REASONS WHY DUAL CITIZENSHIP MAY NOT BE A GOOD IDEA?

Dual citizenship; Philippine dual citizenship; Philippine duality citizen; Filipino dual citizenship; Filipino dual citizen; Republic Act 9225; Citizenship Retention and Re-Acquisition Act; Becoming a dual citizen; Rights of a dual citizen; Rights of a Philippine dual citizen; Filipino-American dual citizenship; Filipino-Canadian dual citizenship; Filipino-Australian dual citizenship; Filipino-British dual citizenship; disadvantages of dual citizenship; Why dual citizenship is not a good idea; Is dual citizenship bad? Why some people do not want to become dual citizens?; Downsides of dual citizenship; Why dual citizenship may not be for you?; Dual taxation for dual citizens; Double taxation for dual citizens; Double tax agreement; Dual citizens may lose their social benefits? Are dual citizens subject to tax by both countries? Are dual citizens liable to pay taxes to both countries?; What is conflict of laws or conflicts of law? What are the conflict of law rules? Do dual citizens have divided loyalty? Are dual citizens subject to military service in both countries? Are dual citizens entitled to better rights when facing criminal prosecution? Are there limitations to the rights of a dual citizen? Double tax agreement; social security benefits of dual citizens; Tax treaty; Reasons why dual citizenship is not attractive to some:
Number 1 in the list is that dual citizenship may complicate your tax situation. You may find yourself being subjected to tax liabilities by two governments and therefore, getting taxed twice (double taxation) on the same income. If true, that definitely is not good.
Number 2 in the list is that - As a dual citizen, you may be subject to the laws of both countries - problem may particularly arise when these laws are conflicting.
Number 3 in the list is the possibility of losing one’s social security benefits. If you are receiving social security benefits from your country of current citizenship and residence, are you going to lose it if you become a Philippine dual citizen? As I will be discussing here, concerns about social security benefits are more of a residency issue and has nothing to do with dual citizenship.
For US official website:
No. 4. “Limited U.S. Assistance Abroad”: According to the said website, local authorities may not recognize your U.S. nationality if you are also a national of that country, especially if you did not enter the country using your U.S. passport. The U.S. embassy or consulate’s ability to provide consular assistance may be limited. In the case of the Philippines, however, if you are a Filipino-American dual citizen, you may enter the Philippines and be admitted as a Filipino citizen even if you use your US passport.
According to the official website of the Philippine Consulate General in New York: “As a dual citizen, it is not mandatory to apply for a Philippine passport. You may use your US passport when travelling to the Philippines. You simply have to present your dual documents to the Philippine Immigration Officer as proof of Philippine citizenship, per the Bureau of Immigration’s Operation Order No. SBM-2014-045 dated 30 September 2014 which is in force and still in effect. Incoming Filipinos may present a valid PHL passport, Identification Certificate or a Certificate of Re-acquisition / Retention of PHL Citizenship to be admitted as Filipino citizens.
No. 5. Notification and Access to Detained Dual Nationals: Many countries do not recognize dual nationality under their laws, even if they do not expressly prohibit dual nationality. U.S. consular officials may not be permitted to access U.S. nationals in detention if they are also nationals of the country where they are detained. Dual nationals who are arrested or detained should request that police or prison officials notify the closest U.S. embassy or consulate.
No. 6. Military Service
In the United States, the US government official website says that the US military has been all-volunteer since 1973 but an act of Congress could still reinstate the draft in case of national emergency. Almost all men ages 18-25 who are US citizens or are immigrants living in the US are required to register with the Selective Service, which gets activated only when there is s situation requiring a draft. In Canada, military service is also voluntary.
The Philippines however does not have a mandatory military service although it is now being proposed by the current vice president of the Philippines. We still need a legislation for that.

I am a Fil-Am, born in Philippines, now a naturalized US Citizen based in Las Vegas. When I go to Philippines, they stamp my US passport 1 year balikbayan visa. I have a condo in Makati, I DO NOT have a need to own land, start a biz, work, etc in the Philippines. I only stay in Philippines 25-40% of the year, have fun, visit friends , etc, then I travel to US, Europe, etc, the rest of the year. I am not a dual citizen, just a US citizen. I feel like a "tourist" when I am in the Philippines, but I blend in as a "Filipino", and for me, that is fun! I will keep it like that. Condo is good enough for me. Low maintenance, in Makati, like living in a 5-star hotel, great location, great amenities, good security. I do not want a big house and lot - lots of upkeep, maintenance head ache.. For each his own. my 2 cents.

