into it further, but... In trademark law, you're generally at risk only if there is a possibility of confusion. Nobody is going to get confused that I work for the Pokemon company or something like that or that I am the manufacturer of Pokemon. The risk on this end is low. And even if Pokemon wanted to enforce the trademark, they would almost certainly send a demand letter first before actually litigating the issue. *This is not legal advice*
