arresting officer gets an A from me. I don't know anything about the law but I do know from a public perception stand point this video is exactly what the police need more of to help change their overall imagine as of late.

Unfortunately cops still have qualified immunity and never really see the consequences for their actions. Even if the department this guy worked for fired him he could go one town over and is right back to being a cop again. There’s really not accountability here.

@@Super.Deluxe1 there really should be. Best way I can describe the bad cops. Rogues with guns whose only goal is to erode the trust of the public. When put in terms like that, one could possibly see the potentially that maybe they are trying to sabotage the government in hopes of causing an uprising to prevent the government from carrying out its functions and from sending aid to allies (Ukraine). They like to toss allegations around at everyone they see, and I think my allegation of them being saboteurs trying to create distrust of the government is rather spot on. Which I would say is technically me calling them out for committing treason.

Yep. She gave a B to that officer who arrested her ex or whatever and didn’t follow any procedures. This guy didn’t follow it down to the last detail but his arrest was quick, didn’t succumb to the pressure.

Tristan giving the officer a B rating because he wasn't more lenient because "it's only 4 blocks" is absurd to me. The Captain was TRASHED and should NEVER be behind the wheel for any amount of distance. If it's truly 4 blocks, WALK home. Would you feel that way if he crashed and/or killed someone? Absolutely ridiculous coming from a DUI attorney! Be better.

Agreed, he should be less lenient for driving four blocks while that drunk because he COULD easily walk home or get a quick ride. As a Captain of an Investigations unit in a larger city he would have encountered the bad result of people driving drunk like he did so it's even more unreasonable for him to get a break. Not to mention that's only if we're taking his word. Could have said 4 blocks, but in reality it was actually 4 miles.

Honestly, driving 4 blocks drunk is worse than driving a long way, because he could have easily walked instead of putting other peoples lives in danger.

As a resident of Oklahoma, I can a test that here in Oklahoma if it is readily apparent the driver is intoxicated and the driver has admitted to being drunk the field sobriety test becomes a formality and as such the explanations of the tests and the typical procedures are not required to be followed to a T. For us here in Oklahoma the reason this was as big of an issue is due to not only Capt. French's request to have the body cam turned off but also due to Mr. French speeding and swerving while driving an unmarked "City Owned SUV" (essentially an unmarked cruiser). Edit: plus here in Oklahoma we have a pretty sad history of officers giving other officers "professional courtesy" when said courtesy is a detriment to the entire police force and in turn has given the residents of OKC a bit of a sour taste in there mouths.

Plot twist. The captain retired with a full pension and the Sargeant was let go for over use of force in a previous case.

The casual acknowledgement of how you don't blame the captain for initially trying to get out of it, even going so far to admit that you all may have done the same thing, caused my respect for all of you to skyrocket. I think that while police do have a higher standard of ethics to uphold, much like all public servants, people tend to forget that they are still human. If they strong arm or act belligerent about it, obviously they are in the wrong and should be punished. However, that first act of trying to get out of it is just a human response. They should absolutely NOT be allowed any leeway, but they're not the demonized versions of themselves that many make them out to be. I just thought that one detail was really nice and human of you all. I love this channel, definitely have a new subscriber! Can't wait to see more reactions in the future :)

In school I learned how to make 3 different kinds of nutcracker but I never learned that I can refuse these tests. I got a DUI on a bicycle in uni altho there is no legal limit in my area. You have to be visually impaired to be stopped and the cop even admitted that I looked sober.

I’m a retired police captain and have only been stopped once since my ‘97 retirement. It was a speeding violation that I admitted to, was given a warning and let go. When asked where we were going I said to a family funeral (true) and I’m guessing the officer didn’t want to make our day any worse. The fact that I was a retired LEO never came up.

I think maybe the arresting officer was trying to throw the investigation to give the captain a fighting chance. I wish we got to see the events at the station and the breath analysis (if he blew). With that being said, I think the captain's speech, performance, etc, he will have a hard time.