Am a Filipina wife of a German & a resident for almost 28 yrs. but I maintained my PH citizenship (my husband respected it), as I promised to my father. He permitted me go abroad for my profession (singing) at 19, at first in Okinawa (U.S.Bases), then other key cities in Japan. Got married to a half American-Japanese at 33, divorced after 10 yrs. At a total of almost 54 yrs. residence abroad and my father had passed many years ago, I still want to keep my promise, to be a (proud) Filipino until my last breath❣️ 🎉Mabuhay ang Pilipinas at mga Filipino🎊 🙏💖☮️🍀

I am not against this topic about dual citizenship or whatsoever but I just wanted to share about another CITIZENSHIP which is CITIZENSHIP IN HEAVEN. In the book of Philippians 3:20-21 "But our citizenship is in heaven. And we eagerly await a Savior from there, the Lord Jesus Christ, who, by the power that enables him to bring everything under his control, will transform our lowly bodies so that they will be like his glorious body." We can obtain citizenship in heaven IF WE obey the commandments of the Lord. In the book of Ecclesiastes 12:13 “Let us hear the conclusion of the whole matter: Fear God, and keep his commandments: for this is the whole duty of man." Citizenship on earth is temporal. In the book of 2 Corinthians 4:18 “While we look not at the things which are seen, but at the things which are not seen: for the things which are seen are temporal; but the things which are not seen are eternal.” Colossians 3:2 "Set your mind on things above, not on things on the earth."

Thanks for this video. I'm an American citizen, but a natural-born Filipino. Although I've been thinking of applying for "dual" citizenship for a couple of years now, I've been holding off because of the many the "cons" (which outweighs the "pros") of "dual" citizenship. The "con" part which I am most concerned about, i.e., Philippine law will have jurisdiction over me for anything that happens to me while in the Philippines. And that is something I'm not willing Philippine law to have jurisdiction over me. Why? Keep on reading. Yes, I agree there is no PERFECT justice system but there are GOOD justice system. But as we all know, "justice delayed is justice denied," and that is how justice is administered in the Philippines most of the time. Despite having laws like any democratic country, however, in the Philippines the laws are NOT ALWAYS ENFORCED, especially if the "accused" belongs to a RICH AND POWERFUL family. Let's say I had been raped, beaten to death or even murdered in the Philippines. My family will wait years, if not decades to get justice, or no justice at all! Reasons: Investigation was BOTCHED; investigators/police officers don't have EXPERIENCE and KNOWLEDGE about criminal investigation, and mostly INCOMPETENT to say the least; suspects are not INTEREVIEWED. And when perpetrators are "identified" (through fingerprints or DNA) they are NOT ARRESTED in a timely manner or not arrested at all because the perpetrator belongs to a RICH AND POWERFUL family. And if (and that's a big IF) there was an ARREST, trial takes many YEARS to happen. And by the time the case goes to trial, most of the "evidence" were either missing or destroyed, and the DNA heavily degraded to convict the accused. And that is what "justice delayed is justice denied" especially in the Philippines. I can list Philippine cases I know (rape, murder, robbery, embezzlement, etc., etc.) and some I read in the papers where justice was NOT SERVED because the VICTIMS belong to the masses and the poor and the "accused" are either RICH or WELL-CONNECTED. In short, the Philippine justice system is CORRUPT! I'd rather have the U.S. government have jurisdiction over me because as a U.S. citizen, my LEGAL RIGHTS are (and will be) protected by the U.S. government, not by the Philippine government. It just is and that's the REALITY of it!

Yes, there's a lot of budol budol, in the landownership, inherited from your pre - decessor in interest or grand parents of future inheritance wherein partition is not open yet & an illegitimate cousin all of sudden had a Deed of Sale claiming she bought the entire properties except it's fake signature, & she deleted name of her father from the group of siblings, substitution & conversion of her name, instead, claiming adverse claims w/o - legal title, undated, unexecuted, absent of registration, unpublished & without the indispensable party no resolution can be had. The court accepted it & already conducted a hearing without me. Has no cause of action against me, who is the legal title holder of the land in my name. Whatever, they may be, it will just be those bullies, w/o legal entitlement. Imagine, a fraud almost become source of legal title. And they were suing each other without the legal owner & was only represented without my consent. I was not a defendant or a plaintiff & were figthing for my land that doesn't belong to them. I never sold my inherited land to no one. I even a built my house there.

For most countries, you will be subject to their tax laws if you are staying in that country for most of the year, not whether you are a citizen or not. So even if you are a foreigner and you don't have an ounce of Filipino blood in you but you are residing in the Phils. you will have to report all your income in and outside of the Phils. The bad news for US citizens is that the US subject ALL its citizens to US tax laws even if they are living outside the US. That is why many US citizens who can work remotely and have many assets abroad renounce their US citizenship.

This is just my opinion: wag po sanang magagalit. I am a dual citizen (Filipino -American) and I don't see any problem about it. If you are just to follow rules, regulations and laws of both countries, then you'll not be in trouble. My point is, don't make any illegal things at wala kang maging problema. I am a law abiding citizen. If I have to pay tax twice both in the Philippines and in the US so be it because I am a citizen in both countries. One other possible disadvantage of dual citizenship could be with obtaining a government job that requires a security clearance. A dual citizen has sworn an oath to two countries to put their loyalty in that one country above all others. Of course that is impossible. This could definitely be a conflict of interest that could disqualify someone from employment in some government jobs.

I agree that - presently at least - it would be highly unlikely to cause any problems with most government jobs. However, things can change politically in very short order. Especially when you consider that the former Philippine President Duturte was warming up to both China and Russia and called then sitting President Obama a son-of-a-bitch (the truth gets you nowhere 🤣). I suppose it could also depend on your paygrade. It may not be a problem for a GS-5 but could be for a GM-13 or someone in the Senior Executive Service. My only interest in dual-citizenship is for my fully retired Filipina wife so that she could have more flexibility with property ownership, etc. Personally, I would never do anything that could potentially compromise my U.S. citizenship status even if I did qualify for dual status (which I do not). So yes, dual citizenship will not likely cause most people any trouble, but it's still a noteworthy topic for discussion, and one should consider all the possible ramifications before going ahead with it.

I am a dual citizen, Filipino/Canadian. I remember, when I applied for my dual citizenship at the Philippine Embassy in Ottawa, my first questions was what are disadvantages and advantages of being a dual citizenship? They said, my prime citizenship is Canadian and I don’t need to change my canadian passport to Philippine passport. Applying dual citizenship is that, if you want to buy properties or if one day you decided to stay for a bit longer in the Philippines, or If you have an existing properties in the Philippines , you needed to become a dual citizen. Otherwise, you will pay a huge taxes in the Philippines.Yes,there still an oath of allegiance but I asked one of the employee and who was assisting me for my dual citizenship application what are the disadvantage of of being dual citizen, nothing they said. I asked again do I need to pay my taxes in the Philippines. Yes if you have your properties. But, whatever income I have here in Canada there’s nothing to do about taxation in the Philippines. Same here Canada,if I have property(ies)here in Canada, I have to pay my taxes here. and Philippine government has nothing to do about my taxation where I am presently staying and working. Not unless if you’re an OFW( I guess). There’s a bit confusion about he is saying in his video.May be he is right. But I asked directly the Philippine embassy regarding advantage and disadvantage of a dual citizenship. They clearly said nothing disadvantage.

Exactly! I'm a dual citizen too french/filipino at tama lahat ng sinabi mo. You only pay tax in the Philippines if you purchased properties there and have it declared it's normal. Bumili ako ng lupa sa pinas but didn't declare it here in France why do i have to? French has nothing to do with that and same with our property here in France. Wlang pakialam ang pnas sa bahay nmin dto. We pay taxes here in France it's normal because we live here. In Philippines I will only pay dun sa sa tax ng lupa Na binili ko that's it. Wala nman nka sulat sa income tax form if you have properties outside France lol . It took me almost 20 yrs bago ako nag apply ng french citizenship but my husband told me Na mag apply at mag apply ng dual. Because kpag nagka ruon ng gulo like sample sa pnas e a acknowledge ako ng french govt. and vice versa. Wla din sinabi yung Phils.embassy Na disavantages of having dual citizenship.