Reminds me of a story years ago in Chattanooga, TN. Sheriff from a local county was caught reckless driving and pulled over. My friend was the investigating officer. Sheriff was so passed he got pulled over he shoved the officer into oncoming traffic. He resisted arrest and was injured in the process. Media initially ran with police brutality story until the real info came out. Sheriff was not elected again.

Great videos guys! I just started watching your channel and it is now a favorite along with Audit The Audit. Please make more content!!! Unfortunately I think something more nefarious that you mildly addressed. The police officer never properly disclosed the right to gain approval for a field sobriety test. I believe this was done on purpose to potentially get thrown out by a lawyer. The cop saved face by continuing to record but you would think any field sobriety would require proper disclosure especially from a trained DUI officer. My spidey sense didn't like that part. From a defense attorney, could this case get thrown out if he never obtained consent for field sobriety???

In Illinois, it is not required that an officer give warnings or obtain verbal consent prior to administering field tests. What the officer did here is totally accepted by the courts. It is up to the driver to know their rights…which is why this channel exists. Of course, some states might be different. And here in IL there are different rules if it’s a cannabis DUI. But the big lesson here is: The cops don’t need to tell you the full truth. In fact, they don’t have to tell you the truth at all. It’s up to you to protect yourself.

I'm in Valparaiso, Indiana and travel to Illinois frequently so your case law on Illinois is nice to know! I thought there was something nefarious because all 3 of you had agreed about proper protocol into getting a field sobriety test (asking for vision impairment, etc). What would you, as a defense attorney, state about the officers use of the test as you guys had mentioned? You had mentioned NTSA guidelines and "very specific guidelines" an officer has to give.

I wish someone had addressed the officer turning off his body cam at the end. Presumably you did not comment because it was totally per protocol and legal. But did his official report of the incident include what the captain spoke to him about? What was such a big secret between them?

Wdym what was such a secret? He wanted to camera off so it would be easier for him to get a pass. The officer still had to file a report since he stopped and probably called it in already. If he turned his camera off it would be easier for him to falsify a report because there's no footage to say it's falsified.

They are waaay to nice to the police chief! "I would've done the same thing?" Asking the cop to turn off his camera?! Possibly coercing the arresting officer to commit a crime, violate police policy, or at the bare minimum disregard any moral values cops should stand for? What the actual f..?! They gave this guy an A or B for doing the bare minimum? For not committing a crime? I'm a law student in Europe and letting another cop off the hook just because he's "in the same gang"? That would be highly illegal!

19:40 i think he messed up because he was just really pissed off, which makes the mistakes that he did make completely understandable since it looked like he was rushing to get it over with and he knew his body cam had enough for a conviction. with that being said i would give him an A+ from the point of public perception which is extremely important, and an A- for like actual dui investigation, since the body cam spoke for itself

It could be argued, that not being a regular member of the public, but in fact a captain, he already has the knowledge about the task, and his option to not participate. No jury on the planet would be of the opinion thst he does not already possess this knowledge, and there is absolutely no point in providing him with information that he already possesses.

I had a relative who was a judge in a small town not far from Chicago. He had 2 DUIs. The local cops knew his car, and ended up not pulling him over again. If they didn't pull him over, they couldn't give him his 3rd. After his alcoholic wife died (a long, painful fight with cancer), he lost the "functional" in "functional alcoholic". The lawyers before him were the judge, and even covered for him. He was sleeping on the bench, showed up to work drunk, and drank on the job. But the police knew the situation, and let it slide. Until one night. He drove his car home from the bar. He made it as far as the dumpster in the parking lot of the bar. After smashing into the dumpster, he walked home. This wasn't the first time. And the cops were going to wait until the morning to show up at his home to ask him about it. Well, with everyone trying to cover for him, he had to double-down on stupid. He walked home, was "safe" and chose to drive back to the scene in his wife's minivan. The cops on the scene recognized his car, knew what happened, and were treating it like a joyride gone wrong, or something that could end up letting it slide. But on seeing the judge drive back to the scene, and he turned around in the parking lot and was recognized. They waived him over and he did get his 3rd IL DUI (felony), and resigned shortly after he was charged. If the bar was close enough that he could walk home after crashing, why didn't he walk home before he crashed, rather than just walking home? And of course, the choice to go back. And all the other bad choices that got him there. I have literally walked to that bar from his house before. It's literally the "4 blocks" the police captain asks for special treatment in this video from.