@@09Hope In 2003 I got my Green Card. In 2009, I applied for my US citizenship. My primary reason? When I traveled in the UK and France back in 2004, I had to get a visa for the UK and a Schengen visa for France. When I traveled in Italy in 2006, I had to get a Schengen visa. Too much hassle. Once I got my US citizenship, I was able to travel in Europe without a need for a visa. Another advantage - "Permanent residents have the right to work and live in the U.S. indefinitely, as well as the right to petition for close family members for a Green Card. However, because Green Card's relatives are considered preference relatives, this process takes considerably longer than for a U.S. citizen."

Most of your presentation refers to duel Filipino/US citizens and briefly Filipino/ Canadian citizens. My wife who is a natural born Filipino, has now been approved for Australian citizenship, but with family and cultural ties to the Philippines, is now considering having duel citizenship (which I as an Australian, deeply respect). With due respect, I believe that an Australian passport does have some advantages over a Philippines passport when traveling to many countries more freely, however giving up one’s birthright is not an easy thing to do and anyway it’s extremely unlikely that there would ever be a conflict between our two nations for we are a nation that recognises our responsibilities as a Asia/Pacific nation and as a global nation. So my wife would like to know what are the disadvantages of being a duel Filipino/Australian citizen? As for me (an Australian citizen by birth), I’ve been fortunate to have traveled to many countries around the world with just my passport (no visa required) and I’ve been asked many times where I came from, my answer is, I’m an Australian and proud to be an Australian, but I also consider myself to be a citizen of the world for there are many beautiful places where I’d happily live and isn’t that’s the way it should be, for once you meet other people as equals, you quickly realise that we are all the same no matter where w e come from.

Yup, the justice system in the Philippines is almost non-existent, especially if you are not very rich or don’t know the “right” people. It’s so slow and ripe with incompetence and corruption. We are having problems with our relatives who are trying to steal our properties and we have been waiting for a judgement for more than 8 years. We have all the legal documents for our properties but somehow the would be thieves are finding ways to delay the proceedings with the blessings of the judge. It’s infuriating.

I will never ever exchange my U.S. citizenship for a Dual Citizenship. My parents worked hard to attain a citizenship for the future of their children and this will not go to a dumpster just because a Philippine government will find a way to get money from US citizens. Besides, the American law changes depending who’s seated in the government and can change the status on Dual Citizenships. If there will be a war in the Philippines, the USA government will vacate US citizens first before any other citizens of the world just like what happened in Vietnam. Never, that’s a wrong move people!!!!!! Filipino US citizens don’t make your life too complicated keep your U.S.A. citizenship, remember how you worked hard to become one!!!!

Having dual citizenship does not mean you loss your foreign citizenship if you are a Filipino. And that was also recognized by Canada and US. The benefit of dual citizen is you can stay in the Philippines as long as you want with out paying for overstaying especially when you are retired and want to stay for good in the Philippines.

So it’s more advantageous to be dual rather than not , as I said if you go home to the Philippines for than 6 months you pay I think you pay there is Philippines bc if you have salaried income pension ( not supplemental income ) you will continue to receive it wherever you are ..but if you don’t receive for any reason you have to call source of income why you are not receiving your salary , that’s a big hustle plus you pay for long distance e fee ..❤ from USA

@@YourLawyer I am a dual citizen (PHIL-US) thru re.acquisition. The person from the Phil embassy based in New York, assured the US before we applied that there will be no double taxation. But watching this video just confused me. I am a senior citizen, redifing mainly in the Philippines. All my income (no business) comes from the US. Zero income earned here in the Phil. Do I need to file income tax here? Thank you.

There is no disadvantage of being dual citizens as long as you pay your yearly income tax here in USA if you do not have income in Philippines thenyou don’t have to file income tax , my daughter is US born too but no plan of applying dual .. the advantage of being dual is you can stay in Philippines as long as you like. But if you are not dual , after 6 months you pay certain amount that’s the problem of my cousin in law he has to pay more than 50,000 pesos here in Philippines so he never comes back here in USA

Get your Filipino citizenship. You need autonomy of both country. Dual citizenship is a privilege. Such privilege can be repealed or revoked. Kaya kumuha ako niyan because anything can happen and you have a second choice. May possibility dual citizenship could ne repealed, revoked if not end this privelege to Filipinos abroad.

I have heard of some crime committed in the Philippines and some sentencing seamed harsh while others seamed fair. This could be said for my country as well. However, the prison system in the Philippines is a disaster. Putting children with adults is not wise. I hope they change this soon. It's best to obey the laws and not go to prison. God bless the Philippines ❤