IDK the time frame for DUI charges, but I tried googling about the guy and haven't found anything about if he was convicted or fired or anything, the only information was from right after the arrest, stating that Matt French was suspended with pay pending both the charges and an investigation. Also re: saying that the arresting officer could have just told him to make better decisions and let him go, it's bullshit how often cops get away with breaking the law because they *know* they have to fuck up big time for them to face any consequences, it's their job to enforce the law, this mother absolutely needs the book thrown at him. Cops should be held to a *higher* standard when breaking the laws they are supposed to enforce, not lesser

Anything could have gone down. The officer easily could have thrown the fight in the CPT's favor. It's such a winnable case. CPT's biggest problem if I'm his chief is his attempts on the roadside. I'd let him retire if his record is otherwise okay. If not I might go after him.

It's strange to me the thought that we should applaud the officer for doing his job. The officer and especially the captain should be acting in a manner that is beyond reproach. Public officials need to be held to a higher standard.

Officer didn't ask if he consented to the tests. Also standard procedure wasn't followed. Cop could be doing these things to provide some level of defense.

Bet you all his buddies who played poker with him were also pissed drunk and all drove home too, the judge,dentist,attorney .disgusting, just imagine how many times this guy has got away with it,and even if he killed some poor guy by knocking him off his scooter or bicycle ,his blue line buddies would still defend him or swipe it under the carpet. the BWC deletes the intimidation as long as it does not get lost or destroyed by accident . good job officer because he was obviously wasted and there is no way any police union or attorney can say otherwise.

I suggest most people at some point look up calculators for BAC. Especially if you're skinny and/or female, you'd be surprised just how quickly the legal limit comes up and how long it can for your metabolism to lower your BAC back to legal levels. For a 120 lb woman, it takes around 6 hours to be able to drive again after just 4 beers. It's just not worth taking chances, get someone to drive you or sleep in your car if you have to.

I think the officer did the tests out of order for the reason the captain would have expected them in a way so he could try to wing it in the end, the guy could have killed someone while pissed

This chief of police is asking for special treatment. He’s asking him to turn off the video body cam well I gotta see how this plays out because this might be the first cop that actually has a pair of balls to do the right thing.. No matter your status.

I have a quick question. What does it matter if you do the tests or not? If you are intoxicated, refuse to do the tests, they are still going to require you to blow. If you blow over, regardless of whether you do the tests or not, you'll still get a DUI. I just don't understand why you guys always say don't do the tests. Especially if you have had a small amount to drink, wouldn't it be in your favour to do the tests, do them well and maybe convince the officer you don't need to blow? Would appreciate your opinion on this matter

It's possible to fail a FST even if you're sober. If you fail the FST and blow under the limit, you can still be convicted of DUI.

They want as much evidence as possible to ensure a conviction. Do not help them in their investigation. The tests are not there to help you.

I’m stone cold sober and just did the turn and walk and leg lift field sobriety tests in my living room on a dry perfectly level clean hardwood floor and I failed miserably. You are not obligated to help the police build a case against you.

I mean, the cop didn’t even have a black breathalyzer done on him right there on the spot. What are you gonna do? Wait it out till you get to the police department and then wait it out some more before you let them blow on it. Yeah I would’ve given him a probably an F plus.

it was only four blocks why didn't you just walk? I love the officers ethics. at the captain should lose his badge, he knows better and trying to intimidate the officer with his rank. Pretty sure he lacks judgement in other areas of his job.

The cop got a A bec he didn’t treat the captain diff from others bec he is still a citizen and people who take that oath should know better I’m sure the capt wasn’t lenient on other drinking and driving no matter what rank or what high position

Sure, good for the cop to do the right thing. And, 4 blocks or 400 miles, I have absolutely no sympathy for drunk drivers. He was polite, understanding, and still did his job. But, would he really have acted the same if the driver was some "gangbanger"? And what if he didn't have that bodycam? I guess, since there is no evidence otherwise, I should give him the benefit of the doubt about that one. But I wouldn't bet on it.

Not sure I really trust the officer. He knows everything is recorded. If, the captain had kept his mouth shut on camera, things could have gone differently. Just my experience and opinion

I think the arresting officer should be reprimanded for turning off the camera and making deals with a drunk to turn off the camera, and then following through with it even though he’s being arrested, this is bullshit that should’ve been running the whole time without interruption everything should’ve been caught I mean you could’ve just lied to the drunk and said yeah I’ll turn it off and then don’t turn it off and just let it keep rolling because then he would’ve been doing a conspiracy of you know let’s just do this I’ll give you this much money if you just look the other way, and all that crap it would’ve been caught on tape Whatever finagling he was going to attempt so up until this point I was proud of this officer shutting off the video, not so much that is criminal because he used to say that we would’ve never seen this video tape and this drunk cop wanna be why is this officer off, see what I mean. I’ll see what these lawyers say about I’m shutting it off because that is just totally know. The good cop just broke his own oath in law and that’s criminal on him.

It's only racist if it's code instead of an actual example of who might be arrested. Latin gangs factually exist, and should be treated with exactly the same amount of respect as this cop when arrested.

@@EclipseClemens I think my issue with it is the word “loco” and the fact that’s he’s clearly referring to a specific race when using it as an example. Like why couldn’t he just use a vague term to mean any person committing a crime like, “criminal” or “terrorist.” And talking to you just jogged why this phrase is weird to me. The reason he didn’t say “criminal” or “terrorist” was because he was trying to make two extremes. The President of the United States, to him, was one extreme from good to evil. He subconsciously sees the president as the pinnacle of what a good person looks like. And then he jumped to the opposite extreme. His subconscious idea of the worst kind of a person, is a “south side loco.” He couldn’t say “criminal,” because in his head, “south side locos” are worse than criminals. He didn’t say “terrorist” because “south side locos” are worse to him. He probably wouldn’t admit that. But the fact that he used a racial word to describe the worst person he could imagine is a good indicator of what he thinks about them. They are the worst kind of criminal there is to him. Not just gang members or terrorists or school shooters or whatever else is out there. The “south side loco” is the worst of the worst

From my perspective it seemed like both a person a cop would usually respect and a contrast with a person in organized crime who usually disrespects cops to give context to the professionalism a cop is expected to have. Perhaps I am biased since I consider Latin people to be white (since genetically they are). Thanks for articulating the point so well.

@@PtylerBeatswhen he made the comparison of extremes he said gang banger. Then he said “if I treat you different from a southside loco, or some pedo.” So your point could be he thinks gang bangers are worse then terrorist, but I feel like you’re jumping through hoops to find fault with someone.

Well, as she is doing her commentary on what transpired here she is saying that he the good cop was doing great however, it’s not great when he shuts off the camera, so it’s beginning he’s being a good cop and covering his ass, but at the point where the sobriety test are over he’s going to be arrested. He agrees to shut the camera off. He’s just as bad as the drunk cop.

I think another option is that the officer was nervous while conducting the investigation. I don't think there is enough evidence to support ill intent and another plausible explanation is a very human one.

The Captain was wasted and he ruined himself by a self-inflicted wound. Responded to a DUI stop like any dopey bum off the street, and therefore he was treated like one. No one should be above the law, not to this degree edit: And thank you to the host (Derek?) for clearly making the moral argument. That is the only angle to be considered here.

But neither one of you three are mentioning the fact that you turned off the camera because the captain told him to when they were done with the sobriety the test. That’s dirty that’s a possible payoff, especially if off-camera he second when we get to the police department I’ll do the breathalyzer there. That’ll blow me some more time, and if you give me a whole Lotta more time to come down off of this to make it less guilty. I got a Lotta cash to give you so you don’t know what happened turn it off that camera should never have happened. I don’t give him an Attaboy at all. I’m done, I have no trust for this cop. He might look good up to appoint, but he still played favoritism and he’s gonna let this cop get away with it. Y’all need to follow up on this and find out what happened in dig into the evidence to find out when he finally did a breathalyzer at the PD
